The owner, Jim Galucci, has given his permission for this permit application. The area for the proposed satellite caz rental office measures fifty-six square feet (56 ftz) in area and is located on the lower floor of the existing automobile repair shop. One (1) Enterprise employee will staff the office to provide administrative support exclusively. The Applicant is requesting that the existing use conform to the requirements of the Zoning Ordinance by means of this Conditional Use Permit. ANALYSIS: CONDITIONAL USE PERMIT The purpose of a Conditional Use Permit is to determine whether the proposed use is appropriate for the site and if conditions of approval are required. Issues that are commonly addressed include access to the site, land use compatibility and site design. The Planning Commission must make the following findings before a Conditional Use Permit may be granted: 1. The proposed use and related structures is compatible with other land uses, transportation and service facilities in the vicinity 2. The proposed use will not adversely affect the health or safety of persons residing or working in the vicinity, or be detrimental to the public health, safety and welfare; 3. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use and related structures would not be detrimental to the public health, safety, and welfare; S. The subject site is physically suitable for the type, density and intensity of the use and related structures being proposed; 6. The proposed use will not be contrary to the specific intent clauses or performance standards established for the PD (Planned Development) Zoning District in which it is to be located and; 7. The approval of the Conditional Use Permit will be consistent with the Dublin General Plan. ISSUES: The potential issues associated with establishing a satellite caz rental facility include 1) parking, traffic and circulation and 2) compatibility with adjacent uses. Parking, Traffic and Circulation: The proposed satellite car rental office will provide administrative services only with parking for one (1) employee. The site contains twenty-one (21) parking spaces. The primary automobile repair shop is required to maintain twenty (20) parking spaces leaving one (1) parking space for Enterprise Rent-A-Car employee pazking. The Planning Department has determined that the proposed project will not adversely affect off-street parking as customer service, vehicle delivery, maintenance, and storage will occur off-site at the existing 6867 Dublin Boulevard location. The Department of Public Works has determined that this project will not generate traffic and that a Traffic Impact Fee is not required. Compatibility with adjacent uses: The proposed satellite caz rental office would be compatible with the primary use of the property, which is an automobile repair shop and adjacent properties which are also occupied by automotive repair shops or mini storage. CONSISTENCY WITH THE GENERAL PLAN AND ZONING ORDINANCE: The project is consistent with the City of Dublin General Plan designation of Retail/Office and Automotive, which allows office uses and auto-related uses. The project is located in the Planned Development Zoning District with an underlying C-2 (Retail/Office & Automotive) Zoning District. This use is allowed in the Planned Development Zoning District with a Conditional Use Permit. The project is also consistent with the development regulations of the Zoning Ordinance. Public NotiTcatiou: In accordance with State law, a public notice was mailed to all property owners and tenants within 300 feet of the proposed project, for advertisement for the project and the upcoming public hearing. A public notice was also published in the Tri-Valley Herald and posted at several locations throughout the City. To date, the City has received no contact or objections from existing businesses in or surrounding property owners regazding the current proposal. ENVIRONMENTAL REVIEW: This project has been found to be Exempt from the California Environmental Quality Act (CEQA), according to Section 15301(a), Class 1, Existing Facilities. The rental office will occupy an existing office and will only require minor physical modifications to the structure. 2 CONCLUSION: The proposed satellite car rental office will be entirely enclosed within an existing automobile repair shop. The proposed satellite car rental office is consistent with the General Plan and the development regulations of the Zoning Ordinance and would be compatible with adjacent land uses. Approval of this Conditional Use Permit would bring the use into conformity with the land use requirements of the Zoning Ordinance. RECOMMENDATION: Staff recommends the Planning Commission open a public hearing, receive the staff presentation and public testimony, close the public hearing and deliberate and adopt the Resolution (Attachment 4) approving Conditional Use Permit PA 99-036 Enterprise Rent-A-Car for a satellite rental car office. N n J I A 1 July 12, 1999 City of Dublin City Planning Commission Deaz Cih- Planning Commission, ^1 Enterprise Rent-A-Caz is applying for a conditional use permit for a small branch location in Dublin. I am writing this letter to ask for your support in our efforts to operate a "Satellite" office at 6077 Dublin Blvd. Enterprise Rent-A-Caz has been servicing this area for more than 10 years in Dublin and has long established itself as a community business. We believe strongly in working kith the community in which we operate branch locations. In addition to the continual tax revenue provided by our ongoing rental operation, Enterprise works closely with related businesses in the azea to service their customers. Additionally, we utilize some of Dublin's established facilities (i.e. car wash, oil change/maintenance shops) to maintain our rental vehicles. THE ENTERPRISE DIFFERENCE: Enterprise Rent-A-Caz provides replacement transportation for customers whose vehicles aze disabled as a result of an automobile accident or mechanical problem. We also service local corporate businesses, as well as leisure and business travel needs. Our service includes free delivery of rental vehicles to customers at their home, repair shop, or place of business. Enterprise plans on doing a majority of this business as deliveries to the above mentioned customers (especially to repair shops and caz dealerships), without a lot of incoming traffic at this 6077 Dublin Blvd. location. Furthermore, Enterprise will not be performing automobile sales or vehicle maintenance at this location. Unlike other retail businesses in the azea, Enterprise will pick up and deliver to our customers, rather than having them drive to us. ENTERPRISE SATELLITE LOCATION: (How this is different ) Enterprise plans to utilize this new location as a Satellite outlet, in comparison to the primary location that we currently operate in Dublin at 6867 Dublin Blvd.. A Satellite location largely