CALL TO ORDER/ROLL CALL
A regular meeting of the City of Dublin Planning Commission was held on Tuesday, April 22,
2008, in the City Council Chambers located at 100 Civic Plaza. Chair Schaub called the meeting
to order at 7:00 p.m.
Present: Chair Schaub; Vice Chair Tomlinson; Commissioners Wehrenberg, and Biddle; Erica
Fraser, Senior Planner; Kit Faubian, City Attorney; and Debra LeClair, Recording Secretary.
Absent: Mary Jo Wilson, Planning Manager, em. King
ADDITIONS OR REVISIONS TO THE AGENDA - NONE
MINUTES OF PREVIOUS MEETINGS - On a motion by em. Tomlinson, seconded by Cm.
Wehrenberg the minutes of the April 8, 2008 neeting were approved with modifications.
ORAL COMMUNICATIONS - Liz King, F:esident at 7721 Lisa Court, spoke regarding the
bushes in front of Dublin High School on Village Parkway, and the tree roots coming up
through the sidewalk across the street from the school. She stated the children are walking in
the bike lane because the bushes block the sidewalk which is cangerous. Chair Schaub asked if
the area was City property or part of Dublin High School. Ms. King responded the area does
not belong to the school but is part of the City sidewalks. She also stated while riding the bus
one of the mirrors was broken because of th~ trees was hanging over the street. Erica Fraser,
Senior Planner stated it is the responsibility of the Public Works Department to trim
landscaping in the City and stated she would contact the Dir~ctor of Public Works to address
Ms. King's concerns.
Ms. King's other concerns were regarding tree roots bringing up the sidewalks and stated she
had fallen three times. She was concerned that any new tree5 that would replace the existing
ones would cause the same problem. Chair S:haub answered that the new trees would be deep
rooted trees and would not cause the same problem. She indicated several areas where the
problem has occurred: in front of the ChevrJn Station on Sar. Ramon Road on the east side; in
front of Carl's Jr. on the south side; and across the street from Los Perico's.
She was also concerned about the new traffic lights at the Dublin Blvd/Dougherty Road
intersection and wanted to ensure there would be a pedestriar WALK sign installed. She felt it
was an unsafe situation without one.
Ms. King was also concerned there are elderly homeowners who must move from their 3 story
condominium because they can no longer climb the stairs and encouraged the Planning
Commission to take that into consideration when approving nEW development.
Chair Schaub thanked Ms. King for her comments.

Ms. Fraser stated she would contact the Public Works Department about Ms. King's concerns
regarding the overgrown landscaping, broken sidewalks and the WALK sign at Dublin and
Dougherty.
Cm. Wehrenberg mentioned the rubber sidewalks the City was reviewing. Ms. Fraser answered
that there are some rubber sidewalks in front of Dublin High ~;chool and the City is researching
their further use. She also commented that trees are now planted with root barriers to prevent
root problems.
Ms. Fraser stated she would contact Jaimee Bourgeois, Traffic Engineer, regarding the question
of the WALK sign at Dublin/Dougherty intersection. Cm. Tomlinson stated that the reason
there is no WALK sign at the southern area of the intersection is because the light is set for
"right on green" with a green arrow.

Uses of Land, Chapter 8.16, Agricultural Zoning District, Chapter 8.20, Residential Zoning
Districts, Chapter 8.24 Commercial Zoning Distric:s, Chapter 8.28, Industrial Zoning
District, Chapter 8.34, Scarlett Court Overlay Zoning District, Chapter 8.36, Historic
District Overlay Zoning District, Chapter 8.40, Development Regulations, Chapter 8.44,

Erica Fraser, Senior Planner presented the specifics of the proje:t as outlined in the Staff Report.
Cm. Biddle mentioned that the date on the resolution needed to be changed from March 25 to
April 22, 2008.
Chair Schaub opened the public hearing and hearing no comm=nts closed the public hearing.
On a motion by Cm. Tomlinson and seconded by Cm. Wehrenberg, on a vote of 4-0-0, with Cm.
King absent, the Planning Commission approved the following:

There was a discussion regarding the timeline for the different phases of the Comprehensive
Zoning Ordinance update. ChaIr Schaub was concerned about the Sign Ordinance update and
felt the Commission should be able to control brightness and content of signs within the City.
The Commission discussed the recent signs that had been installed and a large LED sign that
was recently denied by the Commission. Ms. Fraser stated that she had been researching these
types of signs while working on the update of the Sign Ordinance and found there are no cities
which have a good way of regulating those types of signs and found that most cities ban the
signs entirely.
NEW OR UNFINISHED BUSINESS - Chair Schaub encouraged the Commission to do their
own research when reviewing a legislative action and send it to Mary Jo Wilson, Planning
Manager, so that it can be shared with the rest of the Corrunission. He felt that the more
research that is done the better the decisions are. He stated that in a quazi-judicial action it can
be a problem to bring in outside information because the Commission must act based on the
documents provided. Kit Faubian, City Attorney stated that in the quazi-judicial situation the
Commission is acting as a judge and applying the law rather than making law, therefore, it can
be a problem when bringing in outside material.
OTHER BUSINESS
10.1 Brief INFORMATION ONLY reports from the Planning Commission and/or Staff,
including Committee Reports and Reports by the Planning Commission related to
meetings attended at City Expense (AB 1234).
