FINANCIAL STATEMENT: KBH Investments, LLC, has provided a Maintenance Bond in the amount of $107,408.00 (Bond No. 104789114) to replace the Performance and Labor and Materials Bonds that guaranteed the on-site and off-site improvements. The Maintenance Bond will guarantee against defects for one year. Once these improvements have been accepted, the City will incur maintenance and street sweeping costs. DESCRIPTION: KBH Investments, LLC, recently completed street improvements associated with Parcel Map 9185. The project site, which is known as Dublin Honda, is located on the southeast comer of Dublin Boulevard and Scarlett Court. The work consisted of on-site improvements, and of off-site improvements that widened the south side of Dublin Boulevard from Scarlett Court to a point 345 feet easterly along the Dublin Honda frontage. The off-site work was governed by an Improvement Agreement executed on April 17, 2007, via City Council Resolution No. 43-07. Since the developer has completed the work governed by the Improvement Agreement and to the satisfaction of the Public Works Director, it is appropriate for the improvements to now be accepted by the City for permanent maintenance. ------------------------------------------------------------------------------------------------------------- COPY TO: Ken Harvey, Dublin Honda Page 1 of2 ITEM NO. "No Parking Anytime" on the south side of Dublin Boulevard between Scarlett Court and to a point 345 feet easterly of Scarlett Court. At the time that the City and KBH Investments, LLC, executed the Improvement Agreement for the Dublin Boulevard street improvements, the developer provided a Performance Bond and a Labor and Materials Bond, each in the amount $345,795.00 (Bond No. 104859999 by Travelers Casualty and Surety Company of America), to guarantee performance of the work. Diede Construction, Inc., the contractor for KBH Investments, LLC, also provided a Performance Bond and a Payment Bond, each in the amount $714,921.00 (Bond No. 104789114 by Travelers Casualty and Surety Company of America) to guarantee performance of the work on both the on-site and off-site improvements. Now that the work is complete, these bonds may be released in accordance with the authority contained in g66499.7 of the Government Code, and replaced with a Maintenance Bond in an amount necessary to guarantee the work for a one-year period following acceptance. The developer and the contractor have provided Maintenance Bonds in the amount of $107,408.00 (Bond No. 104789114 by Travelers Casualty and Surety Company of America), which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the improvements associated with Parcel Map 9185, and approving the regulatory traffic control devices. Page 2 of2 RESOLUTION NO. - 08 I~ ""'I " -, -' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF IMPROVEMENTS ASSOCIATED WITH PARCEL MAP 9185 (KBH INVESTMENTS, LLC) AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES WHEREAS, the developer of Parcel Map 9185, filed July 29,2008, in Book 308 of Parcel Maps at Pages 57 - 61, previously entered into an Improvement Agreement with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the Public Works Director, said Parcel identified as follows: a) Subdivider: b) Parcel Location: KBH Investments, LLC (aka Dublin Honda) Southeast comer of Dublin Boulevard and Scarlett Court 2 parcels: Parcel A (2.21 ac), Parcel B (5.50 ac) No. 43-07, City of Dublin City Council Dublin Boulevard and Scarlett Court c) Parcel Size: d) Resolution Approving Agreement: e) City Streets Affected: WHEREAS, the Street Improvements associated with Parcel Map 9185 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the original improvement Performance Bonds and Labor and Materials Bonds that guaranteed the Improvements can be released, in accordance with the authority contained in g66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and 2. The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: a) "No Parking Anytime" traffic control devices have been installed on the south side of Dublin Boulevard between Scarlett Court and a point 345 feet easterly to Parcel boundary. 3.