supports high volume locations by providing administrative services such as return date follow up with customers, callbacks to local accounts (i.e. insurance companies, body shops, dealerships, etc.) and handling a lazge volume of incoming reservations for all of the local azea. As previously mentioned, a majority of the business at 6077 Dublin Blvd. will come from automotive repair facilities, body shops, car dealerships and insurance companies. Enterprise will also work with other businesses and the general public. This location will serve as the base of operations to coordinate our delivery activities. Most of the actual business transactions will take place off-site at the various businesses to whom we deliver the vehicles. Enterprise vehicles will be staged at the locations of the dealerships and repair shop facilities, and will razely be brought through 6077 Dublin Blvd. ATTACHMENT 3 Because Enterprise is unique in providing free delivery and pick-up for our customers, we have limited need for customer parking. PARKING/ TRAFFIC FLOW: Due to the fact that this will be a low volume Satellite location, Enterprise plans on operating only a small fleet of vehicles. The average occupancy for a small Enterprise location is 90% of ow vehicles rented, meaning that we will rarely have vehicles on the premises at any given time. Enterprise has also arranged to utilize our existing location at 6867 Dublin Blvd. for overflow pazking, if we have more than 3-4 vehicles on-site at 6077 Dublin Blvd. The location at 6867 Dublin Blvd. has plenty of space and pazking behind the building to handle any overflow pazking needs. Overall, because most of our business will be conducted as deliveries away from 6077 Dublin Blvd, coupled with our alternative pazking plans, we are confident that there will be no disruption or negative impact, health related or otherwise to neighboring businesses, transportation systems, residents or property. OTHER: The premises at 6077 Dublin Blvd. will be utilized entirely by Enterprise for the purpose of coordinating our daily rental business transactions (deliveries) and for administrative functions. We anticipate a staff of 2 full-time employees and 1 part-time employee. The pazking needed for these employees will be limited because one of the full-time employees will have use of an Enterprise company vehicle, which in tum will be used as part of the rental fleet when he or she returns to open in the morning. Our hours of business will be Monday through Friday, 7:30 a.m. to 6:00 p.m., Satwday- 9:00 a.m. to 12:00 p.m. and closed on Sunday. A majority of our business is conducted first thing in the mornings, 7:30-9:00- which is a good fit with our immediate neighbors (body shops and caz dealerships), who have a need for our services first thing in the morning. In conclusion, we aze confident that Enterprise Rent-A-Car would be a nice compliment to the surrounding area. Enterprise would be central to several of the core businesses in this area- ie-body shops, service stations, detailing shops, and caz dealerships. Our presence will also help attract business to the City of Dublin because of our proximity to the above mentioned businesses whose customers rely upon replacement transportation. Enterprise's delivery service would help give these businesses a competitive advantage, with the goal of improving their customer satisfaction, as well as our customer service capabilities. WHEREAS, the Applicant, Daniel Friedman, of the Enterprise Rent-A-Car Company has filed a Conditional Use Permit application to allow a satellite car rental location within the existing facility located at 6077 Dublin Boulevard, in a C-2 Retail/Office & Automotive Zoning District; and WHEREAS the Planning Commission held a properly noticed public heazing on said application on April 11, 2000; and WHEREAS, the California Environmental Quality Act (CEQA), together with the State guidelines and City environmental regulations require that certain projects be reviewed for environmental impact and that environmental documents be prepazed; and WHEREAS, the project has been found to be Categorically Exempt from the California Environmental Quality Act (CEQA), according to Section 15301(a), Class 1; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did heaz and consider all said reports, recommendations and testimony herein above set forth and used his independent judgment to make a decision; and WHEREAS, the Planning Commission has found that the proposed project is appropriate for the subject site. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does find that: A. The proposed use is and related structures are compatible with other land uses, transportation and service facilities in the vicinity. B. The use will not adversely affect the health or safety of persons residing or working in the vicinity, or be detrimental to the public health, safety, and welfare. C. The use, under all circumstances and conditions of this permit, will not be injurious to property or improvements in the neighborhood. D. The approval of this Conditional Use Permit is consistent with the Dublin General Plan and any applicable Specific Plans. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby approve PA 99-036 Conditional Use Permit to allow anEnterprise-Rent-A-Caz satellite office as generally depicted on Exhibit A, stamped approved and on file, subject to compliance with the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. This Conditional Use Permit approval for PA 99-036 allows the establishment of a satellite car rental office within an existing commercial building. [PL] 2. The activities associated with the satellite caz rental office shall exclusively consist of a. Administrative and management operations; b. One pazking (1) space for an employee; c. The following operating hours: Monday to Friday: 7:30 a.m. - 6:00 p.m. Saturday: 9:00 a.m. - 12:00 p.m. [PL] No rental vehicles shall be stored or parked on or at the site as Enterprise Rent-A-Car staff will pick up and deliver customers to the vehicle storage site located at 6867 Dublin Boulevard. [PL] 4. The servicing or washing of rental vehicles or equipment shall not be permitted. [PL] No loudspeakers or amplified music shall be permitted outside of the enclosed buildings. [PL] 6. Any signage on site shall be subject to the Sign Requirements established in the Resolution No. 97- 03. [PL] 7. The proposed customer counter must be accessible per Section 1122B.4 of the 1998 California Building Code. The height of the customer counter shall be 28 inches to 34 inches from the floor. [B] Equivalent facilitation must be provided between the upper and lower levels if the existing second floor level is not accessible. The Applicant may request, in writing, that the requirement be waived if an "unreasonable" hardship exists in complying with this requirement per Section 1123B.1 of the 1998 California Building Code.
