The site is surrounded by commercial uses to the north, south, east and west. The site is zoned C-1 (Retail Commercial) and has a General Plan land use designation of Retail/Office. On August 28, 2007 the Planning Commission approved Resolution 07-43 to allow Goodwill to accept donations at the existing Goodwill retail establishment located at 7:?32 Regional Street. For background information regarding the Conditional Use Permit, refer to the ,august 28, 2007 Agenda Statement included as Attachment 3. The Applicant has requested a six month extension of a previously approved Conditional Use Permit to allow Goodwill to accept donations at the existing Goodwill retail establishment. The donation center will take place in a designated area within the Goodwill store. Section 8.96.020 D of the Dublin Zoning Ordinance states that construction or use shall commence within one (1) year of Permit approval, or the Permit shall lapse and become null and void. The previously approved Conditional Use Permit for an interior donation center was approved by the Planning Commission on August 28, 2007. Consequently, the Permit will expire on August 28, 2008 unless the Planning Commission approves an extension before that date. Section 8.96.020 E of the Dublin Zoning Ordinance states that the original approving decision-maker may, upon the Applicant's written request for an extension of approval prior to expiration, and upon the determination that any Conditions of Approval remain adequate to assure that applicable findings of approval will continue to be met, grant a time extension of approval for a period not to exceed six months. On August 5, 2008 the City received a written statement from Goodwill Industries requesting a six month extension (Attachment 5). The project has not moved forward at this time due to operational necessities in other areas and limited resources. Goodwill Industries is now in a position to refocus attention on the Dublin retail establishment and move forward with the project. If the Planning Commission approves a six month extension of the Conditional Use Permit, Goodwill will be required to construct all necessary improvements and begin accepting donations at this lacility prior to February 26, 2009 or the Conditional Use Permit will expire. ATTACHMENT 1 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Dublin does hereby find that the Conditions of Approval for the Conditional Use Permit are adequate to assure that the findings of approval in Resolution 07-43 will continue to be met as required by Section 8.96.020.E of the Dublin Zoning Ordinance. The proposed use, as conditioned, is compatible with other land uses, transportation and service facilities in the vicinity because: 1) the property is zoned C-1 (Retail Commercial); 2) the acceptance of donations at this facility is permitted in the C-1 (Retail Commercial) Zoning District with a Conditional Use Permit; 3) the proposed use is compatible with uses in the vicinity, which include a retail and service uses; 4) donations will be accepted only inside the store and as conditioned will not impact surrounding businesses; and 5) the acceptance of donations will be used to support the existing Goodwill store which is a non- profitbusiness. _ _ B. The proposed use, as conditioned, will not adversely affect the health or safety of persons residing or working in the vicinity or be detrimental to the public health safety and welfare because: 1) the proposed use will comply with a11.City of Dublin and State regulations; 2) the proposed use will be located in an existing building and is compatible with the existing uses within the building and uses in the vicinity of the building; 3) the use will be conducted entirely within the building; and 4) as conditioned, improvements will be required to be made to the property in order to minimize impacts this use may have on existing uses and to bring the property into compliance with current State, Regional and Local regulations including modifications to the site to comply with NPDES requirements and restriping and patching/repair of the parking lot surface to promote safety and property maintenance on the site. C. The proposed use, as conditioned, will not be injurious to property or improvements in the neighborhood because: 1) as conditioned, the proposed use will comply with all City of Dublin and State regulations; 2) the proposed use will be located in an existing building with minimal exterior modifications to the building, and the minor exterior modifications are designed to reduce impacts on adjacent businesses; 3) as conditioned, the proposed use will be compatible with the surrounding uses which include a variety of retail and service uses; 4) as conditioned, improvements will be required to be made to the property, including repairs in order to bring the property into compliance with current Local and State regulations; and 5) several 'conditions have been included in this Resolution to reduce impacts on adjacent properties and the City with respect to safety, trash accumulation and monitoring of the site. D. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use and related structures would not be detrimental to the public health, safety and welfare because: 1) the proposed use will be located in an existing building and will not require additional public services; and 2) the building and property were designed to accommodate a variety of uses, with which the proposed use is compatible. E. The subject site is physically suitable for the type, density and intensity of the use and related structures being proposed because: 1) the proposed use will be located in an existing building which was designed to support a variety of retail and service uses; 2) the proposed donation center is small and will only occupy a small portion of the Goodwill store; 3) as conditioned, the Applicant will be required to exercise adequate property maintenance including the removal of any items which are dumped outside of the store; 4) as conditioned, the Applicant will be required to monitor the site and remove any donations left at the store after hours; and 5) as conditioned, improvements