RECOMMENDATION: Adopt Resolution Finding the City's Proposed Acquisition of 5777 Scarlett Court (APN 941-0550-029) to be in Conformity with the Dublin General Plan. PROJECT DESCRIPTION: Prior to the initiation or construction of Public Works projects, the Planning Commission is required to review and report on the Public Works projects proposed for the ensuing fiscal year, as to their conformance with the City's General Plan. Similarly, prior to the acquisition of real property for public purposes, California Government Code section 65402(a) requires that the location, purpose and extent of an acquisition of property by the City be submitted to and reported upon by the City's Planning Commission as to conformity with the General Plan. The purpose of this item is to have the Commission provide a report on the City's proposed acquisition of 5777 Scarlett Court as to its conformity with the General Plan. BACKGROUND: On December 16, 2008, the City Council entered into an agreement with the property owner of 5777 Scarlett Court to purchase the property, following the City's successful completion of certain due diligence activities including the Planning Commission's General Plan conformity report. 5777 Scarlett Court is the former site of the 84 Lumber property. The City plans to use the property, and its existing buildings with minor modifications, as the City's Maintenance Yard Facility. A Maintenance Yard Facility along with an Emergency Operations Center is identified as a future project (Project No. 93570) in the Five Year Capital Improvement Plan (CIP) (2008-2013) adopted by the City Council in June, 2008. Although this project is identified in the CIP, no funds were appropriated for Fiscal Year 2008-2009. On June 24, 2008, the Planning Commission found the City's Capital Improvement Program to be in conformity with the City's General Plan. COPIES TO: Property Owner -41 1 ITEM NO. Page 1 of 2 G:Wgendas12009Maintenance Yard FacilityW SR 1.13.09.doc Staff is proposing to proceed with an initial phase under Capital Improvement Project No. 93570, involving only the Maintenance Yard Facility on the property at 5777 Scarlett Court, if acquired. It is anticipated that, provided the sale is completed, Staff will present to the City Council a separate Project (Phase 2) that will address the cost of design, site and building improvements necessary to make the facility functional for City use. SCARCE GENERAL PLAN CONFORMITY: The proposed acquisition of 5777 Scarlett Court and its use as a City maintenance yard facility is consistent with the General Plan Land Use Designation of Business Park/Industrial and Outdoor Storage. The maintenance yard would be consistent with the applicable General Plan and Zoning, is in a developed area, is fully served by public utilities and services, and is a developed site with no habitat value. The area is developed with Service Commercial and Light Industrial uses with no Residential uses nearby; the acquisition and maintenance yard use would have no potential for traffic, noise, air quality or water quality impacts. Staff is unaware of any policies contained in the General Plan that are inconsistent with the proposed acquisition and use. ENVIRONMENTAL REVIEW: The acquisition of the property is exempt from CEQA under the Class 1, Existing Facilities and Class 32, Infill Development categorical exemptions. The property is currently developed with paved storage and parking areas, a metal storage building and two other structures that will accommodate the City's Maintenance Yard Facility. The operation of the facility will involve outdoor storage, vehicle storage, maintenance and related administrative office use and will involve negligible or no expansion of the Page 2 of 3 recent lumber yard use. The maintenance yard would be consistent Nvith the applicable General Plan and Zoning, is in a developed area, is fully served by public utilities and services, and is a developed site with no habitat value. The area is developed with Service Commercial and Light Industrial uses with no Residential uses nearby; the acquisition and maintenance yard use would have no potential for traffic, noise, air quality or water quality impacts. RECOMMENDATION: Staff recommends the Planning Commission adopt the Resolution Finding. the City's Proposed Acquisition of 5777 Scarlett Court (APN 941-0550-029) to be in Conformity with the Dublin General Plan. Page 3 of 3 RESOLUTION NO. 09 - XX A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN FINDING THE CITY'S PROPOSED ACQUISITION OF 5777 SCARLETT COURT (APN 941-0550-029) TO BE IN CONFORMITY WITH THE DUBLIN GENERAL PLAN WHEREAS, the City Council of the City of Dublin adopted the 2008-2013 Capital Improvement Program (CIP) on June 26, 2008; and WHEREAS, the CIP outlines major infrastructure improvements through Fiscal Year 2013, including a Maintenance Yard Facility/Emergency Operations Center (Project No. 93570); and WHEREAS, the City Council on December 16, 2008 including the adoption of Resolution (Resolution No. 219-08) approved a purchase and sale agreement with the 84 Lumber Company for the City's proposed acquisition of the property at 5777 Scarlett Court which, if acquired, would be used for a Maintenance Yard Facility; and WHEREAS, Section 65402 of the Government Code requires that that the location, purpose and extent of an acquisition of property by the City be submitted to and reported upon by the City's Planning Commission as to conformity with the General Plan; and WHEREAS, Government Code Section 65402 (a) requires the Planning Commission to review the proposed acquisition of property for conformance with the City's General Plan; and WHEREAS, The proposed acquisition of 5777 Scarlett Court is in conformance with the General Plan and its use as a City maintenance yard facility is consistent with the General Plan Land Use Designation of Business Park/Industrial and Outdoor Storage.
