the Dublin Civic Center City Council Chambers. Cm. Hughes called the meeting to order at 7:00 p.m.
ROLL CALL
Present: Commissioners Hughes, Oravetz, Johnson, and Musser, Eddie Peabody Jr., Community
Development Director; Michael Porto, Planning Consultant; Andy Byde, Associate Planner; Anne
Kinney, Assistant Planner, and Maria Carrasco, Recording Secretary.
Absent Cm. Jennings
PLEDGE OF ALLEGIANCE TO THE FLAG
Cm. Hughes led the Commission, Staff, and those present in the pledge of allegiance to the flag.
The minutes from the December 14, 1999 meeting were approved as submitted. The minutes of January
11, 2000 were approved with one minor revision.

PUBLIC HEARING -

PA 98-068, 98-069, and 98-070 Dublin Ranch Areas F, G and H (Previously known as the Pao
Lin Property); General Plan/Eastern Dublin Specific Plan Amendment; Stage I Planned
Development Rezone for Areas F (PA 98-068), and H (PA 98-070); Stage I and Stage II Planned
Development Rezone for Area G (PA 98-069).
Cm. Hughes asked for the staff report.

Regular Meeting
Michael Porto presented the staff report. He stated that the public hearing is still open from the December 14th
Planning Commission meeting. At that meeting they looked at the General Plan Amendment, Specific Plan
Amendment, and a PD Rezone. They did not address the three mitigated negative declarations at that meeting
because the City had received comments from outside agencies so the public hearing was continued to January 11t~.
Staff worked on the project but was unable to make the January 11th meeting and moved the item to tonight's
meeting. He stated that Ms. Kinney will discuss the mitigated negative declarations and the responses the City
received.
Anne Kinney stated that the mitigated negative declarations were given to the Commission in early November and
the public comment period ended in early December. During that time, the City received 10 letters from various
agencies that focused on the biological sections of the mitigated negative declaration. Staff has worked with the
applicant and refined a number of the mitigation measures. She read for the record a mitigation measure that was
missed in the mitigation monitoring program for Area H: Prior to the issuance offine grading permits for the site,
project development shall submit a drainage and hydrology study to the City, the report should also document the
projects fair share contribution to fund any improvements in down stream facilities. As a result of the three initial
studies and mitigated negative declarations as further refined in the response to comments document, the project as
proposed complies with CEQA and will not have any significant impacts on the environment. She stated that Mr.
Porto will continue his presentation on the project.
Mr. Porto stated that Kit Fabion, the City's Attorney also helped with the project. The Planning Commission
reviewed and discussed the items relative to the General Plan and Specific Plan, the Planned Development Rezone
and the extensive development standards at the December 14th meeting. Staff recommended that the Planning
Commission recommend to the City Council to adopt the mitigated negative declarations and mitigation monitoring
program for Areas F, G and H; recommend to the City Council to adopt a resolution that the General Plan and
Specific Plan Amendments for Areas F, G and H be approved; recommend to City Council to adopt a resolution to
approve a Planned Development Rezone and Stage 1 development plan for Areas F and H, and to approve a
Planned Development Rezone and Stage 2 development plan for Area G. He concluded his presentation and asked
if anyone had any questions.
Cm. Hughes stated that to his understanding, the public comment period for the negative declaration expired on the
December 11th, which means the Commission can't take any testimony on that portion of the project.
Mr. Porto said it expired on December 9~.
Cm. Hughes asked Staff if the applicant has to comply with all State and Federal requirements on environmental
issues before they can break ground.
Mr. Porto stated that there are a series of permits the applicant is required to get before they can break ground.
Cm. Hughes asked if the applicant would like to address the Commission.
Marry Inderbitzen, representing the applicant stated they are very excited about the project and it will bring a
unique atmosphere to Dublin. He asked the Commission for their support on the project.
Martin Vitz, East Bay Regional Park District (EBRPD) reviewed the response to comments on the Mitigated
Negative Declaration. It appears that some of the mitigation proposed for the project would be on the East Bay
Regional Park District's property. The City made reference to a record of survey for this project and EBRPD
would like a copy of that record. He stated that any mitigation activity would not be permitted on the District's
land. He recommended for Staff and the Commission to carefully review the proposed mitigation.

Cm. Hughes asked for a 5-minute recess. He called the meeting back to order at 7:15 p.m.

