DESCRIPTION: Section 19850 of the Health and Safety Code
requires the Building Department to maintain copies of plans for
certain specified buildings for the life of the building.
Section 34090 of the Government Code provides that approval of the
city Council and written consent of the city Attorney is required
prior to destroying records that are more than 2 years old.
The Building Department files contain many records of permits, plans
and correspondence regarding buildings or structures that no longer
exist. Examples are as follows:
1. Signs for businesses that have relocated or have discontinued
business.
2. Plans for buildings or structures that have subsequently been
demolished.
3. Plans for buildings or structures for which permits were issued,
but were never constructed.
4." Records of permit refunds granted by Alameda County and receipts
for miscellaneous fees collected by Alameda County.
5. Alameda County Planning documents which are also contained in the
city's planning files.
6. Alameda County notices and other documents relating to abandoned
vehicles.
It is the opinion of the Building Official these files are no longer
necessary. /
The Building Department has a volunteer who will be available on a
part-time bases to purge the files of the above documents. This will
reduce additional file space requirements significantly.
