CLOSED SESSION - EXISTING L1TIGA TION Government Code Section 54956.9, subdivision a Name of Case: Arroyo Vista Tenants Association et al. v. City of Dublin et al. United States District Court, Northern District of California, Case No. C07-05794 MHP .. A regular meeting of the Dublin City Council was held on Tuesday, April 1, 2008, in the Council Chambers of the Dublin Civic Center. The meeting was called to order at 7 :00 p.m., by Mayor Lockhart. .. ROLL CALL PRESENT: Councilmembers Hildenbrand, Oravetz, Sbranti and Scholz, and Mayor Lockhart. ABSENT: None .. PLEDGE OF ALLEGIANCE The pledge of allegiance to the flag was recited by the Council, Staff and those present. .. REPORT ON CLOSED SESSION ACTION Mayor Lockhart advised that no reportable action was taken. DUBLIN CITY COUNCIL MINUTES VOLUME 27 REGULAR MEETING Aprill, 2008 .. ORAL COMMUNICATIONS Acceptance of Gifts to City from St. Patrick's Dav Sponsors 7:02 p.m. 3.1 (150-70) Recreation Coordinator Lorri Polon presented the Staff Report and advised that the 2008 St. Patrick's Day Festival was held on Saturday and Sunday, March 15 and 16, at the Dublin Civic Plaza and that this year's event highlighted the festival's 25th Anniversary Celebration. The presentation included information on the support from in-kind donations of goods and services from sponsors totaling $43,000. The City Council recognized the sponsors and local non-profit organizations that coordinated events during the St. Patrick's Day Celebration. On motion of Vm. Sbranti, seconded by Cm. Hildenbrand, and by unanimous vote, the contributions were formally accepted by the City Council. .. Recognition and Congratulations to City of Dublin's 2007 Youn!! Citizen of the Year~ Citizen of the Year~ and Or!!anization of the Year 7:10 p.m. 3.2 (610-50) Mayor Lockhart read the nominations and congratulated Terrance VanTuyl the winner of the City of Dublin's 2007 Young Citizen of the Year, Rich Guarienti, the winner of the Citizen of the Year, and Charlene Sigman, representing Happy Talkers/School of Imagination, the winner of the Organization of the Year. Ms. Sigman announced Golf Tournament and Dinner Fundraiser on May 15, 2008. DUBLIN CITY COUNCIL MINUTES VOLUME 27 REGULAR MEETING Aprill, 2008 2 Appointment of New Member to the Housing Committee and Extension of Term of Existin!! Housin!! Committee Members 7:27 p.m. 3.3 (110-30) Community Development Director Jeri Ram presented the Staff Report on the background of formation of the Housing Committee and advised that the City Council approved an extension of the Housing Committee (but not the Committee Members to the conclusion of the preparation of the Housing Element) and recommended the existing members of the Committee be extended for the same duration as the Housing Committee itself. In addition, she advised of a resignation of a member of the Committee representing the residential community and stated the Mayor is requesting that the City Council confirm Rick Runnels to fill the vacancy. On motion of Mayor Lockhart, seconded by Vm. Sbranti, and by unanimous vote, the Council confirmed the appointment of Rick Runnels to the Housing Committee and extended the term of the existing Housing Committee Members to the completion of the Housing Element. .. Appointment of Alternate to Livermore-Amador Vallev Transit Authoritv~ Joint Powers Authoritv (JPA)~ Board of Directors 7:30 p.m. 3.4 (140-95) Mayor Lockhart stated that she and Cm. Hildenbrand are currently the City's representatives on the LA VT A JP A Board of Directors and recommended the City Council approve the appointment of a Councilmember as an alternate, in the event the two Councilmembers currently serving as the City's representatives are unavailable to attend a LA VT A meeting. On motion of Mayor Lockhart, seconded by Vm. Sbranti, and by unanimous vote, the Council appointed Cm. Scholz to serve as the alternate. DUBLIN CITY COUNCIL MINUTES VOLUME 27 REGULAR MEETING Aprill, 2008 3 Public Comments 7:32 p.m. 3.5 Maureen Cornejo, Dublin resident, spoke on the Relay for Life event, Paint the Town Purple, sponsored by the Cancer Society, and requested the Council authorize the event in the City of