SUBJECT: Acceptance of Improvements for Dublin Boulevard, Amador Plaza
Road, and Required On-Site Improvements at Downtown Safeway

RECOMMENDATION: Adopt the Resolution accepting the improvements to Dublin
BOulevard, Amador Plaza Road,.and required on-site improvements,
a Maintenance Bond in the amount of $406,621 for onsite/offsite
improvements, and approving the traffic regulatory devices installed
as part of the project
FINANCIAL STATEMENT: Safeway has provided a Maintenance Bond in the amount of
$406,621 to guarantee against any defects in improvements to
Dublin Boulevard and Amador Plaza Road, and to any on-site
improvements. Once these improvements have been accepted,
the City will incur maintenance costs for the City street
improvements and modified traffic signal.
DESCRIPTION: The Safeway project at the northeast comer of Dublin Boulevard
and Amador Plaza Road included a 12-foot-wide right-of-way dedication and new westbound lane on
Dublin Boulevard, new pavement striping modifications to add a second southbound left-tm lane on
Amador Plaza Road, modifications to the existing traffic signal, and various frontage and on-site
improvements. These improvements have been constructed pursuant to the Improvement Agreement
and have been completed to the satisfaction of the Director of Public Works. In addition, Safeway has
executed an Agreement for Art Work with Dan Dykes, an artist, to create and erect a 16'-tall stainless steel
sculpture at the site to comply with the Public Art requirement included as Condition of Approval #3 of
City Council Resolution No. 33-01.
The following regulatory traffic improvements will be accepted and approved as part of this project and
added to the City of Dublin Traffic Code:
"No parking" restriction along both sides of Amador Plaza Road from Dublin Boulevard
north to the first driveway.

Staff recommends that the City Council adopt the Resolution accepting the improvements to Dublin
Boulevard, Amador Plaza Road, and required on-site improvements, a Maintenance Bond in the amount
of $406,621 for onsite/offsite improvements, and approving the traffic regulatory devices installed as part
of the project.

RESOLUTION NO. 02
A RESOLUTION OF TIlE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING IMPROVEMENTS FOR DUBLIN BOULEVARD, AMADOR PLAZA ROAD,
AND REQUIRED SITE IMPROVEMENTS, AND APPROVING REGULATORY TRAFFIC
DEVICES INSTALLED AS ROADWAY IMPROVEMENTS (SAFEWAY, INC.)
WHEREAS, the public right-of-way for Dublin Boulevard, in the incorporated territory of
the City of Dublin, State of California, to serve the Downtown Safeway Project, has been irrevocably
dedicated to the public by separate instrument and recorded as Series No. 2001-285635, all in accordance
with the Conditions of Approval for a Conditional Use Permit and Site Development Review, City
Council Resolution 33-01 (P.A. 00-034); and
WHEREAS, the developer, Safeway, Inc., a Delaware Corporation, previously entered into an
agreement with the City of Dublin to improve said roadway in accordance with plans and specifications
on file with the City Engineer, said improvements identified as follows:
a) Developer: Safeway, Inc., a Delaware Corporation
b) Location: 7499-7497 Dublin Boulevard and
6851 Amador Plaza Road
c) Resolution Approving Agreement: 88-01
d) City Streets Affected: Dublin Boulevard and Amador Plaza Road
WHEREAS, the improvements associated with Dublin Boulevard and Amador Plaza Road are
complete in accordance with said plans and specifications, and any approved modifications thereto, to the
satisfaction of the City Engineer; and
WHEREAS, the developer has installed certain traffic regulatory devices as a part of the
improvements; and
WHEREAS, the Performance Bond and Labor and Materials Bond can be released in accordance
with the authority contained in §66499.7 of the Government Code of the State of California, and replaced
with a Maintenance Bond to guarantee maintenance of the completed work for a one-year period.
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed within Dublin Boulevard and Amador Plaza Road are hereby
approved and accepted subject to a one-year guarantee period.
2. The traffic regulatory devices installed by the developer are hereby included in the City of
Dublin Traffic Code, said regulatory devices to include the following:
"No parking" restriction along both sides of Amador Plaza Road from Dublin
Boulevard north to the first driveway.
3. The original Performance Bond issued by Liberty Mutual Insurance Company (Bond No.
4123392) in the mount of $1,626,482.00 be released.
4. The original Labor and Materials Bond issued by Liberty Mutual Insurance Company
(Bond No. 4123392) in the amount of $1,626,482.00 be released.
5. The submitted Maintenance Bond in the amount of $406,621.00 by Liberty Mutual
Insurance Company (Bond No. 024-016-130) be accepted as security for the aforesaid
one-year maintenance period, said period to commence on this date and terminate on
17th day of September, 2003.
PASSED, APPROVED AND ADOPTED this 17th day of September, 2002.
