FINANCIAL STATEMENT: GHC Roxbury, LLC, has provided a Maintenance Bond in the
amount of $762,175.00 (Bond No. 868716-M) to replace the
Performance and Labor and Materials Bonds that guaranteed the
improvements. The Maintenance Bond will guarantee against
defects for one year. Once these improvements have been accepted,
the City will incur no maintenance costs. All streets are Private
Streets, and these Private Streets and landscaping within common
areas will be maintained by the Tassajara Creek Homeowners
Association and the Tassajara Creek Maintenance Association.
DESCRIPTION: GHC Roxbury, LLC, recently completed improvements associated
with Tract 7414, Tassajara Creek Phase III. This subdivision, which is comprised of 108 single-family
lots and 1 estate lot, is located in eastern Dublin west of Tassajara Creek at Creekview Drive. The work
was governed by an Improvement Agreement approved by the City Council via Resolution No. 95-04 on
June 15, 2004. Additional work governed by two separate Improvement Agreements for the construction
of Maymont Lane Bridge and Somerset Lane Bridge was accepted by the City Council via Resolution No.
16-06 on February 21,2006.

Since the improvements have been constructed pursuant to the Improvement Agreement and to the
satisfaction of the Public Works Director, it is appropriate for the improvements to now be accepted by
the City. All streets are Private Streets, and these Private Streets and landscaping within common areas
will be maintained by the Tassajara Creek Homeowners Association and the Tassajara Creek Maintenance
Association.
The following regulatory traffic control devices will be accepted and approved as part of this project and
added to the City of Dublin Traffic Code:
A. Hillbrook Place, Maymont Lane, and Somerset Lane are designated as "Private Streets."
At the time that the City and GHC Roxbury, LLC, executed the Improvement Agreement, the developer
provided Performance and Labor and Materials Bonds each in the amount of $3,048,700.00 to guarantee
performance of the work for the subdivision. Now that the work is complete, these bonds may be released
in accordance with the authority contained in Section 966499.7 of the Government Code, and replaced
with a Maintenance Bond in the amount necessary to guarantee the work for a one-year period following
acceptance. The developer has provided a Maintenance Bond in the amount of $762,175.00 (Bond No.
868716-M), which is sufficient to guarantee the improvements for a one-year period after acceptance.
Staff recommends that the City Council adopt the Resolution accepting the improvements associated with
Tract 7414, Tassajara Creek Phase III, and approving the regulatory traffic control devices.

ACCEPTANCE OF IMPROVEMENTS AND APPROVAL OF REGULATORY TRAFFIC
CONTROL DEVICES ASSOCIATED WITH TRACT 7414, TASSAJARA CREEK PHASE III
(GHC ROXBURY, LLC, A DELAWARE LIMITED LIABILITY COMPANY)
WHEREAS, the subdivider of Tract 7414, filed on June 28,2004, in Book 275 of Maps at Pages
66 - 80, previously entered into an Improvement Agreement with the City of Dublin to improve said Tract
in accordance with plans and specifications on file with the Public Works Director, said Tract identified as
follows:

WHEREAS, the Maymont Lane Bridge and Somerset Lane Bridge improvements, as governed by
two separate Improvement Agreements for Tract 7414 were completed and accepted by the City Council
via Resolution No. 16-06 on February 21,2006; and
WHEREAS, the street improvements associated with Tract 7414 are complete in accordance with
said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public
Works Director; and
WHEREAS, the developer has installed certain regulatory traffic control devices as part of the
Tract improvements; and
WHEREAS, the original Performance Bonds and Labor and Materials Bonds that guaranteed the
Street Improvements can be released, in accordance with the authority contained in Section 966499.7 of
the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the
completed work for a one-year period following acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
1. The street improvements completed within said Tract are hereby approved and accepted
subject to a one-year guarantee period.
2. The traffic regulatory devices installed by the developer are hereby included in the City of
Dublin Traffic Code, said regulatory devices to include the following:
a) Hillbrook Place, Maymont Lane, and Somerset Lane are designated as "Private
Streets."

3. The original Performance Bond issued by Developers Surety and Indemnity Company
(Bond No. 868716S) in the amount of $3,048,700.00 be released; and
4. The original Labor and Material Bond issued by Developers Surety and Indemnity
Company (Bond No. 868716S) in the amount of $3,048,700.00 be released; and
5. The submitted Maintenance Bond issued by Developer's Surety and Indemnity Company
(Bond No. 868716-M) in the amount of $762,175.00 be accepted as security for the
aforesaid one-year maintenance period, said period to commence on this date and terminate
on the 18th day of September, 2008, and
PASSED, APPROVED AND ADOPTED this 18th day of September, 2007, by the following
