PROJECT DESCRIPTION:
Background:
The Applicant is requesting approval of a Conditional Use Permit (C'UP) to legalize the establishment of
an existing church within a 1,949 square foot suite located on a triangular shaped lot at 11501 Dublin
Boulevard. The property consists of an existing multi-tenant commercial office building with access from
Dublin Boulevard. The property is zoned Planned Development with a General Plan Land Use
Designation of Retail/Office which allows a church facility with the approval of a Conditional Use
Permit. The church is surrounded by single family residential homes to the north, commercial office uses
to the east, Interstate 580 to the south and Dublin Boulevard to the west.

ANALYSIS:
A Conditional Use Permit is required in order to operate a Comm unity Facility, which include church
facilities within the PD (Planned Development) Zoning District for the site. The Conditional Use Permit
process allows the City to place Conditions of Approval on the projf~ct to ensure that the operation of the
proposed use is compatible with the surrounding uses. The proposed project has been reviewed for issues
related to operating characteristics. parking, and project design. Conditions of Approval have been
proposed where appropriate to ensure compatibility with adjacent uses.
The commercial office building is approximately 41,000 square feet in size. The church is located within
an existing 1,949 square foot suite. 'the suite consists of a 938 squan; foot sanctuary with alter, children's
sanctuary (classroom), two offices, a retreat room and storage room.
Operating C{a!~rracteristics:
The church conducts Sunday morning services and regularly scheduled activities as provided in Table 1
below. The .Applicant has indicated that there are no full-time staf ~ members at this location, since the
church's principle office is located in Pleasanton. The worship/servic ~ attendance is estimated at 20 adults
and 15 children. The following table describes the worship times.

As described above, all of the services are at times that are outside of normal business hours for an office
building. The majority of existing; uses within this multi-tenant commercial office building operate
Monday through Friday from 8:30 a.m. to 5 p.m. Because church activities occur on weekday evenings
and weekends, when the other businesses are typically closed, the p~~tential for conflict to occur with the
other uses in the building is minimal. A Condition of Approval has been added restricting the operation
of the church to these times. If the church expands the hours of operation, such modification would need
to be reviewed and approved by the City.
Parking Analysis:
The City of Dublin Zoning Ordinance contains off-street parking requirements by use type. A Place of
Worship (church) is required to provide one parking space per 50 square feet for non-fixed seating in the
assembly area, plus 1 per classroom (Chapter 8.76.080.C). As previously stated, the sanctuary is
approximately 938 square feet with one classroom. Therefore, the Zoning Ordinance parking requirement
for the church is 20 parking spaces.

Although the church is located within amulti-tenant commercial of face building a parking analysis has
not been performed because the church's days and hours of operations are not during typical office hours;
therefore the existing 123 on-site parking spaces are sufficient to ;support the church and its activities
during the hours proposed for the church and will not impact the office parking demand.
Conditional Use Permit Required Findings:
In order for the Planning Commission to approve a request for a Conditional Use Permit, the Planning
Commission must make all finding; (Section 8.100.060 of the Dublin Zoning Ordinance) as shown on
pages 1-2 of the Resolution (Attachment 1).

