DESCRIPTION:
Government Code Sections 6540.1 and 6540.2 (a) require the Planning Commission to review public
works projects proposed for the ensuing fiscal year for their conformmce with the City's adopted General
Plan.
City Staff has prepared the Five Year Capital Improvement Prograrr (CIP) covering Fiscal Years 20.0.8-
20.13. This plan was prepared to identify the needs for major infrastructure improvements and capital
items for this five year period.
The Planning Commission's role is to review those major public works projects within the Capital
Improvement Program and to detemline whether they are in conforflance with the City's General Plan.
Not all ofthe Capital Items within the Capital Improvement Program are major public works projects.
Projects that are proposed for Fiscal Year 20.0.8-20.0.9 in the Five Ye.lT CIP as it relates to the review by
the Planning Commission include the following:

RECOMMENDATION:
Staff recommends that the Planning Commission adopt the Resolution finding the Public Works projects
proposed for Fiscal Year 20.0.8-20.0.9 within the 20.0.8-20.13 Capital Improvement Program, and covered in
the adopted General Plan to be consistent with the General Plan.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
FINDING THAT THOSE PROJECTS COVERED IN THE AUOPTED GENERAL PLAN AS
PART OF THE 2008-2013 CAPITAL IMPROVEMENT PLAN (CIP),
OF THE CITY OF DUBLIN ARE CONSISTENT WITH THE
ADOPTED CITY OF DUBLIN GENERAL PLAN
WHEREAS, the City of Dublin has completed a 20.0.8-20.13 Capital Improvement Program (CIP)
outlining major infrastructure improvements through Fiscal Year 20. 13; and
WHEREAS, Sections 6540.1 and 6540.2 (a) of the Government Code requires that plans for major
public works for the ensuing fiscal year be submitted to the Plarming Commission for review as to
conformance with the adopted City of Dublin General Plan; and
WHEREAS, this application is exempt from environmental r,~view under State law; and
WHEREAS, the Planning Commission did review and cor sider the draft document and heard
recommendations at a public meeting on June 24, 20.0.8.
NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning Commission does hereby
find that those major public works projects covered by the adopted General Plan and proposed within the
20.0.8-20.13 CIP of the City of Dublin comply with the General Plan as adopted, and said Resolution shall
be submitted to the City Council in accordance with the Government Code.

TITLE 7. PLANNING AND LAND USE
DIVISION 1. PLANNING AND ZONING

Article 7. Administration of General Plan
65401. If a general plan or part thereof has been adopted, within such time as may be fixed by
the legislative body, each county or city officer, department, 1:0ard, or commission, and each
governmental body, commission, or board, including the goveming body of any special district
or school district, whose jurisdiction lies wholly or partially within the county or city, whose
functions include recommending, preparing plans for, or constructing, major public works, shall
submit to the official agency, as designated by the respective county board of supervisors or city
council, a list of the proposed public works recommended for planning, initiation or construction
during the ensuing fiscal year. The official agency receiving tle list of proposed public works
shall list and classify all such recommendations and shall prepare a coordinated program of
proposed public works for the ensuing fiscal year. Such coordinated program shall be submitted
to the county or city planning agency for review and reporl to said official agency as to
conformity with the adopted general plan or part thereof.
65402. (a) If a general plan or part thereof has been adopted, no real property shall be acquired
by dedication or otherwise for street, square, park or other pub lie purposes, and no real property
shall be disposed of, no street shall be vacated or abandoned, and no public building or structure
shall be constructed or authorized, if the adopted general plan or part thereof applies thereto,
until the location, purpose and extent of such acquisition or disposition, such street vacation or
abandonment, or such public building or structure have been suhmitted to and reported upon by
the planning agency as to conformity with said adopted general plan or part thereof. The
planning agency shall render its report as to conformity with s2id adopted general plan or part
thereof within forty (40.) days alter the matter was submitted to t, or such longer period of time
as may be designated by the legislative body.
If the legislative body so provides, by ordinance or resolution, tte provisions of this subdivision
shall not apply to: (1) the disposition of the remainder of a larger parcel which was acquired and
used in part for street purposes; (2) acquisitions, dispositions, or abandonments for street
widening; or (3) alignment projects, provided such dispositions Jor street purposes, acquisitions,
dispositions, or abandonments for street widening, or alignment projects are of a minor nature.
