HomeMy WebLinkAbout00-018 TmpCmpaignHdqtrs8/8/00CITY OF DUBLIN PLANNING COMMISSION AGENDA STATEMENT/STAFF REPORT for August 8, 2000 SUBJECT: PUBLIC HEARING PA 00-018, Temporary Campaign Headquarters, Conditional Use Permit (CUP) (Report Prepared by: Andy Byde, Associate Planner) ATTACHMENTS: 1) Project Site Plan 2) Applicant's written statement 3) Resolution Approving the Conditional Use Permit RECOMMENDATION: 1) Open public hearing 2) Receive staff presentation and public testimony 3) Close public hearing 4) Adopt Resolution (Attachment 3) approving the Conditional Use Permit request DESCRIPTION: The Applicant, Guy Houston, is requesting approval of a Conditional Use Permit to allow a temporary campaign headquarters to be located within the vacant Dublin Fishery building, located at 7400 San Ramon Road. The building is approximately 7,800 square feet with 91-dedicated parking spaces. Two full time campaign workers will be at the facility during the hours of operation, in addition to various numbers of volunteers throughout the day. The proposed hours of operation would be from Sam to 7pm daily, with the option of 6 special events that would extend the hours from Sam to 12am. The applicant has proposed the use to terminate on November 30, 2000. ANALYSIS: Specific Plan The subject property is located within Area 3 of the San Ramon Specific Plan. Area 3 was intended for retail uses as well as eating and drinking establishments. Community, religious and chazitable uses are allowed within this azea of the Specific Plan, subject to the securing of a Conditional Use Permit. Staff has determined that a campaign headquarters is consistent with a community use and thus requires a Conditional Use Permit. Conditional Use Permit The purpose of a Conditional Use Permit is to determine whether the proposed use is appropriate for the site and if conditions of approval are required. Issues that are commonly addressed include access to the site, land use compatibility and site design. The Planning Commission must make the following findings before a Conditional Use Permit may be granted: COPIES TO: Applicant PA File 00-018 ITEM NO. G:\PAN\2000\00-O1 S\cup sr.doc 1. The proposed use and related structures is compatible with other land uses, transportation and service facilities in the vicinity 2. The proposed use will not adversely affect the health or safety of persons residing or working in the vicinity, or be detrimental to the public health, safety and welfare,' 3. The proposed use will not be injurious to property or improvements in the neighborhood; 4. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use and related structures would not be detrimental to the public health, safety, and welfare; 5. The subject site is physically suitable for the type, density and intensity of the use and related structures being proposed; 6. The proposed use will not be contrary to the specific intent clauses or performance standards established for the C-1 Zoning District in which it is to be located and; 7. The approval of the Conditional Use Permit will be consistent with the Dublin General Plan. CONSISTENCY WITH THE GENERAL PLAN AND ZONING ORDINANCE: The project is consistent with the City of Dublin General Plan designation of Retail/Office, which allows office and retail uses. The project is also consistent with the San Ramon Road Specific Plan. The project is located C-I (Retail/Office) Zoning District. Additionally, staff finds the project consistent with the development regulations of the Zoning Ordinance. PUBLIC NOTIFICATION: In accordance with State law, a public notice was mailed to all property owners and tenants within 300 feet of the proposed project, for advertisement. for the project and the upcoming public hearing. A public notice was also published in the Tri-Valley Herald and posted at several locations throughout the City. To date, the City has received no contact or objections from surrounding property owners or tenants regarding the current proposal. ENVIRONMENTAL REVIEW: This project has been found to be Exempt from the California Environmental Quality Act (CEQA), according to Section 15301(a), Class 1, Existing Facilities. The a temporary campaign headquarters will occupy an existing building and will only require minor physical modifications to the structure. CONCLUSION: Staff finds that the proposed project is consistent with the findings required for a Conditional Use Permit because: (1) the proposed a temporary campaign headquarters will be entirely enclosed within the existing restaurant building; (2) the 91 parking spaces will be more than adequate to serve the proposed use and; (3) the proposed use is consistent with the General Plan, San Ramon Road Specific Plan, and the development regulations of the Zoning Ordinance. Attn: City of Dublin Planning Department RE: 7400 San Ramon Road application The proposed use at the 7400 San Ramon Road, Dublin site will be for a temporary campaign headquarters. The requested conditional use is for the period ending November 30, 2000. The most recent use for the site has been the "Dublin Fishery" Restaurant. The current site has 91 parking spaces to serve the building. The footprint of the building is approx- imately 7,800 square feet. The new Temporary use would be for a campaign headquarters. The plan would be for 1- 2full time campaign workers to be in the facility during hours of operation, which would be from 8AM-7PM every day. Space would