ENVIRONMENTAL REVIEW:
The project has been reviewed under the California Environmental Quality Act (CEQA), CEQA Guidelines
and the Dublin Environmental Guidelines and has been found to be categorically exempt from the
environmental review requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA
Guidelines Section 15301 (Existing Facilities).
NOTICING:
In accordance with State law, a public notice regarding this hearing v~~as mailed to all property owners and
occupants within 300 feet of the proposed project. A public notice was also published in the Valley
Times and posted at several locations throughout the City. To date, the City has not received any
comments or objections from surrounding property owners or tenants regarding the current proposal.
REVIEW BY APPLICABLE DEPARTMENT AND AGENCIES:
The proposed project has been reviewed by the Building Division, Public Works Department, Police
Services Department, and the Alameda County Fire Department. Conditions of Approval have been
included where applicable.
CONSISTENCY WITH THE GENERAL PLAN, SPECIFIC PLAN AND ZONING ORDINANCE:
The proposed project is consistent with the General Plan Land Use designation of Retail/Office.
Community Facilities, which include church facilities, are allowed n the Planned Development Zoning
District with approval of a Conditional Use Permit from the Planning Commission.
CONCLUSION:
This application has been reviewed by the applicable City departments and agencies, and their comments
have. been incorporated into the Conditions of Approval for the project. The proposed church, as
conditioned, is consistent with the Dublin General Plan and Zoning District in which the project site is
located and represents an appropriate: project for the site.
RECOMMENDATION:
Staff recommends that the Planning Commission: 1) Receive Staff presentation; 2) Open the public
hearing; 3) Take testimony from the Applicant and the public; 4) Close the public hearing and deliberate;
and 5) Adopt Resolution (Attachment 1) approving a Conditional Usf; Permit to legalize the establishment
of a church (Mountain of Fire and Miracles Ministries) 11501 Dublin Boulevard, Suite 202.

A RESOLUTION OF THE PLANNING CQ~MMISSION
OF THE CITY OF DUBLIN
APPROVING A REQUEST FOR A CONDITIONAL USE PERMIT TO LEGALIZE THE
ESTABLISHMENT OF AN EXISTING PLACE OF WORSHIP WITHIN THE PLANNED
DEVELOPMENT (PD) ZONING DISTRICT LOCATED AT 1]_501 DUBLIN BOULEVARD,

WHEREAS, Samuel Y. Adeyemi, the Applicant, has requested approval of a Conditional Use Permit
to legalize the establishment of the existing Mountain of Fire and Miracles Ministries to be located within a
1,949 square foot suite in the Planned Development (PD) zoning district at 11501 Dublin Boulevard, Suite
202; and
WHEREAS, a complete application for the above noted entitl ~ment request is available and on file
in the Community Development Depa~~tment; and
WHEREAS, the Applicant has submitted project plans dated received April 3, 2008; and
WHEREAS, the application has been reviewed in accordance with the provisions of the California
Environmental Quality Act (CEQA) and this project was found to be exempt under the CEQA Guidelines Section
15301; and
WHEREAS, a Staff Report was submitted outlining the issues surrounding the request; and
WHEREAS the Planning Commission held a properly noticed public hearing on said application on
August 26, 2008; and
WHEREAS, the Planning Commission did hear and consider a l said reports, recommendations and
testimony herein above set forth and u:;ed their independent judgment tc~ make a decision; and
WHEREAS, the Planning Commission has found that the proposed project is appropriate for the
subject site.
NOW, THEREFORE, BE IT RESOLVED THAT the Dublin Planning Commission does hereby
make the following findings and determinations.
A. The proposed use and related structures is compatible with other land uses, transportation and service
facilities in the vicinity because it is located within an existing building and the existing on and off-
site parking is adequate to seri~e the existing uses.
B. The proposed use, as conditioned, will not adversely affect the 1 _ealth or safety of persons residing or
working in the vicinity, or be detrimental to the public health, s~.fety and welfare and will not be
injurious to property or improvements in the neighborhood becGUSe the proposed use will operate
during non peak hours from surrounding uses and will be adequately conditioned to ensure that the
operation is conducive with adjacent uses.

D. There are adequate provisions for public access, water, sanitation, and public utilities and services to
ensure that the proposed use and related structures would not be detrimental to the public health,

that is serviced by all appropriate utilities and infrastructure.
F,. The subject site is physically suitable for the type, density and intensity of the use and related
structures being proposed because the existing roadway networl- leading to the site and the existing
on-site parking is adequate to serve the use.
F. The use will not be contrary to the specific intent clauses, devel<-pment regulations, and performance
standards established for the Planned Development (PD) zoning district in which it is located because
a church is allowed by Conditi~~nal Use Permit as defined in the Planned Development.
G. The approval of this Conditional Use Permit is consistent with fie Dublin General Plan and will
provide a service to the community that is consistent with the intent of the Retail/Office General Plan
Land Use designation because it will provide a place of worship for the community.
BE IT FURTHER RESOLVED THAT the Dublin Planning Commission does hereby approve PA
07-010 Mountain of Fire and Miracles Ministries Conditional Use Perrr~it to establish a 1,949 square foot
church located at 11501 Dublin Boulevard, Suite 202, APN 941-1570-C04-02. The project approval shall be
subject to compliance with the following conditions:

