Adopt Resolution denying Specific Plan Amendment Study request FINANCIAL STATEMENT: The costs of preparing the General Plan Amendment shall be borne by those affected property owners who have indicated a desire to participate financially. The costs of preparing the Specific Plan Amendment will ultimately be borne by all property owners within the annexation area covered by the ultimate Specific Plan area. DESCRIPTION: In 1993 the City Council approved the Eastern Dublin Specific Plan and General Plan Amendment and the accompanying Environmental Impact Report which the voters approved in January 1994. The Eastern Dublin Specific Plan represented a comprehensive planning effOrt that established land use designations, densities and development patterns for much of Dublin's Eastern Extended Planning Area. In so doing, · the City approved a development area and a rural residential area located outside of the then-existing City limits but within the City's Sphere of Influence. DOC t~ ~ ITEM NO.~, The Eastern Dublin Properties project area, Consisting of 13 contiguous parcels totaling 1,120 acres with 11 different ownerships, subsequently requested annexation, pre-zoning, and related approvals. (See Attachment 1 for a map of the property.) The City certified a Supplemental Environmental Impact Report (SEIR) and approved the annexation, pre-zoning and related approvals on April 2, 2002. The project area annexation received final approval by the Alameda County Local Agency Formation Commission (LAFCo) on July 11, 2002 and steps by the property owners to implement the approved mitigation measures have begun. Additionally, the City entered into a Memorandum of Understanding (MOU) with the City of Livermore, dated May 1, 2002, regarding planning issues of mutual concern.. In the Memorandum of Understanding, Dublin agreed to several items that require changes in text and maps of both the General Plan and Eastern Dublin Specific Plan. Two of the important issues in the Memorandum of Understanding have already been addressed, including removing the Doolan Canyon designation of "Future Study Area" from the General Plan and correcting the conceptual alignment for Central Parkway in the General Plan. This Amendment Study will address paragraph 5 of the Memorandum of Understanding. Specifically, the amendments to the General Plan and Eastern Dublin Specific Plan would include: 1. Land Use Map Consistency. The land use designations for the Eastern Dublin Properties project area are as shown in Attachment 1, the Eastern Dublin Properties Stage 1 Planned Development Land Use Map. This Land Use Map (See Attachment 2) is consistent with the General Plan. However, the Eastern Dublin Specific Plan does not currently cover the whole Eastern Dublin Properties project area and needs to be amended in order to comply with the General Plan which requires a specific plan for the area outside the Eastern Dublin Specific Plan.. (See Attachment 3) 2. Airport Protection Area. (Item no. 5 in the MOU) Dublin has agreed to amend the General Plan to add a policy stating that future uses to the Eastern Dublin Properties project area noted as Future Study Areas will be submitted to the Alameda County Airport Land Use Commission to determine consistency with Livermore's Airport Protection Area. This policy should also be added to the Eastern Dublin Specific Plan. Additionally, the Eastern Dublin Property Owners and the City of Dublin have started the collaborative process of preparing a Resource Management Plan for the Eastern Dublin Properties project area. This Plan will assess the biological and physical resources of the properties in order to determine the development opportunities and environmental constraints that exist in the project area as a whole including the area to be studied for inclusion in the Eastern Dublin Specific Plan. The preparation of a Resource Management Plan will involve soliciting the services of a conSulting firm with experience and expertise in the areas of biological and physical resource analysis and permitting. As a result of the Resource Management Plan opportunities and constraints analysis, it is possible that the current land use plan for the Eastern Dublin Properties project area will change. A General Plan and Eastern Dublin Specific Plan amendment will be required if land uses, infrastructure requirements, and allowable densities are shifted around within the project area to accommodate the findings of the Resource Management Plan. These issues will be a part of this Amendment Study. Government Code section 56375(e) restricts changes to the general plan and zoning for a newly-annexed area for a period of two years from the completion of the annexation. Simply the initiation of a general . plan or specific plan amendment study in the area during the two-year period does not violate the statute. However, City Council approval of such amendments would violate the statute unless the City Council made a finding at a public hearing "that a substantial changes has occurred in circumstances that necessitate a departure from the prezoning in the application to [LAFCO]." The timeline of this General Page2 ~f~ Plan and Specific Plan Amendment Study and the associated Resource Management Plan work make it very unlikely that the actual amendment would be back before the City Council before the two-year waiting period has expired. At this point, the City Council needs to determine whether a General Plan and Specific Plan Amendment Study should be authorized for the project area. Both approval and denial resolutions have been included for City Council consideration. (See Attachments 4 and 5) RECOMMENDATION: Staff recommends that the City Council receive the staff presentation and public testimony; question staff and the public, and adopt a Resolution either authorizing or denying the General Plan and Specific Plan Amendment Study request. Ensuring land use map consistency between the Eastern Dublin Properties project area boundaries, the Eastern Dublin Specific Plan Land Use Map boundaries, and the General Plan Eastern Extended Planning Area Land Use Map; 2. Clarifying Livermore Airport Protection Area requirements in the General Plan and Specific Plan; ~J 3. Studying General Plan and Specific Plan land use changes that will likely result from the findings of the Resource Management Plan; and WHEREAS, the initiation request has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15306, Class 6 of the State CEQA Guidelines for basic data collection, research, and resource evaluation activities; and WHEREAS, Government Code section 56375(e) restricts changes to the general plan and zoning for a newly-annexed area for a period of two years from the completion of the annexation. It has been determined that the simple initiation of a general plan or specific plan amendment study in the area during the two-year period does not violate this statute; and WHEREAS, a staff report was submitted outlining the issues surrounding the request; and WHEREAS, the City Council did hear and consider all such reports, recommendations, and testimony hereinabove set forth and supports the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study for the Eastern Dublin Properties project area; and NOW, THEREFORE, BE IT RESOLVED 'THAT the City Council of the City of Dublin does hereby approve the initiation request for a General Plan and Eastern Dublin Specific Plan Amendment Study for the Eastern Dublin Properties project area. BE IT FURTHER RESOLVED that the Eastern Dublin Property Owners will be required to pay all costs associated with the General Plan and Specific Plan Amendment Study.