will be required to be 2 made to the property which will reduce impacts on adj~icent uses and aid in the operation of the proposed use. F. The proposed use will not be contrary to the s~~ec~c intent clauses, development regulations or performance standards established for the zoning district in which it is located because: 1) the proposed use is a Conditional Use in the C-1 (Retail Commercial) Zoning District and is a permitted use when the required findings as stated in Section 8.100.060 of the Dublin Zoning Ordinance can be matte; 2) the proposed use is compatible with the existing retail use in the building (Goodell Store) and therefore meets the requirements of the Dublin Zoning Ordinance; and 3) the proposed use is consistent with the intent of the C-1 (Retail Commercial) District as defined by Section 8.24.020.C of the Dublin Zoning Ordinance because the proposed use meets the needs of residents in the City, is compatible with the surrounding land uses acid will be conducted entirely within the existing building. G. The proposed use, as conditioned, is consistent with the Dublin General Plan because: 1) the General Plan Land Use designation for the parcel is Retail Office, which permits retail and service uses; 2) the proposed use is permitted with a Conditional Use Permit and is compatible with the zoning district in which it is located; and 3) as conditioned, the proposed use will operate in such a manner as tc limit impacts on the surrounding businesses. BE IT FURTHER RESOLVED that the Dublin Planning Commission does hereby approve PA 06-053, Conditional Use Permit, to allow Goodwill to accept donations in their existing retail establishment in the C-1 (Retail Commercial) Zoning District subject to the following Conditions of Approval: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits. or establishment of use, and` shall be subject to review and approval by the City of Dublin. Goodwill Industries or their PL, PO On-going Planning agent shall monitor the store a minimum of two times during non-business hours each day to monitor the site, remove trash or unattended donations. 14. Unattended Donations. The Store Manager PL, PO On-going Planning and employees shall continuously monitor the exterior perimeter of the store and shall promptly remove any donations left unattended in these areas. 15. Loading/Unloading. All goods which are PL On-going Planning delivered or picked-up from the store shall be immediately located inside the store' or truck. At no time shall these items be located outside of the store, even on a tem or basis. 16. Trash Bins. All trash and recycling bins PL On-going Planning shall be kept inside of the store at all times and may only be removed on a temporary basis for pick-up. The bins shall be immediately returned to the inside of the store once ick-u has occurred. 17, Security. A security system which PL, PO On-going Planning discourages the dropping off of donations after hours and associated signage shall be installed prior to accepting donations at the store. The security system anti signage shall be maintained at all times. The video surveillance system proposed by the Applicant shall be installed so that it covers the area on the west side of th.e building and any area of the storefront not covered by the flash type camera. PUB LIC WORKS 30. Clarifications and Changes to the PW Prior to Approval of Public Works Conditions. In the event that there needs Improvement Plans to be clarification to these Conditions of Approval, the Directors of Community Development and Public Works have the authority to clarify the intent of these Conditions of Approval to the Applicant/Developer by a written document signed by the Directors of Community Development and Public Works and placed in the project file. The Directors also have the authority to make minor modifications to these conditions without going to a public hearing in order for the Developer to fulfill needed improvements or mitigations resultin from im acts of this ro'ect. 31. Standard Public Works Conditions of PW Prior to Approval of Public Works Approval. Applicant/Developer shall Improvement Plans comply with all applicable City of Dublin Public Works Standard Conditions of Approval. In the event of a conflict between the Public Works Standard Conditions of Approval and these Conditions these Conditions shall revail. 32, Hold Harmless/Indemnification. Improvement and Grading Plans. All .printing and lettering shall be 1/8" minimum height and such shape and weight as to be readily legible on prints and microfilm reproductions. For on-site improvements, the Applicant/Developer shall adhere to the City's On-site Checklist (eight 8-1/2" x 11" pages). All of these reference documents are available from the Public Works Department (call telephone 925-833-6630 for more information). A detailed Erosion Control Plan shall `be included with the improvement plan approval. The plan shall include detailed design, location, and maintenance criteria of all erosion and sedimentation control measures. 34 Grading/Sitework Permit. All PW Issuance of Public Works . improvement work must be performed per Grading/Sitework a Grading/Sitework Permit issued by the Permit Public Works Department. Said permit will be based on the final set of civil plans to be approved once all of the plan check comments have been resolved. Please refer to the handout titled Grading/Site Improvement Permit Application Instructions and attached application (three 8-1/2" x 11" pages) for more information. The Applicant/Developer must fill in and return the applicant information contained on pages 2 and 3. BACKGROUND: The Goodwill store has operated a retail facility at 7232 Regional Street since 2003. The Goodwill store was previously located in the Shamrock Village shopping center. Since moving to its current location in 2003, the Goodwill store has not accepted donations. The previous Goodwill store accepted donations via a trailer parked on the site (allowed by a Conditional Use Permit ap~~roved by the Planning Commission) from 1989 until the store moved to its current location in 2003. The Community Development Director