DESCRIPTION: The southeast comer of theBes~.t.,~.py building is encroaching
approximately 5z'i/2 feet into a 10-foot-wide public service easement (P:S.E.). The area of the P.S.E.
affected is approximately 111 square feet. This P.S.E. was offered for dedication to the public as a pan of
Parcel Map 7223 and was accepted by the City Council on February I0, 1998. There are no utilities
installed within this easement, nor is it anticipated that utilities will be installed here in the future.
Therefore, under the provisions of Streets and Highways Code Chapter 4, this P.S.E. may be abandoned
by summary vacation.
Staff'recommends that the City Council adopt the resolution summarily vacating this portion of the Public
Service Easement.

Subject: ENCROACHMENT OF BUILDING SITUATE ON PAD M11 (BEST
BUY) EXTTO 10 FOOT WIDE PUBLIC SERVICE EASEMENT.
Dear Mr. Thompson:
This is to present the following information:
1. The southeast comer of the building foundation is encroaching approximately
5.5 feet into a 10 foot wide public service easement (p.s.e). (see attached
sketch)
2. Said 10'foot wide p.s.e, was offered for dedication to the public and accepted
on behalf of the public by the city council of the city of Dublin on m~d by
Parcel Map 7223, filed on February 10, 1998 in book 234 of_parcel maps at
page 45, official records of Alameda county.
3. There were never any pUblic utilities located within the affected p.s.e.
4. There are not now any public utilities located within the affected p.s.e.
5. There are no public utilities anticipated that will need to be located within the
affected p.s.e, in the future.
By this letter we hereby request that by resolution of the city council that a portion of
said p.s.e be abandoned by summary vacation.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
SUM/VL4,RH,Y VACATING PUBLIC SERVICE EASEMENT
PARCEL 6 OF PARCEL MAP 7223
HACIENDA CROSSINGS
WHEREAS, the portion of Public Service Easement proposed to be vacated, as described on
Exhibit A and shown on Exhibit B attached hereto, has never contained utilities, does not now contain
utilities, and is not anticipated to contain utilities in the future; and
WHEREAS, the portion of Public Service Easement to be vacated is needed to facilitate
construction ora building on Parcel 6 of Parcel Map 7223 and is of benefit to both the City and the
property owner as provided in Chapter 4 of the Streets and Highways Code;
NOW, THEREFORE, BE IT RESOLVED that the portion of Public Service Easement as
described in Exhibit A and shown on Exhibit B attached hereto is hereby vacated.
BE IT FURTHER RESOLVED that the City Clerk is directed to submit a certified copy of this ~
Resolution to the County Recorder for recording.