PLAN NING CONDITIONS
1. Approval. This Conditional Use Permit approval for PA PL On-going Standard
07-010 is to allow Mountain oi~ Fire and Miracles
Ministries to establish a churcl- at 11501 Dublin
Boulevard, Suite 202. This approval shall generally
conform to the project plans stamped approved, consisting
of a site plan and floor plans (stamped received by the
Plannin De artment on A ril 3, 2008).
2. Permit Expiration. Construction or use shall commence PL One year from DMC
within one (1) year of Permit approval or the Permit shall permit approval 8.96.020.D
lapse and become null and void. Commencement of
construction or use means the actual construction or use
pursuant to the Permit approval or demonstrating
substantial progress toward commencing such
construction or use. If there is a dispute as to whether the
Permit has ex fired, the City may hold a noticed ublic

hearing to determine the matter. Such a determination
may be processed concurrently with revocation
proceedings in appropriate circumstances. If a Permit
expires, a new application must be made and processed
accordin to the re uirements of this Ordinance.
3. Time Extension. The original approving decision-maker PL One year from DMC

determination that any Conditions of Approval remain
adequate to assure that applicable findings of approval

8.100.080, of the Zonin Ordinance.
9. Clarification to the Conditions of Approval. In the Various On-going Standard
event that there needs to be clarification to the Conditions
of Approval, the Director of Community Development
and the City Engineer have the authority to clarify the
intent of these Conditions of Approval to the Developer
without going to a public heari~ig. The Director of
Community Development and the City Engineer also have
the authority to make minor modifications to these
conditions without going to a public hearing in order for

11. Requirements and Standard Conditions. The Various Building Permit Standard
Applicant/ Developer shall comply with applicable City Issuance
of Dublin Fire Prevention Bureau, Dublin Public Works
Department, Dublin Building Department, Dublin Police
Services, Alameda County Flood Control District Zone 7,
Livermore Amador Valley Transit Authority, Alameda
County Public and Environmental Health, Dublin San
Ramon Services District and the California Department of
Health Services requirements and standard conditions.
Prior to issuance of building permits or the installation of
any improvements related to this project, the Developer
shall supply written statements from each such agency or
department to the Planning Department, indicating that all
a licable conditions re uired have been or will be met.
12. Required Permits. Developer shell obtain all permits Various Building Permit Standard

District Zone 7, California Department of Fish and Game,
Army Corps of Engineers, Regional Water Quality

16. Outdoor Events. Any outside events shall be subject to PL On-going Planning

17. Noise/Nuisance. The Applicant shall control all activities PL On-going Planning

BUILDING `CONDITIONS
19. Building Codes and Ordinances. All project BL Through Building
construction shall conform to all building codes and Completion
ordinances in effect at the time of buildin ermit.
20. Building Permits. To apply for building permits, BL Issuance of Building
Applicant/Developer shall submit eight (8) sets of Building Permits
construction plans to the Building Division for plan
check. Each set of plans shall have attached an annotated
copy of these Conditions of Approval. The notations
shall clearly indicate how all Conditions of Approval will
have been complied with. Construction plans will not be
accepted without the annotated resolutions attached to
each set of plans. Applicant~Developer will be
responsible for obtaining the approv,rls of all participation
non-City agencies prior to the issuance of building
ermits.
21. Construction Drawings. Construction plans shall be BL Prior to Issuance of Building

