RECOMMENDATION: AuthorizeStaff to advertise Contract 87-5 for bids. FINANCIAL STATEMENT: Estimated Cost: Design and Inspection Construction $ 3,500 26,500 $ 30,000 DESCRIPTION: This project provides for construction of approximately 2,000 feet of chain-link fence on the east side of Dougherty Road north of Amador Valley Blvd. The City agreed to construct this fence as part of the City's agreement with the Army for a road right-of-way easement along the east side of Dougherty Road which will enable the City to widen Dougherty Road to its ultimate width in the future. The fence will be placed behind the berm that was constructed by Rafanelli and Nahas as part of the required improvements for the Villages at Alamo Creek development. Staff recommends that the City Council authorize Staff to advertise for bids for the construction of the fence. ITEM NO. ~.%.~ COPIES TO: Col. In connection with the grant of the easement, City is to provide new security fgncing, construct a new main entrance to PRFTA at a ~ location, and establish a~to the new roadway alignment. Your requept has been a.~pproved in rinciple by the U.S. Army Forces Command. Although the corre~po~deh-ce received in this District authorlzg~ separate easements for the roadway and for the berm, we are investigating the feasability of issuing a single document. In view of your urgent necessity, you ar'e hereby gr~nted permission to occupy the proposed easement right(s)-of2way,' subject to the following: a.- That you agree to accept the provisions and conditions of the enclosed standard Department of the Army Easement for Road or Street, ENG Form 547. JUL 1986 .- b. -That because.~ou-desire, to proceed-in edvence of negotiation, p~ocessing, execution and delivery of the formal instrument(s),-you-further agree to accept.and be bound in the formal instrument(s) by such other special conditions which the Government may determine and incorporate therein as are reasonable and proper to protect its interests, including services or compensation~ as.it .shall specify...The.easement(s) as proposed will be granted for an indefinite term and without charge for the right (s)-of-way. c. That with respect to the easement area(s), it is mutually understood by and between the Secretary of the Army and the CiTy of Dublin as follows: .... 1.- That this Right-of-Entry is. effective only insofar as the rights of the United States in the premises are concerned and shall .obtain further permission on account of- City any necessary any other existing rights. ~:~ e~ o~ 2. .That from the beginning of work within the easement area(s) in exercise of the rights herein granted,~'the improvements established By City. except any fencing and gating on PRFTA,.shall he and remain the property of City. which shall thereafter have the responsibility for their maln, K~nance and, if such is directed, for 3..That in the event constrmction of said improvements and installation of said fencing and gating are begun but not completed, the Government willdetermine whether title will vest in it or whether the site(s) by City at no cost shall be restored %he to the Government. 4. 'That City shall.not.unlawfully pollute the alt, ground or water or create a public nuisance and shall, at no cost to the United States, promptly comply with present and future Federal, State and local laws, ordinances, regulations or instructions controlllng the quality-of the environment. This does not affect the right of City to contest their validity or enjoin their applicability. 5. That City shall comply with all appllcable laws, statutes, ordinances and regulations of all competent public authority having jurisdiction in the prem/ses, per~alning to said easement area(s), with regard to construction, maintenance, safety, sanitation, railroad operations, water quality, licenses, permits. consents, compliances and all other matters. · . 6..- That a1.1 matters.of ingress,.egress, i~stallation of gating and fencing, contractor haul routes and construction activity, in connection with the rights herein granted, shall be coordinated with the Commander, PRFTA, and that all excavation, construction, and installation shall be accomplished during periods acceptable to the Commander, PP~TA. .. 7. That with respect to the-easement area(s),~City's project will be accomplished without cost or expense~to the Government. .. 8. That final design.and construction or'THe-prop~e~ berm, fencing and entrance .gating shall be approved by the Commander, .Presidio of San Francisco or his authorized representative. 9. That City's use of the easement area(s) shall in no way ~terfere wi:h Department of the the United States Army Reserve (USAR) Center,.excep~ for any te~ora~ ~terference during const~ction that may be approved the respective Co=ander or his authorized representative. 10. ~at US~ proper~ will be kept clear for ingress and egress at all times. · 11..
