CITY OF DUBLIN "'9ENDA STATEMENT CITY COUNCIL MESTING DATE: February 22, 1993 SUBJECT: paratransit Services EXHIBITS: Amendment to Agreement RECOMMENDATION: Approve Amendment to Agreement FINANCIAL STATEMENT: The Fiscal Year 1992-93 adopted budget includes a $1,500 contribution to fund paratransitservices. DESCRIPTION: On July 1, 1988, the Livermore-Amador v,lley Transit Authority (LAVTA) assumed responsibility for the provision of Para- transit services for special transportation of elderly anq handicapped persons in the City of Dublin. As a result of this transfer, LAVTA directly receives the city's Transportation Development Act annual allocation for paratransit services. During the Fiscal Year 1992-93 budget deliberations, LAVTA requested a subsidy of $1,500. The City of Dublin approved this request. In addition to funding the LAVTA budgetary shortfall, the City's contribution will help LAVTA offset the costs associated with expanding Dial-A-Ride services to meet the requirements of the Americans with Disabilities Act. In order to release the funds to LAVTA it is necessary to amend the current agreement. It is recommended that the City council approve the attached Amendment to Agreement and release the City's contribution of $1,500. --------------------------~---------------------~--------------------- ITEM NO. COPIES TO: CITY CLERK FILE ~ e e SECOND AMENDMENT TO AGREEMENT DATED March 28, 1988 Between the City of Dublin and Livennorel Amador Valley Transit Authority Providing a City Contribution for F:ascal Year 1992-1993 This Agreement is entered into this day of by and between the Livermore/Amador Valley Transit Authority (hereinafter referred to as II AUTHORITY II) and the City of Dublin, a municipal corporation (hereinafter referred to as "CITY"). WHEREAS, the AUTHORITY and the CITY entered into an agreement dated March 28, 1988, whereby the AUTHORITY assumed operation of City's Dial-A-Ride Paratransit Service for special transportation of elderly and handicapped persons; and WHEREAS, Section 2 of Said Agreement limited the City of Dublin's obligation to provide funding to a contribution for Fiscal Year 1988-89 only; and WHEREAS, in amendments dated August 13, 1990 and June 27,1991, the City of Dublin agreed to make a contribution for Fiscal Years 1990-91 and 1991-92; and WHEREAS, PUC 99268.5 and MTC Resolution Number 1209 set a fare local match ratio of 10 percent for operators qualifying as IISpecial Transit Service" claimants; and WHEREAS, the AUTHORITY cannot meet the 10 percent fare local match ratio through passenger fares alone; and WHEREAS, the Dublin City Council appropriated a contribution to the AUTHORITY of $1,500 in the approved Fiscal Year 1992-93 Budget. NOW, THEREFORE, the parties agree as follows: A. Section 2 of the agreement dated March 28, 1988 shall be amended to read as follows: Section 2. The CITY shall provide a contribution to AUTHORITY for Fiscal Year 1992-93 in an amount of One Thousand Five Hundred Dollars ($1,500). This funding shall be used by AUTHORITY to conform to the PUC mandated fare local match ratio of 10 percent for the Dublin Dial-A-Ride Service. . .' e e IN WITNESS WHEREOF, the parties hereto have executed this Agreement by their duly authorized officers and representatives as of the date indicated.
