A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
APPROVING PA 99-047 AUTONATION/SHAMROCK FORD
AMMEDMENT TO MASTER SIGN PROGRAM / SITE DEVELOPMENT REVIEW
WHEREAS, AutoNation ("Applicant") has proposed to modify the existing building, colors, and
signage of the AutoNation used car facility necessary to allow new car sales, at 4600 Dublin Boulevard in
Eastern Dublin; and
WHEREAS, the City Council approved a Master Sign Program/Site Development Review for the
directional, wall-mounted, and free standing signage for Auto Nation USA, an automobile sales lot with
ancillary service, within a Planned Development Zoning District (Santa Rita Commercial Center PA 94-
001) in Eastern Dublin on October 20, 1998; and
WHEREAS, the Planned Development (PA 94-001) that was approved for this site requires that
the application for Site Development Review be approvedby the City Council at a public meeting; and
WHEREAS, the California Environmental Quality Act (CEQA), together with the State guidelines
and City environmental regulations require that certain projects be reviewed for environmental impact and
that environmental documents be prepared; and
WHEREAS, the project has been found to be Categorically Exempt from CEQA under Section
15311, Class 11 of the California Environmental Quality Act guidelines. The project consists of
construction and placement of on-premise signs accessory to a commercial facility.
WHEREAS, the City Council held a public meeting on said application on October 19, 1999; and
WHEREAS, proper notice of said public meeting and a ten day public review period was given in
all resPects as required by law; and
WHEREAS, the StaffReport was submitted recommending the City CoUncil approve the Master
Sign Program / Site Development Review application subject to Conditions of Approval; and
WHEREAS, the City Council did hear and consider all said reports, recommendations and
testimony hereinabove set forth and used their independent judgment to make a decision.
NOW, TI:rlr~REFORE, BE IT RESOLVED THAT THE Dublin City Council does hereby find
that:

The Master Sign Program modifications (MsP)/Site Development RevieW for PA 99-049 Auto
Nation/Shamrock Ford contributes to an effective and attractive identification of the car dealership
and its users by providing clear, legible signage that will identify and direct automobile and
pedestrian traffic to the site.
The design quality of the site, improved with this MSP, and the surrounding area will be superior to
the quality that would result under the regUlations and standards of Section 8.84.40 "Sign
Development RegUlations"; 8.84.050, Signs Subject To Permits, 8.84.110, "RegUlations for Wall
Signs and Projecting Signs"; and 8.84.120, "Freestanding Sign General RegUlations". All signage
will conform to the overall design and layout of the site and all mounted signage will correspond
well with the building elevations. The signs will reflect the overall design theme of the site and the
adjacent Hacienda Crossings Master Sign Program.

All of the proposed signs have been designed to be compatible with the style and character of the
existing improvements on the site and they are well related to each other.
All proposed signage is visible, legible, does not cause glare or disrupt the flow to pedestrian or
vehicular traffic and conforms with the Design Criteria in Section 8.84.060, of the Zoning
Ordinance. The proposed freestanding signs are ora scale that relates well to the layout of the
automobile dealership and the adjacent Hacienda Crossings Master Sign Program
E. The approval of the MSP/SDR is consistent with the intent of Section 8.104 "Site Development
Review" (SDR). The MSP compliments and improves the site's development and design by
.... : providing a comprehensive sign program that incorporates the architectural style and design of the
existing buildings. Additionally, all signage will promote safe traffic circulation within the site.
The relocation of Shamrock Ford to the AutoNation site, as modified by the conditions of
approval, complies with the General Plan, the Easte~w Dublin Specific Plan because the sales tax
revenue generated by the project would implement the financing plan of the Eastern Dublin
Specific Plan. The Specific Plan contains, goals and policies which require development to fully
fund the cost of providing public services to the area. The public services necessary to serve the
development are provided by the City, based upon the assumptions contained with the Eastern
Dublin Specific Plan fiscal analysis. The Eastern Dublin Specific Plan fiscal analysis anticipated
continuing to receive sales tax revenue from the existing auto dealers. Conditioning the project to
either retain the existing sellers permit number or requiring the applicant to keep a record of sales
from the two sales outlets would allow the proposed conversion project to be consistent with the
Eastern Dublin Specific Plan fiscal analysis and thereby be consistent with the Eastern Dublin
Specific Plan.
Furthermore, the proposed project would be consistent with requirements of the Dublin Zoning
Ordinance because the modified signs establishes a comprehensive, well-designed signage program
for the development.
The approval of the MSP/SDR, as conditioned, will not adversely affect the health or safety of
persons residing or working in the vicinity, or be detrimental to the public health, safety and general
welfare because it promotes a sign program that will provide effective and attractive identification
for the site.
The proposed MSP/SDR considered site layout, vehicular access, circulation, parking, setbacks,
height, walls, public safety and similar elements to ensure that the MSP/SDR design assists in the
provision of a desirable environment for the automobile dealership.