conditions on site), and prepared and signed by a
California licensed Architect or Engineer. All structural
calculations shall be prepared and signed by a California

illuminated and be able to be seen from the street, 5

23. Engineer Observation. The Engineer of record shall be BL Prior to Frame Building
retained to provide observation services for all Inspection
components of the lateral and vertical design of the
building, including nailing, holddowns, straps, shear, roof
diaphragm and structural frame of building. A written
report shall be submitted to the City Inspector prior to
schedulin the final frame ins ectiori.
24. Air Conditioning Units. Air conditioning units and BL Occupancy of Unit Building
ventilation ducts shall be screened from public view with
materials compatible to the main building. Units shall be
permanently installed on concrete pads or other non-
movable materials approved by the Building Official and
Director of Communi Develo ment.

Please assure that the pavement slopes does not exceed
2% in any direction. Said stall shall be close to the main
entrance. Minimum of 5 disabled parking stalls are
necessary for this site as per the total number of parking
shown on the lan.

33. Site Entrance Signage. Signs (R100B) must be posted at PW Prior to Occupancy Public Works

owner's expense. Towed vehicles may be reclaimed at
Dublin Police or by telephoning 83306670". Show the

DSRS D CONDITIONS
34. Prior to issuance of any building permit, complete DSRSD Prior to Issuance of DSRSD
improvement plans shall be submitted to DSRSD that Building Permits
conform to the requirements of the Dublin San Ramon
Services District Code, the DSRSD "Standard Procedures,
Specifications and Drawings for Design and Installation
of Water and Wastewater Facilities", all applicable
DSRSD Master Plans and all DSRSD olicies.
35. Prior to issuance by the City of any Building Permit or DSRSD Prior to Issuance of DSRSD
Construction Permit by the Dublin San Ramon Services Building Permits
District, whichever comes first, all utility connection fees
including DSRSD and Zone 7, plan checking fees,
inspection fees, connection fees, and fees associated with
a wastewater discharge permit shall be paid to DSRSD in
accordance with the rates and schedules established in the
DSRSD Code.

Dear Laura:
In response to the planning division comments indicated in your letter dated May 2, 2008 and the
attached Dublin Fire Department requirements of November 7, 2007, please be advised as
follows:
Item 1 The letter dated 10/17/07 states an anticipated occupant load over 49 persons, a change
of occupancy will need to be approved by the Building Department: -
Response -
Please be advised that our church is a very small group that cun~ently consists of 18 to 20 adult
and about 15 children for a total of 35 individual on a typical d:iy of worship. This means that
our congregation is under the current approved maximum occupant load of 49 or less. Therefore,
the current approved occupant load does not need to be revised by the Building Department.
Item #2 General Comments: -
This is a general comment and as such no response is required from us
Item #3 Deferred Submittals: --
Provide on the title or Cover Sheet under the heading; Deferred Submittal all of the
deferred submitted items:
• Fire Sprinkler modifications
• Fire monitoring s vstem install or modifications.
Response -There is no modification / TI of the current space of worship as the current sprinkler
system is deemed to be adequ~rte as provided within the current bi~.ilding requirements
Item #4 Existing Fire Sprinkla~r Systems -Modification: -
a. Sprinkler Plans
b. S year Certfftcation
Response - As indicated in item #3 above, the current sprinkler plan by the building Owner is
adequate, while the 5-year certification is being processed by the property Owner.
Item #6 Fire Extinguishers-
Response -Fire Extinguishers are currently located in visible ar d unobstructed locations within
the building main floor as necessary.

Response - A Knox box is already installed in front of the buildvig entrance
Once again, we have addressed the all The City of Dublin's raised issues along with the Alameda
Fire Department comments. We strongly believe that most ofd these questions are life safety
requirement that's applicable for an occupancy load of +49, whi~;h is not applicable to our group
as of this time. We therefore look forward to your favorable review and issuance of the permit to
operate a Church at the above referenced address.