has determined that a builc.ing at which donations are accepted shall be considered a Recycling Facility. Chapter 8.08 of the Dublin Zoning Ordinance defines Recycling Facilities as an indoor or outdoor facility which accepts reusable materials. Recycling Facilities aze a Conditional Use in the C-1 (Retail Commercial) Zoning District in which the Goodwill store is located. Conditional Use Permit approval by the Planning Commission is required in order to allow the Goodwill store to accept donations inside thew store because the drop-off of do nations and resale of the donations is consistent with the definition of a Recycling Facility. ANALYSIS: The Conditional Use Permit process allows the City to place conditions of approval on the project to ensure that the operation of the proposed use is compatible with the surrounding uses. The project has beeri reviewed for issues related to operating chazacteristics, pazking, and project design. Conditions of Approval have been proposed where appropriate to ensure compatibility. In order to minirruze the impact on ~:he adjacent businesses and to ensure that items are not left outside of the store when the store is closed, Goodwill Industries will in~,orporate several measures into the operation of they- businesses including no outside storage, appropr. ate signage to direct patrons and the instillation of video monitoring equipment to monitor the site. The measures are included on page 1 of Attachment 2, which is the written statement for the project. Additional measures and conditions related to the operation of the donation center are discussed in detail below. The parking lot v~~ill be monitored throughout the day to ensure that all trash is removed from the site and any abandoned goods are removed. conditions of Approval 7, 14, 1 `~ and 19 also require that these efforts be conducted regularly. Additionalh~, during the hours when the store is closed, a Goodwill representative will visit the site two times during n~~n business hours to remove any abandoned items. Additionally, in order to ensure that adequate monitoring will be co Zducted on the site and to ensure that patrons do not abandon goods outside of the store, new signage (please refer to the project plans) and a camera system will be installed outside of the building. T'he camera. system will capture a photograph of Page 2 of 5 the patron and will announce recording stating that the business is red and dropping any items off after business hours is considered littering (Conditions of Approval 17 and 18). In order to minimize impacts on the surrounding properties, the loading trucks will be required to park in designated parking stalls (Condition of Approval No. 12) only. Truc;ks are not permitted to be parked in the drive-aisle at any time. The Zoning Ordinance does not include a parking requirement for Recycling Facilities. Iri this case, the parking for a recycling facility in conjunction with a retail store world be 1 stall per 300 square feet (the same as retail). The existing building was approved as a retail building with 18 parking stalls. This is less than the 21 parking stalls that are typically required for a retail use (l stall per 300 square feet). However, because the building was approved with a lower parking requirement and the building was approved as a retail building, the lower number has been "grandfathered" which allows retail uses to continue to operate in the building. It does however, prohibit uses from locating insi ie the building which have a more intense parking requirement than retail (for example an office which requires 1 stall per 250 square feet). Three spaces near the entrance to the donation center will be post~;d with signage limiting the parking time to 20 minutes to facilitate the dropping off of donations. Thy` Conditions of Approval (contained in Attachment 1) have been drafted to require that the property owner exercise adequate property maintenance of the site and also include requirements for the operation of the businesses. These conditions have been drafted to minimize the impact the donation center will have on the adjacent neighbors as well as reducing impacts to City services (such as the Police Department) when items are left outside of the store. Goodwill has agreed to the conditions and the written statement prepared by Goodwill (included in Attachment 1) also includes measures they will incorporate into their business to ensure that they will minimize impacts on the City and the adjacent businesses. With the incorporation of these Conditions of Approval and with the project description as outlined in the project plans and written statement, the acceptance o:' donations at the Goodwill store will be compatible with the existing use rind businesses in the vicinity. Conformance with Zoning Ordinance and General Plan The project site is zoned C-1 (Retail Commercial). A Recycling FaciLty is permitted with the approval of a Conditional Use Permit. The General Plan Land Use designation 1 or the parcel is RetaiUOffice, which permits a wide range of retail and service uses. The proposed applications are consistent with the Dublin General Plan and the Municipal Code because the projects are compatible with the existing zoning and Gener~il Plan Land Use designation. As conditioned, the proposed Conditional Use Permits would ensure that the donation center will be operated and maintained in such a manner as to reduce impacts on surrounding; properties. Conditional Use Permit Findings In order for the Planning Commission to approve a request for a Conditional Use Permit, the Planning Commission must make all. of the findings found in Section 8.100. X60 of the Dublin Zoning Ordinance and included on pages 2-3 of the attached Resolutions (Attachment 1). CONCLUSION: This application has been reviewed by the applicable City departme:its and agencies, and their comments have been incorporated into the Conditions of Approval for the project. The proposed project, as conditioned, is consistent with the Dublin General Plw-~ and the Zoning Districts in which the project site is located and represents an appropriate project for the site.
