HomeMy WebLinkAboutReso 038-00 Oil RecyclingRESOLUTION NO. 38 - 00 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AUTHORIZING SUBMITTAL OF A THREE YEAR USED OIL AND OIL FILTER RECYCLING GRANT TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD FOR $29,925 AND APPROPRIATING THE FUNDS WHEREAS, the people of the State of California have enacted the California Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil; and WHEREAS, the California Integrated Waste Management Board (CIWMB) has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by cities and counties under the program; and WHEREAS, the City of Dublin (City) will enter into an agreement with the State of California for the development of the projects as specified in the grant application; and WHEREAS, procedures established by the CIWMB require the grant applicant to certify by resolution the approval of said application; and WHEREAS, the City will submit a grant application for the 6~ Cycle Used Oil Recycling Block Grant (FY 2000-03) for used motor oil and oil filter collection and recycling services and public education activities by April 6, 2000; and WHEREAS, all jurisdictions in Alameda County are member agencies of the Alameda County Waste Management Authority (ACWMA), a regional Joint Powers Authority (JPA) that was formed for the purpose of, and having expertise in, recycling and solid waste project planning and implementation; and WHEREAS, the ACWMA is empowered to make and enter into contracts with its member agencies, inclutling either to receive or provide services; and WHEREAS, the City, as a member of the JPA, would benefit from a regional effort led by the ACWMA to educate the public about used oil and oil filter recycling; and WHEREAS, the City and other Alameda County jurisdictions have agreed, but not committed, to provide a percentage of 6th Cycle Used Oil Recycling Block Grant funding to the ACWMA to provide regional used oil and oil filter recycling services; and WHEREAS, if the ACWMA and other Alameda County jurisdictions agree to implement regional used oil and oil filter recycling projects, the City agrees to designate and transfer 95% of its 6th Cycle Used Oil Recycling Block Grant funds to the ACWMA for the used oil and oil filter recycling regional projects; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby approves a grant application to be submitted to the CIWMB for an approximate amount of $29,925 for the 6t~ Cycle Used Oil Recycling Block Grant for used motor oil and oil filter collection and public education activities; and be it BE IT FURTHER RESOLVED that the City Manager or his/her designee is hereby authorized and empowered to execute in the name of the City all necessary applications, comracts, payments requests, agreements and amendments hereto, subject to the review and approval of the City Attorney's office, for the purpose of securing grant funds and to implement and carry out the purposes specified in the grant application provided that the contracts shall be reviewed and approved by the City Attorney's Office and shall be filed with the City Clerk's Office. Should additional funds be received, the City Manager or his designee is hereby authorized to appropriate same for the purpose described above; and, be it BE IT FURTHER RESOLVED that, should the ACWMA, other Alameda County jurisdictions and the City agree to implement regional used oil and oil filter recycling projects, the City Manager or his/her designee is authorized to negotiate and execute an agreement with the ACWMA, subject to the review and approval of the City Attorney's Office, that'provides for 95% of the grant funds received from the CIWMB for the 6th Cycle Used Oil Recycling Block Grant be payable to ACWMA for providing regional used and fiker recycling services; and be it BE IT FURTHER RESOLVED that the City Council authorizes the appropriation of grant funds and the increase in the City's estimated revenues upon execution of the agreement with the CIWMB.