Dublin. City Manager Richard Ambrose requested Ms. Cornejo provide the City with a letter on the request to be placed on a future agenda. .. CONSENT CALENDAR 7:35 p.m. Items 4.1 through 4.11 On motion of Cm. Scholz, seconded by Vm. DUBLIN CITY COUNCIL MINUTES VOLUME 27 REGULAR MEETING April 1, 2008 5 .. WRITTEN COMMUNICATIONS - None .. PUBLIC HEARINGS Public Hearing Amendment of Dublin Municipal Code Chapter 4.24 (Dru!! Paraphernalia) 7:36 p.m. 6.1 (660-60) Mayor Lockhart opened the public hearing. City Attorney John Bakker presented the Staff Report and advised that this Ordinance will amend Chapter 4.24 (Drug Paraphernalia) to prohibit, and provide for the sanction of activity that is not otherwise regulated by State Law. No testimony was received by any member of the public relative to this issue. Mayor Lockhart closed the public hearing. On motion of Cm. Oravetz, seconded by Cm. Hildenbrand, and by unanimous vote, the Council waived reading and INTRODUCED the Ordinance amending Chapter 4.24 of the Dublin Municipal Code relating to Drug Paraphernalia. .. DUBLIN CITY COUNCIL MINUTES VOLUME 27 REGULAR MEETING April 1, 2008 6 UNFINISHED BUSINESS PA 02-053 General Plan Amendment Study for the 19-Acre Union Pacific Railroad and Alameda County Parcels Adiacent to the Iron Horse Trail 7:40 p.m. 7.1 (420-30) Consulting Planner Kristi Bascom presented the Staff Report on the preparation of a General Plan Amendment study to consider Parks/Public Recreation, Public/Semi Public, or Open Space land use designations only on subject properties. The presentation included background information, including community discussions of possible uses that explore a variety of different public-benefit uses and overwhelming support of the site being used for open space and/or passive park. She also spoke on challenges of the site and an event that happened along this corridor which may also influence land use and acquisition decisions. The presentation concluded with an analysis of each General Plan land use category studied, options, and Staff s request for City Council direction. Vm. Sbranti requested clarification of the options. Ms. Bascom responded that if the properties were designated either Open Space or Parks/Public Recreation, the City would be required to purchase the land and that acquisition of the properties would also involve assuming potential liability for future issues that may occur as a result of the location of the high pressure gas line located under the properties. City Manager Richard Ambrose responded on the results of a previous appraisal. Rob Krantz, representing Union Pacific Railraod, spoke in opposition to any change in the land use designation at this time, citing a proposed development plan. He presented a letter in opposition for the public record. Ron Boggs, Dublin resident, spoke in support of park space. Haley Vote, Dublin resident, spoke in support of open space. Denise William, spoke in opposition to development on the property and in support of leaving the land as it is. DUBLIN CITY COUNCIL MINUTES VOLUME 27 REGULAR MEETING April 1, 2008 7 Mayor Lockhart and Councilmembers spoke in agreement with Union Pacific's position to leave the property as it is for now. They also spoke on the feasibility of using the land for agricultural uses. Community Development Director Jeri Ram responded that agricultural uses were not analyzed. On motion of Cm. Hildenbrand, seconded by Cm. Scholz, and by unanimous vote, the City Council provided Staff direction to do nothing at this time. .. FY 2007-2008 Fundin!! for Tri-Vallev Business Council 8:00 p.m. 7.2 (140-80) Economic Development Director Christopher Foss presented the Staff Report and advised that Staff received a letter and invoice from the Tri- Valley Business Council requesting funding in the amount of $12,500 for Fiscal Year 2007-2008. He stated that during the FY 2007-08 budget deliberations, the City Council appropriated funds to support the efforts of the Tri-Valley Business Council with a caveat that the City of Dublin's funding would be contingent upon the funding by the other Tri- Valley cities. On motion of Vm. Sbranti, seconded by Cm. Oravetz, and by