REPORT PREPARED BY: EXHIBITS ATTACHED: RECOMMENDATION: :, \LiP1} Adopt Draft Resolution relating to the Fourth of July Celebration FINANCIAL STATEMENT: None DESCRIPTION: On May 17, 1993, the city of Dublin received a letter from Kathi Schultz, Chairman of the Dublin Chamber of Commerce Business Development Committee (see Attachment 1), in which she explained that the Committee had planned on organizing a Fourth of July Celebration for 1993, but, due to time constraints, were postponing the event. The Committee did request, however, that the city Council waive all fees associated with outdoor sales for those businesses wishing to participate in sidewalk sales during the July 2-5 weekend. Staff discussed the issue of a Fourth of July Celebration with Ms. Schultz, and determined that a sidewalk sale on that weekend could be allowed, similar to the st. Patrick's Day sidewalk sales. Staff developed a Fourth of July Sidewalk Sales Application form (see Attachment 2) to provide guidelines for individual businesses interested in participating in the event. It should be noted that participation in this citywide outdoor sales event would not preclude a business from holding an additional, separate outdoor sales event in the month of July. The Business Development Committee has indicated that the Chamber of Commerce will 1} coordinate the sidewalk sale as a citywide event and 2} be responsible for notifying Dublin businesses of the Fourth of July sidewalk sale (see Attachment 3). Staff recommends the city council adopt the draft resolution (Exhibit A) relating to the Fourth of July Celebration. RESOLUTION NO. -93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ~~~---~----------~---~-----~-----------~-------------------~---~---~-- SUPPORTING THE 1993 FOURTH OF JULY CELEBRATION WHEREAS, the City of Dublin and the Dublin Chamber of Commerce have joined together for the planning of the 1993 Fourth of July Celebration; and WHEREAS, in an attempt to gain business participation in the celebration it has been recommended that businesses be allowed to conduct sidewalk sales over the Fourth of July weekend (July 2-5, 1993); and WHEREAS, it has been recommended that participation in the Fourth of July Celebration sidewalk sale not preclude a business from holding an additional, separate outdoor sales event in the month of July; and WHEREAS, it has further been recommended that 1) the City Council waive the outdoor sales processing fees and the promotional sign processing fees and 2) a waiver of two (2) weeks of promotional sign display be granted to those individual businesses that a) obtain promotional sign permits, b) include "Dublin Fourth of July Celebration" in the signage, and c) display the signage two (2) weeks or less prior to the July 2-5 celebration; and WHEREAS, the City Council finds that approval of these requests promote the Fourth of July Celebration in a positive manner. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve the request for sidewalk sales and promotional signs. Box 2340 Dublin, California 94568 Dear Mayor Snyder & Councilmembers: The Business Development Committee of the Dublin Chamber of Commerce has held two meetings to date to discuss plans for organized sidewalk sales within the City of Dublin. It was suggested that the Fourth of July weekend would be an ideal time for an outdoor sale. Regretably, the Committee has concluded that there is not sufficient time to adequately plan an organized outdoor sale for the Dublin business community. However, we would like to request that the City Council consider lifting the restrictions currently in place as ~/ell as waive all fees associated with an outdoor sale for all businesses wishing to participate in the holiday festivities in the form of a sidewalk sale on the Fourth of July weekend. Another meeting of the Business Development Committee has been scheduled for May 26, 1993 at which time we will consider plans for a Fall sale. We look forward to working with the City to structure a new outdoor sale ordinance which is workable and agreeable to all concerned. The Duhlin hased merchant, or non-profit organization, shali provide a simple site plan and photographs wirh the Appiicarion to demonstrate that the display/sale, area (including equipment, tahles, stands, etc.) dnes not' obstruct ingreSs or egress to the tenant space; block pedestrian movement on the sidewalk; shift pedestrian traffic into the adjoining drive/fire lane aisles; block fire protection appliances or fire lanes; or obstruct motor vehicle drivers' sight distance of the sidewalk or parking areas. . The outdoor sales event is liroited to a maximum of four days (July 2-5, 1993] . A pedestrian barricade (pylons, rope, vinyl tape, etc.) shall be installed around the perimeter nf the display area to protect patrons from vehicular traffic. . plans for temporary promotional advertising (balloons, banners), or identification signs for each sales event shall be submitted to the Planning Director for review and approval a minimum of three (3) days prior to the heginning of the sale' event. Each sign shall be attached to posts, fencing or walls so that they will be secure and will not present a safety hazard. The signs shall not block pedestrian or motor vehicle drivers' view of roads, sidewalkS or parking lots. . The Applicant shall provide adequate security on site, subject to the Dublin police services' review and approval. . operation of the outdoor sales events shall be conducted so as not to create a nuisance to adjacent properties. . The Applicant shall be responsible for maintaining the site and surrounding area free and clean of any project related debris. . All sales merchandise shall be removed from the site at night for security purposes. . All debris, merchandise, fencing, display equipment and the like shall be removed from the site and the site restored to a clean and orderly condition by 8,00 a.m. the day following the last day of the event. A simple application form has been developed and is available through the City Planning Department for those businesses wishing to participate in a sales promotion. The Dublin Chamber of Commerce vIill be handling the coordination of this event including the notification of the business community about the promotion.
