Thompson, Public Works Director ATTACHMENTS: 1) 2) Resolution Agreement with Jennifer Lin RECOMMENDATION: ~Adopt Resolution FINANCIAL STATEMENT: The combination of this agreement, together with the Development Agreement for the Dublin Ranch project, provides that Jennifer Lin will pay the cost of the design for interchange improvements at the I-580/Fallon interchange. The cost of this design phase is broken down as follows: Design Contract (CCS) Project Management (Cordoba) City Staff Time Contingency $ 593,180 30,000 10,000 30,000 TOTAL: $ 663,180 The Developer (Lin) will receive a credit against payment of the future Eastern Dublin Traffic Impact Fees (TIF) in an amount equal to funds advanced for this work. TIF Credit will only be given after the cash deposits have been received by the City. The use of this credit is to be defined in the Development Agreement for each project and used according to the established TIF policy at the time of development. The Agreement has been signed by the authorized Developer representative. DESCRIPTION: Improvement of the 1-580/Fallon Road Interchange is a required traffic mitigation for the Dublin Ranch Areas A-E and F, G & H Developments. The City Council previously approved the preparation of a Project Report for the Improvement of the 1-580/Fallon Road Interchange, and this Report is currently nearing completion. The design of the interchange improvements consists of preparing the COPIES TO: Martin Inderbitzen, for Jennifer Lin g:\develop\interchanges\Fallon PR EDkagst fallon des.doc ITEM NO. 'detailed improvement plans, specifications and estimates for construction and is the next step after the Project Report is approved by Caltrans. The previously approved Development Agreement with the Jennifer Lin developer provides for payment of costs related to the design of the needed 1-580/Fallon Road interchange improvements. A separate item on this agenda provides for the City's Agreement with CCS Planning and Engineering for preparation of the design. The City Council previously approved an agreement with Eric Cordoba of Cordoba Consulting for project management and coordination services related to improvement of several interchanges, including this interchange project. Staff recommends that the City Council adopt the resolution approving the Agreement. -2- RESOLUTION NO. - 00 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING AGREEMENT WITH JENNIFER LIN, REGARDING DESIGN OF THE 1-580/FALLON ROAD INTERCHANGE WHEREAS, a part of the mitigation for the Dublin Ranch Areas A-E and F, G & H developments requires improvement of the 1-580/Fallon Road Interchange; and WHEREAS, the City and Jennifer Lin have agreed to the preparation of a design related to this interchange; and WHEREAS, a credit against payment of future Category 1 Eastern Dublin Traffic Impact fees will be provided to offset each of Jennifer Lin's payments of costs related to the project; NOW, THEREFORE, BE IT RESOLVED that the Dublin City Council approves the agreement with Jennifer Lin regarding preparation of the design for the I-580/Fallon Interchange. BE IT FURTHER RESOLVED that the Mayor is authorized to execute the agreements. PASSED, APPROVED AND ADOPTED this 16th day of May, 2000. AYES: NOES: ABSENT: ABSTAIN: ATTEST: Mayor City Clerk g:develop\interchanges\Fallon PR ED\reso fallon design AGREEMENT BETWEEN JENNIFER LIN AND CITY OF DUBLIN REGARDING DESIGN OF THE 1-580/FALLON ROAD INTERCHANGE IMPROVEMENTS THIS AGREEMENT is entered into this 16th day of May, 2000, between the City of Dublin, a municipal corporation ("City") and Jennifer Lin ("Lin"). RECITALS Lin owns approximately 1,333 acres of land located within the area generally known as Eastern Dublin. Some of Lin's property is within the City of Dublin and the remainder of Lin's property is within the City's sphere of influence. City has adopted a traffic impact fee (Eastern Dublin Traffic Impact Fee) to pay for road improvements necessary in Eastern Dublin. City's Eastern Dublin Specific Plan ("Specific Plan") designates land uses for Lin's property. Lin will be required to pay an Eastern Dublin Traffic Impact Fee when Lin develops her property. A final design that consists of the preparation of construction documents, Improvement Plans, Specifications, and estimates is required by Caltrans in connection with improvements to the Fallon Road / 1-580 Interchange. Lin has agreed to advance funds to City for retention of a consultant to prepare construction documents as provided in this agreement and City has agreed to provide Lin a credit against payment of future Eastern Dublin Traffic Impact Fees in an amount equal to the funds advanced. AGREEMENT Now, therefore, City and Lin agree as follows: 1. Consultant City will retain a consultant to prepare construction documents for the Fallon Road/I-580 Interchange. City intends to enter into an agreement with a consultant within 30 days of this agreement. 2. Payment Lin will pay an initial deposit of $200,000 to City contemporaneous with execution of this agreement to be used by City to cover City's costs of the construction document preparation as set forth in paragraph 1 above. Any funds remaining shall be returned to Lin following completion of the construction documents. Lin shall deposit additional funds when requested by the City's Public Works Director but not to exceed an additional $463,180 for a total contribution of $663,180. 3. Credit Aqainst TIF City shall provide a credit to Lin in the amount of Lin's payment for the construction documents. The amount of the credit shall not be increased for inflation nor shall interest accrue on the amoun{ of the credit. The credit may be used in the manner and subject to the provisions of City's administrative guidelines including any amendments to such resolution for use of TIF credits. 4. No Obligation to Approve Proiect This agreement shall not be construed as providing Lin with any assurance that any application for a land use entitlement will be granted by City for Lin's property.
