authOrIty of the Cahforma Pubhc Resources Code, DIvIsIOn 17, Section 26500 et seq
II BACKGROUND
For thc Fallon Vtllage ProJect, CIty of Dubhn Condition of Approval No 76 reqUIres the
formatIOn of a GeologIC Hazard Abatement Dlstnct ("GHAD") The developer of Fallon Village
has submItted a Plan of Control to allow the Dlstnct to permanently mOllItor and mamtam
GHAD Improvements The establIshment of an assessment level to fund the GHAD
responsibIlIties IS descnbed In thiS Engmeer's Report
III GEOLOGIC HAZARD ABATEMENT DISTRICT BOUNDARIES
The boundarIes for thc GHAD are shown m the diagram attached hereto as ExhibIts A and B
IV SERVICE LEVELS
lhe GI-IAD's activIties are those that arc necessary or InCidental to the preventIOn, mitigation,

The GHAD-mamtamed Improvements are descnbed In the Fallon VIllage Plan of Control dated
May 8, 2007 In general, these Improvements Include water quahty factlltles, debrIS benches,
dramage ~ystems, mcludmg concrete v-ditches m open space and on the hIllSides, open-space
storm draIn Inlets and outlets, subdrams m open space and creek corndors, reconstructed slopes
wIthm the open space area, and access roadways

VI ASSESSMENT METHOD
The GHAD-mamtamed lmprovements descnbed m Section V are dIstnbuted wIthm the
Fallon Vtllage boundarIes Mamtenance and protectIOn of these Improvements provide a special
benefit to all residential or commercial property owners withIn the Fallon Village GHAD There
lS no benefit for propertIes outSIde of the dlstnct The Engmeer hereby finds that these
propertles wlthm the GHAD receive approximately equal speclal benefit from the work and
Improvements wlthm the GHAD As a result, the GHAD assessment IS dlstnbuted among all
owners of parcels which are bUildable wlth habItable space
Smgle-famtly resldenhallots WIll be assessed as one umt Non-resIdential bUIldmgs are assessed
per square foot of habitable area Habitable square footage IS space, "used or tntended Jor
supporting or sheltering any use or occupancy whIch IS expected to have a human occupancy
rate oj more than 2 000 person-hours per year" (Adapted from Califorma Code oj RegulatIOns
Tale 14 DIVISIOn 2 SectIOn 3601) The total number of resIdential umts and non-residential area
wlthm the DIStrIct IS then diVIded Into the annual Dlstnct budget to develop the annual
asse5sment amount
A finanCial analysIs was performed to prOVide a framework for an operatmg budget for the
on-gomg abatement, mItIgatIOn, prevenhon and control of geologIc hazards WIthIn the GHAD
boundaries In preparation of the budget, several factors were conSidered Includmg

VII ASSESSMENT LIMIT - BUDGET
Based on the estimated expenses for on-gomg operatIOns, and allowmg for a larger
(approximately $1,000,000) geologic event at 1 a-year mtervals, a budget was prepared for the
purpose of estImatmg ImtIaI assessment levels (ExhIbIt C) In order to establIsh a reasonable
reserve m the early years of the Fallon VIllage GHAD, there WIll be an mItIal deferral ofGHAD
expenses as descn bed m Plan of Control for the Fallon VIllage development
The Engmeer recommends an annual assessment hmlt for the Fallon Village development of
$488 per detached smgle-resldentIal umt, (FIscal Year 2007/2008 dollars) The proposed mItIal
assessment level of $488 for detached smgle-famIly umts Will be adJusted annually to reflect the
percentage change m the San Franclsco.Oakland-San Jose Consumers Pnce Index (CPI) for All
Urban Consumers The assessment hmlt wtll be adJusted annually usmg an mItIal date of
December 2007 for the CPI for both the reSIdential and non~resldentlal assessment limIt Each
subsequent annual adJustment WIll be calculated usmg the 12-month penod from December to
December The Engmeer also recommends an annual assessment hmlt of $005 per square foot
of habItable non-resIdentIal space The reSIdentIal and non-residential assessments are to be
levied m conJunctIOn Wlth the Issuance of a Fmal Map for the area contammg the habitable
bmldmg
