Report prepared by Erica Fraser, Seni(;r Planner ATTACHMENTS: 1) Resolution approving a Vesting Tertative Tract Map extension for Tract 7667, Dublin Transit Center Site E-l. 2) Vesting Tentative Tract Map. RECOMMENDATION: ll),n&) 1) Receive Staff presentation; 2) Open the public hearing; 3) Take testimony from the Applicant md the public; 4) Close the public hearing and deliberate; and 5) Adopt Resolution (Attachment 1) approving a Vesting Tentative Tract Map extension for Tract 7667. PROJECT DESCRIPTION: In December 2002, the City Council adopted Resolution 216-02 appr:wing a General Plan/Eastern Dublin Specific Plan Amendment; Ordinance 21-02 approving a Stage 1 Planned Development Zoning; and, Resolution 02-40 approving Tentative Parcel Map 7892, for the entire Dublin Transit Center, located generally between the Iron Horse Trail to the west, Dublin Boulevcrd to the north, Arnold Road to the East, and the DublinIPleasanton Bay Area Rapid Transit (BART) Station to the south. A Master Development Agreement for the entire Dublin Transit Cent;:r was adopted by Ordinance 5-03 in May 2003 and together with the approved General Plan/Eastern Dublin Specific Plan Amendment, Stage I Planned Development Zoning, and Vesting Tentative Tract Map e:;tablished the land use approvals for the future development of the overall site. The Master Development Agreement was amended by Ordinance 25-05 to include the affordable housing obligations in the project area. Metropolitan at Dublin ~:tation (located on Site E-l in the Dublin Transit Center), is a 300-unit condominium project with approximately 15,000 square feet of ground floor retail along Iron Horse Parkway and Martinelli Way. The location of the project site is shown on the map on the left side of this page. On December 13, 2005, the Planning Commission approved a Vesting Tentative Map for the Metropolitan project. The Site Development Review, Development Agreement and Planned Development Rezone were approved by the City Council on January 17, 2005. COPIES TO: Property Owner/Appllcant File ITEM NO. 15. 1 Page 1 of3 G:\PA#\2005105-042 Transit Center Site E-llTentative MaD ExtensionlPC Aeenda Statement 7-22-08.doc Condition of Approval No. 61 of the Vesting Tentative Tract Map (Resolution 05-68) for Tract 7667 (Metropolitan) stated that the Map would not be effective until "the related PD-Planned Development rezoning including Stage 2 Development Plan and the Site Development Review are approved by the City Council." The City Council approved the Stage 2 Development Plan and the Site Development Review on February 7, 2006 and the approval of the Map became effective at that time. ANALYSIS: The City's Subdivision Ordinance states that the approval of a Tentative Map is valid for a period of 2.5 years following the date of approval of the Map. The approval of th(: Map did not become effective until February 7,2006. Because the Map is only valid for a period of2.5 years, the Map will expire on August 8, 2008. Section 9.08.120 of Title 9, Subdivisions, of the City's Municipal Code allows an Applicant to apply for an extension of a Tentative Map for a period of up to three years. The Map extension is required to be reviewed and approved or conditionally approved by the Planning Commission. The Applicant has requested a 2.5 year extension of the Vesting Tentative Tract Map. This extension would allow the Map to be valid for a period that is consistent with the approved Development Agreement which is valid for a period of five years and allows the project to be constructed within the five year period (or until January 17, 2011). On July 15, 2008, the State of California enacted SB 1185 which extends the life of all unexpired Tentative Maps for a period of one year. The Planning Commissio:l will therefore be granting an Map extension of 1.5 years which will begin after the one year period expires (for a total of 2.5 years). ENVIRONMENTAL REVIEW: Pursuant to the California Environmental Quality Act, Staff is recommending that the project be found exempt from CEQA pursuant to Government Code section 65457 for residential projects that are consistent with a Specific Plan. The Project is within the scope ofth;: Final Environmental Impact Report for the Dublin Transit Center General Plan Amendment, Eastern Dublin Specific Plan Amendment, Stage 1 Planned Development Zoning, Tentative Parcel Map, and Development Agreement (SCH 2001120395) which was certified by City Council Resolution No. 215-02 dated November 19, 2002. This recommendation is based on a determination that there are no supplemental impacts related to the Map extension that would require preparation of a Supplemental EIR. CONCLUSION: The request to extend the effective period of the Vesting Tentative Tract Map is compatible with the Development Agreement which is valid for a period of five years. The extension of the map will allow the Applicants additional time to construct the Metropolitan project. RECOMMENDATION: Staff recommends that the Planning Commission: 1) Receive Staff presentation; 2) Open the public hearing; 3) Take testimony from the Applicant and the public; 4) Close the public hearing and deliberate; and 5) Adopt Resolution (Attachment 1) approving a Vesting Tentltive Tract Map extension for Tract 7667. Horton, Inc. has requested a 2.5 year (total) Vesting Tentative Tract Map extension for Tract 7667, Dublin Transit Center Site E-l (commony known as Metropolitan at Dublin Station), on approximately :!:4.1 gross acres of land located in the Dublin Transit Center project area, within the Eastern Dublin Specific Plan, located at the southeast corner of Dublin Boulevard and Iron Horse Parkway; and WHEREAS, the State of California Subdivision Map Act and the adopted City of Dublin Subdivision Regulations require that no real property may be divided into two or more parcels for purpose of sale, lease or financing, unless a tentative map is acted upon, and a final map is approved consistent with the Subdivision Map Act and City of Dublin Subdivision Regulations; and WHEREAS, the State of California Subdivision Map Act and Title 9, Subdivisions, of the Dublin Municipal Code states that Tentative Maps are valid for a period of2.5 years and allows Applicants to file for a map extension for up to three years; and WHEREAS, the State of California passed SB 1185 on July 15, 2008 which extended the life of all unexpired Tentative Maps for a period of one year; and WHEREAS, the Applicant has requested an extension of 1.5 years beyond the extension granted by the State of California for a total extension of 2.5 years; and WHEREAS, the Conditions of Approval for Resolution 05-68 continue to apply to the Tentative Map; and WHEREAS, Pursuant to the California Environmental QuaLty Act, Staff has recommended that the project be found exempt from CEQA pursuant to Government Code section 65457 for residential projects that are consistent with a specific plan. NOW, THERFORE, BE IT RESOLVED THAT THE City of Dublin Planning Commission does hereby find that the circumstances under which the Tentative Map was approved have not changed to the extent which would warrant a change in the design or improvement of the Tentative Map, as required by Section 9.08.120 of the Dublin Municipal Code. NOW, THEREFORE BE IT FURTHER RESOLVED THAT THE City of Dublin Planning Commission hereby approves the extension of the Vesting Tentative Tract Map 7667, for a total period of 2.5 years, which will subdivide the property into condominium units for residential condominium purposes and for retail units as APN 986-0001-013-02. This approval shall conform generally to: the Vesting Tentative Tract Map 7667 prepared by BKF, and consisting of six (6) sheets stamped approved except as specifically modified by the Conditions of Approval contained below.