Architectural considerations, including the character, scale and quality of the design, the
architectural relationship with the site and other buildings, building materials and colors, screening
of exterior appurtenances, exterior lighting, and similar elements have been incorporated into the
MSP, where appropriate, in order to insure the compatibility of the walt signs and freestanding
signs with the character of adjacent buildings and uses, including the Hacienda Crossing
retail/entertainment center.
Landscape considerations including the requirement for planters for the fi-eestanding signs that are
of sufficient width, length and height to protect the base of the signs from damage due to vehicular
traffic have been required to insure visual relief and an attractive environment for the public.
CONDITIONS OF APPROVAL
Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of
building permits or establishment of use, and shall be subject to Planning Department review and
approval. The following codes represent those departments/agencies responsible for monitoring
compliance of the conditions of approval. [PL] Planning, [BI Building, [PO] Police, [PW] Public

Department, [DSR] Dublin San Ramon Services District, [CO] Alameda County Department of
Environmental Health
GENERAL SIGN REQUIREMENTS:
This Master Sign Program/Site Development Review approval for PA 99-049 permits the
following: modification of the following existing signs: two (2) freestanding signs, two (2)
Overhead interior signs, five (5) directional signs, five (5) wall-mounted signs and a parking
display/vehicle locator plan as shown on attachments 1, 2 & 3.
This apprOval requires that the exterior colors of the building, the light standards, and the railings
are painted as depicted on project plans and approved color and material board, subject to the
review and approval by the Director of Community Development. The proposed entry feature with
a projecting canopy, as depicted on the project plans is also hereby approved.
Except as modified herein, this approval shall be as generally depicted and indicated by the Auto
Nation USA Exterior Sign Program plans prepared and submitted by Chandler Signs, Inc.,
consisting of 23 sheets, labeled as attachment 1, a site plan, labeled as attachment 2, dated received
October 5, 1999, stamped approved and on file with the City of Dublin Department of Community
Development. Sign's approved under this Master Sign Program shall generally conform to the
following conditions, dimensions, restrictions and notations made and indicated on the documents
labeled Attachment s 1, 2 & 3 and the Dublin Zoning Regulations. [PL]
All signage'shall comply with the provisions established in this Master Sign Program or to the
specific conditions stated. Modifications may be considered by the Zoning Administrator upon
application for a Sign Ske Development Review pursuant to Section 8.104 Site Development
Review. [PL]
Building Permits necessary for installation and/or modifications shall be secured and construction
commenced within one year of the effective date of approval of this Master Sign Program or said
approval shall be void. [B, PL]
All freestanding and wall-mounted signs shown on Attachments 1, 2 & 3, shall be well-maintained
in an attractive manner and in accordance with the approved plans. Any indirect light fixtures used
to illuminate any signage shall be glare-shielded. [PL]
New or proposed wall signs or additional freestanding signs for the automobile dealership site, shall
first be subject to review by the Department of Community Development and shall conform to this
Master Sign Program. The use of said additional wall and/or freestanding signage not shown or
indicated by this Master Sign Program approval, will require a separate Sign Site Development
Review approval by the Zoning Administrator prior to installation or use. Said signage shall
comply with the sign regulation provisions of Section 8.84.060, 8.84.110 and 8.84.120, of the
Zoning Ordinance. [PL]
Wall-mounted signs shall be placed flat against the building wall of the occupied frontage as
applicable. No sign shall appear above the roof line. If signs change, all mounting holes from
previous signs shall be repaired and walls repainted prior to mounting the new signs. [PL]
The Use of any Temporary Promotional Signs (i.e., banners, pennants, flags, balloons, Searchlights
and similar advertising devises) for special advertising and/or promotional use shall first require a
separate Zoning Clearance approval and shall comply with the provisions established in the Sign
Regulations of the Zoning Ordinance. [PL]
The use of any A-Frame, portable or sandwich-board signs on the site is prohibited. Said signs
shall also not be allowed to be placed within the public right-of-way. [PL, PW]
Any vehicles with signage shall be parked as close as practical to the business they serve. Said
vehicles cannot be parked adjacent to the Dublin Boulevard or Myrtle Drive frontages, or adjacent
to Interstate 580, or on the public street. Vehicles with signage shall be used in the normal course
of business and shall not be used as a sign platform or for the sole purpose of attracting people to a
place of business. [PL, PW, PO]
10..-. . The approxted freestanding signs shall be located in a landscaped planter area. Prior to final
inspection by the building inspector, all landscaping and any required irrigation shall be installed for
said freestanding sign. [PL, B]

Applicant will continue to use State Board of Equalization ("SBE") sellers permit number SRCH
21657703 for any business conducted by Shainrock Ford at 7499 Dublin Boulevard and will obtain
a new sellers permit number from the SBE for the business to be conducted on the property (4600
Dublin Boulevard) under the name "Shamrock Ford, an AutoNation Company" consisting of the
sale of new Ford Division cars and trucks and used cars and trucks of any make, sale of parts and
'autOmotive service/repair. AutoNation USA Corporation (or any related company) will continue
to use its existing Dublin SBE sellers permit number (SYEA97158834-0007) for sales of used cars
and trucks and automotive service/repair on the property if AutoNation USA Corporation
Continues such sale and service separate from Shamrock Ford, an AutoNation Company. When
Shamrock Ford relocates its remaining business (e.g., automotive service/repair and parts sales)
from 7499 Dublin Boulevard to 4600 Dublin Boulevard, Shamrock Ford will report revenues from
such business under the new sellers permit number for 4600 Dublin BOulevard.

In the event that the SBE requires Shamrock Ford to obtain suboutlet numbers for its two locations
in Dublin, Applicant will require Shamrock Ford to keep a record of sales from the two outlets
(7499 Dublin Boulevard and 4600 Dublin Boulevard), will record revenues from sales at the two
outlets on Schedule C of its tax return and will make such information available to the City of
Dublin for purposes of assisting the City in complying with its contractual obligation with the
County of Alameda regarding sharing of'property tax revenues. [PL]

Prior to approval of any Parcel Map to subdivide the property, the Director of Community
Development shall determine if Monument Sign No. 2, located adjacent to Dublin Boulevard
constitutes an "off-site advertising sign" under Section 8.84.020 V and 8.84.150 D of the Dublin
Zoning Ordinance and if so, shall require the sign to be removed prior to recordation of the Parcel
Map. [PL, PWl

This Master Sign Program/Sign Site Development Review approval shall be revocable for cause in
accordance with Section 8.96.020.1 of the Dublin Zoning Ordinance. [PL]
