FINANCIAL STATEMENT:
The City would receive any fees collected for issuance
of licenses. It is anticipated that revenue would be
minimal.
DESCRIPTION As part of the comprehensive Municipal Code revision,
the City Attorney's Office has prepared an ordinance requiring the licensing
of kennels.
This ordinance establishes procedures by which the City can control the
operation of kennels. The ordinance requires an applicant to obtain any use
permit required by the Zoning Ordinance prior to the issuance of the kennel
license. The ordinance is based upon the current County ordinance. At the
present time, it is Staff's understanding that only one kennel operates
wi thin the City. This facility is located at the southern end of Donlon
Way.
This ordinance was introduced at the City Council meeting of March 23, 1987.

AN ORDINANCE OF THE CITY OF DUBLIN ESTABLISHING
LICENSING FOR KENNELS
The City Council of the City of Dublin does ordain as follows:
Section 1.
DEFINITIONS:
(a) KENNEL. "Kennel" shall mean any place where more than
five (5) dogs are kept or maintained for breeding
purposes, training, treating, sale or other commercial
purposes.
(b) DIRECTOR. "Director" shall mean the City Manager or his
authorized representative.
(c) OWNER. "Owner" shall mean any person, firm, or
corporation keeping or maintaining any kennel.
Section 2. KENNEL LICENSE REQUIRED: Every person owning or
controlling a kennel within the City shall, within ten (10) days
after commencing to keep or maintain a kennel, and each year
thereafter on the anniversary date of such license, procure a
kennel license from the Director. Each applicant for a kennel
license shall pay a license fee in the amount established by City
Council resolution.
Section 3. CERTIFICATE SIGNED BY COUNTY HEALTH OFFICER:
REQUIRED BEFORE LICENSE IS ISSUED: No kennel license shall be
issued without a current certificate signed by the County Health
Officer first having been obtained that the kennel is operated or
is to be operated in accordance with applicable law.
Section 4. USE PERMIT: No kennel license shall be issued
without a use permit, if any is required, by the City Zoning
Ordinance.
Section 5. ISSUANCE OF LICENSE: The Director shall issue
kennel licenses to applicants who have met requirements of this
Chapter.
Section 6. DOG REMOVED FROM KENNEL: LICENSE TAG MUST BE
ACQUIRED: When any dog is removed from a kennel and is kept at
any place in the City other than a kennel, the owner shall obtain
a license tag for the, dog pursuant to City ordinance,' within ten
(10) days after its removal from the kennel.
Section 7. KENNEL LICENSE NOT TRANSFERABLE: No kennel
license issued pursuant to this Chapter is transferable.
Section 8. MAINTENANCE: Every dog kennel shall be
maintained in a manner satisfactory to the Director.
Section 9. INSPECTION: Any premise licensed as a dog
kennel pursuant to this Chapter may be inspected by any City
official at any reasonable hour.

Section 10. This Ordinance shall supersede the provisions of
Chapter 2 of Title 2 of the Alameda County Code, as adopted by
Dublin Ordinance No. 13.
Section 11. EFFECTIVE DATE AND ,POSTING OF ORDINANCE. This
Ordinance shall take effect and be in force thirty (30) days from
and after the date of its passage. The City Clerk of the City of
Dublin shall cause this Ordinance to be posted in at least three
(3) public places in the City of Dublin in accordance with Section
36933 of the Government Code of the State of California.
