HomeMy WebLinkAboutAttachmt 1 Reso Recommnd CC Adopt Ordnc Appv Phase I RESOLUTION NO. 08 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN RECOMMENDING CITY COUNCIL APPROVAL OF PHASI: 1 OF THE COMPREHENSIVE ZONING ORDINANCE AMENDMENTS INCLUDING CHAPTER 8.04, TITLE PURPOSE, AUTHORITY AND ADMINISTRATION, CHAPTER 8.12, ZONING DISTRICTS AND PERMITTED USES OF LAND, CHAPTER 8.16, AGRICULTURAL ZONING DISTRICT, CHAPTER 8.20, RESIDENTIAL ZONING DISTRICTS, CHAPTER 8.24 COMMERCIAL ZONING DISTRICTS, CHAPTER 8.28, INDUSTRIAL ZONING DISTRICT, CHAPTER 8.34, SCARLETT COURT OVERLAY ZONING DISTRICT, CHAPTER 8.36, HISTORIC DISTRICT OVERLAY ZONING DISTRICT, CHAPTER 8.40, DEVELOPMENT REGULATIONS, CHAPTER 8.44, PERFORMANCE STANDARDS AND CHAPTER 8.46, ACCESSORY STRUCTURES ZOA 07-001 WHEREAS, the City Council, as a high priority goal for Fiscal Year 2006/2007, requested Staff and the City Attorney to work on a comprehensive update of the Municipal Code which includes the Zoning Ordinance; and WHEREAS, the comprehensive update to the Zoning Ordinance has been broken up into several phases with these sections comprising Phase I ofthe comprehensive update; and WHEREAS, the proposed comprehensive update to the ZJning Ordinance is set forth in the proposed Ordinance that is attached as Exhibit A to this Resolution; ald WHEREAS, pursuant to Section 8.120.050.B of the Dublin Municipal Code, the Planning Commission finds that the Zoning Ordinance Amendment is consistent with the Dublin General Plan and all applicable Specific Plans; and WHEREAS, the project has been found to be exempt from the California Environmental Quality Act (CEQA), pursuant to CEQA Guidelines Section 15061(b)(3) because the amendments to Title 8 (Zoning Ordinance) of the Dublin Municipal Code does not have the potential for causing a significant effect on the environment; and WHEREAS, the Planning Commission held a Study Session on December 11, 2007 to discuss Phase 1 of the Zoning Ordinance Amendments; and WHEREAS, the Planning Commission did hold a public healing on Phase1 of the comprehensive amendments to Title 8 (Zoning Ordinance) of the Dublin Municipal Code on March 25,2008, for which proper notice was given in accordance with California State Law; and WHEREAS, a Staff Report was submitted recommending that the Planning Commission recommend City Council approval of Phase 1 of the amendments to Title 8 (Zoning Ordinance) of the Dublin Municipal Code; and WHEREAS, the Planning Commission at its March 25, 2008, meeting did hear and use its ATTACHMENT 1 independent judgment and considered all said reports, recommendations, and testimony hereinabove set forth. NOW THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby recommend that the City Council approve Phase 1 of the Comprehensive Zoning Ordinance Amendment including Chapter 8.04, Title Purpose, Authority and Administration, Chapter 8.12, Zoning Districts and Permitted Uses of Land, Chapter 8.16, Agricultural Zoning District, Chapter 8.20, Residential Zoning Districts, Chapter 8.24 Commercial Zoning Districts, Chapter 8.28, Industrial Zoning District, Chapter 8.34, Scarlett Court Overlay Zoning District, Chapter 8.36, Historic District Overlay Zoning District, Chapter 8.40, Development Regulations, Chapter 8.44, Performance Standards and Chapter 8.46, Accessory Structures, as described in Exhibit A to this Resolution.