PA 99-063 Dublin Ranch Neighborhood L-4 Site Development Review
Neighborhood L-4 (Tract 6959) is comprised of 15.7 acres of residential development and 3.0 acres
of open space/landscape parcels for a total of 18.7 acres located in the southeastern portion of
Dublin Ranch Phase I. The project has 92 detached units on 50x80' lots. The designated uses
include single-family residential, open space landscape areas and roads.
Cm. Hughes asked for the staffreport.
Michael Porto presented the staff report. He stated that this project is Neighborhood L-4 of Dublin Ranch Phase 1
located east of Tassajara Rd. and Dublin Ranch Dr. In December 1998, the Planning Commission reviewed all of
Phase 1 of Dublin Ranch. At that time, Site Development Reviews were approved for the M-Neighborhoods and
for three of the L-Neighborhoods. Neighborhood L-4 did not have the proposed architecture at that time. He stated
that there are three different floor plans, which range from 2,220-sq. ft. to 2,509-sq. ft., with four and five bedrooms

with two and three car garages. There is one plan that places a garage in the rear of the lot. There are three
architectural styles being proposed, they are called Craftsman Bungalow, American Farmhouse, and Renaissance
Revival. He concluded his presentation and recommended Planning Commission approval.
Cm. Hughes asked if anyone had any questions.
Don Hofer, Shea Homes, 2155 Las Positas Ct. Livermore, thanked Staff and Mr. Porto for their work on the
project. The project has had tremendous response from the market. The L-4 Neighborhood, will continue an
outstanding product in the Dublin Ranch project. He asked the Planning Commission for their approval and would
be happy to answer any questions.
Cm. Oravetz asked if Neighborhood L-2 has sold out.
Mr. Hofer responded no; but it is close to being sold out.
Cm. Oravetz asked if Neighborhood L-3 has sold out
Mr. Hofer said L-3 is moving a little slower. They are starting construction of Phase 4.
Cm. Oravetz asked the price of the homes.
Mr. Hofer stated he did not have that information.
Cm. Oravetz asked why there aren't any one-story homes for this project.
Mr. Hofer stated that one-story homes does not meet the market needs and Shea Homes does not have any single
story homes proposed.
Cm. Johnson asked if there would be a fence at the curb where North Forestdale Circle runs parallel to Anton Way.
Mr. Hofer said there would be a split rail fence.
Cm. Hughes asked if there were any other questions; hearing none he closed the public hearing.
On motion by Cm. Musser and 2nd by Cm. Oravetz the project was unanimously approved with a 4-0-1 vote with
Cm. Jennings absent

9.1 Report of Progress on PA 99-020 Chacon Site Development Review Application

Cm. Hughes asked for update.
Andy Byde reported on the progress of PA 99-020 Chacon Dentist Building. He stated that at the November 23ra
Planning Commission meeting the Commission heard StaWs denial for the Chacon building. At that meeting the
Commission directed Staffto work with the applicant and come to an agreement on the architecture of the building.
Staff asked for modifications and worked with the applicant on the roof design. Staff reviewed the modifications,
considered the applicants interest of preserving the courtyard and came to a compromise on the original design.
Cm. Hughes asked when they plan to break ground.
Mr. Byde asked Mr. English how long before they submit for a building permit.
Mr. English responded approximately three months.
Cm. Musser asked what modifications did they agree on.
Mr. Byde stated that Attachment 3 of the packet is the design agreed on.
Cm. Hughes asked if the elevation of the building would be lowered?
Mr. Byde said not the elevation but the top roof peaks will be lowered slightly.
Cm. Johnson asked if the height of the building is 16-feet?
Mr. Byde responded yes.
Cm. Johnson asked the height of the surrounding buildings.
Mr. Byde said RPL Graphics is approximately 19-20 feet, and Cooks Auto Body is approximately 28-feet.
Cm. Johnson asked the height of the tile roof cap in the front of the building.
Mr. Byde said it is about a foot in a half. They actually lowered that cap piece.
Cm. Johnson asked if the cap is supposed to be lower than the roof behind it.
Mr. Byde said the roof height is the same.
Cm. Johnson said the original drawing the building height was 17-feet and it is now 16.2-feet. The building shrunk
by 8 inches.
Mr. Byde said that is correct.
Cm. Johnson asked about signage for the building.
Mr. Peabody said they would be allowed to participate on the monument sign that is there. He may have a sign on
the building.
Cm. Hughes asked if there are any other questions. He stated that the Commission does not have to take any action
on this project.

Mr. Peabody said that is correct. There will be an appeal period though for the Staffapproved SDR.
Mr. Peabody said the Planning Commission are invited to attend the Planners Institute which will be held March 1st
through the 3fa. The rooms have been reserved at the Double Tree in Monterey. He said that if they wish to attend
to let Maria know as soon as possible.
Mr. Peabody stated that at the next meeting they will hear the Greenbrier project.