also be available for volunteers to the campaign. Typically, volunteers meet at the headquarters, pick up materials and leave. There will be times where volunteers will work at the headquarters on special projects (envelope stuffing, assembling yard signs, phone calling, etc.). Past history indicates that the maximum number of part-time volunteers working at the headquarters at one time would be 12-15 people. Due to the large size of the property and the number of pazking spaces, it is not assumed that the local community would have adverse impacts. The traffic will be many times less than what the restaurant generated. The property has its own entrance and exit. The adjacent property is vacant, with an easement securing access to the subject property. At this time the property has been vacated. It is already starting to deteriorate with debris and overgrown vegetation. This temporary use will enhance the property and keep it safe for the term of the occupancy. This application asks that the existing sign be retained in the frontage of the property. There is no need for use of the kitchen facility and would ask that a requirement of this conditional use is that no cooking be done on premises. ~~~~ ATTACHMENT ~ RESOLUTION NO. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 0018 TEMPORARY CAMPAIGN HEADQUARTERS CONDITIONAL USE PERMIT TO ALLOW THE ESTABLISHMENT OF TEMPORARY CAMPAIGN HEADQUARTERS WITHIN THE EXISTING FACILITY LOCATED AT 7400 SAN RAMON ROAD, DUBLIN FISHERY. WHEREAS, the Applicant, Guy Houston, has filed a Conditional Use Permit application to allow a temporary campaign headquarters within the existing facility located at 7400 San Ramon Road, in a C-1 Retail/Office Zoning District; and WHEREAS the Planning Commission held a properly noticed public hearing on said application on August 8, 2000; and WHEREAS, the California Environmental Quality Act (CEQA), together with the State guidelines and City environmental regulations require that certain projects be reviewed for environmental impact and that environmental documents be prepared; and WHEREAS, the project has been found to be Categorically Exempt from the California Environmental Quality Act (CEQA), according to Section 1530](a), Class 1; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above set forth and used his independent judgment to make a decision; and WHEREAS, the Planning Commission has found that the proposed project is appropriate for the subject site. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does find that: A. The proposed use is and related structures are compatible with other land uses, transportation and service facilities in the vicinity. B. The use will not adversely affect the health or safety of persons residing or working in the vicinity, or be detrimental to the public health, safety, and welfare. C. The use, under all circumstances and conditions of this permit, will not be injurious to property or improvements in the neighborhood. D. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use and related structures would not be detrimental to the public health, safety and welfare. Attachment 3 E. The subject site is physically suitable for the type, density and intensity of the use and related structures being proposed. F. The approval of this Conditional Use Permit is consistent with the Dublin General Plan and the San Ramon Road Specific Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby approve PA 00-18 Conditional Use Permit to allow a temporary campaign headquarters as generally depicted on Exhibit A, stamped approved and on file, subject to compliance with the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of AHHroval shall be complied with prior to the issuance of buildine Hermits or establishment of use, and shall be subiect to Plannine Department review and approval. This Conditional Use Permit approval for PA 00-018 allows the establishment of a temporary campaign headquarters within an existing building. [PL] 2. The activities associated with the temporary campaign headquarters shall have by the following operating hours: Monday to Sunday 8:00 a.m. - 7:00 p.m. [PL] 3. A total of 6 separate special events (consisting of one 24-hour period each)may occur on the subject property, the hours of operation for the 6 events are from Sam to 12am. [PL] 4. No loudspeakers or amplified music shall be permitted outside of the enclosed buildings. [PL] Any signage on site shall be subject to the Sign Requirements contained within the Dublin Zoning Code. [PL] 6. The Applicant shall comply with all applicable Planning, Building, Alameda County Fire Authority, and Police Department regulations and ordinances. [PL, B, F, PO] This Conditional Use Permit shall be null and void on December 1, 2000. [PL] No cooking or other food preparation that would require the approval of Alameda County Environmental Health Services, is hereby approved. In the event that food preparation is desired, the applicant shall submit a written request, subject to review and approval by the Community Development Director. The applicant will also be required to receive proper approval by Alameda County Environmental Health Services prior to commencing food preparation. 9. This permit shall be revocable for cause in accordance with Section 8.96.020.I of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this use permit shall be subject to citation. [PL] PASSED, APPROVED AND ADOPTED this 8th day of August, 2000.