unanimous vote, the City Council authorized Staff to disburse $12,500 to the Tri-Valley Business Council. .. NEW BUSINESS Report on 2008 Dublin Pride Week Activities 8:02 p.m. 8.1 (150-80) Administrative Analyst Roger Bradley presented the Staff Report and advised that Dublin Pride Week is an annual event that seeks to promote a positive image for the City of DUBLIN CITY COUNCIL MINUTES VOLUME 27 REGULAR MEETING April 1, 2008 8 Dublin with the primary objective to seek ways to engage individuals and/or groups in action based activities to help the community. His presentation included reporting on the diverse community groups and individuals engaged in the planning process and the upcoming Dublin Pride activities. Council consensus to receive the 2008 Dublin Pride Week Activities Report. .. Request from Councilmember Hildenbrand to Desi!!nate a Street for Namin!! bv a Nonprofit Or!!anization 8:08 p.m. 8.2 (820-60) City Engineer Mark Lander, presented the Staff Report on the Policy adopted by the City Council for street naming and advised that a request from Councilmember Hildenbrand has been received to designate for naming by a nonprofit organization a street in Positano, which is being developed by Braddock & Logan. He stated the naming of the street will be auctioned to benefit the Dougherty Elementary School, a nonprofit public school in Dublin and that the request meets the guidelines contained within the City's Policy. The presentation concluded with the recommendation to approve the request to designate a street within Positano for naming by a nonprofit organization, subject to the provisions of the City's Policy for street naming by or for benefit of nonprofit organizations. On motion of Cm. Scholz, seconded by Vm. Sbranti, and by unanimous vote, the City Council approved the street naming. Review of Draft Tri-Vallev Transportation Plan and Action Plan 2008 Update 8:10 p.m. 8.3 (590-80) Traffic Engineer Jaimee Bourgeois presented the Staff Report and advised that the purpose of this report is to present the Draft Plan, provide an overview of key information, and solicit comments that will be provided in writing to the Tri-Valley Transportation Council (TVTC) in time for review at its next meeting on April 30, 2008. She stated that all Tri- Valley member jurisdictions, including the City of Dublin, are required to consider the Plan when adopting or amending general plans, specific plans, zoning ordinance or DUBLIN CITY COUNCIL MINUTES VOLUME 27 REGULAR MEETING April 1, 2008 9 capital improvement programs and to bring forward to the TVTC for review and comment "regionally or subregionally significant" transportation projects. The presentation included background information on funding, the jurisdictions composing TVTC, the first Transportation Plan and Action Plan, which served as a transportation planning guide through 2010 and the updated major elements. Ms. Bourgeois also spoke on the Statements of Vision, Goals and Policies and routes of regional significance, multimodal transportation service objectives, implementation actions and development review procedures. The presentation concluded with Staff s recommendation that Council receive the presentation and provide comments on the Draft Plan Update that will be documented by Staff and provided in writing to the TVTC. Councilmembers discussed the projects that can be funded by the TVTC Funds carried over from the prior program and those added to the program, noting that the City of Dublin is not included in the recently added projects. They also discussed the arterial routes, citing funding sources and timing to determine identification. Ms. Bourgeois clarified the major actions identified in the 2008 Plan Update and on action aimed at maintaining the service objectives relating to the routes. Cm. Hildenbrand spoke on peak traffic levels. Mayor Lockhart noted the significance of Stoneridge Drive in the study and stated she supports regional thinking but that the Plan requires thorough analysis to determine benefit. Council consensus to receive the presentation. No significant comments on the Draft Plan Update were documented to be provided in writing to the TVTC.
