FINANCIAL STATEMENT: No financial impact to the City DESCRIPTION: On February 6, 200t, the City and DSRSD entered into a Cooperative Agreement concerning the City's Dublin Boulevard Widening - Dougherty Road to Scarlett Drive capital project, to include the installation of a recycled water pipeline as a cost- and time-savings measure. This City project widened Dublin Boulevard to six lanes from Dougherty Road to Scarlett Drive and included a new traffic signal system at the intersection of Dublin Boulevard and Scarlett Drive. On July 2, 2002, the City Council accepted all improvements under Contract No. 00-16, Dublin Boulevard Widening - Dougherty Road to Scarlett Drive, from McGuire & Hester, Inc. On July 16, 2002, DSRSD's Board of Directors accepted the recycled water pipeline and appurtenances constructed as part of Contract No. 00-16, and paid the City all costs required under the Agreement. The cooperative agreement requires Dublin to deed the Pipeline, once completed, to DSRSD. Staff recommends that the City Council adopt the resolution conveying the deed to Dublin San Ramon Services District for the recycled water pipeline and appurtenances installed as part of the "Dublin Boulevard Widening - Dougherty Road to Scarlett Drive" project. ~ COPIES TO: DSRSD ITEM NO. 4_~ g:\agenmisc~S authorize RWP / ~ j RESOLUTION OF TIlE CITY COUNCIL OF TIlE CITY OF DUBLIN ' EXECUTION OF DEED TO DUBLIN SAN RAMON SERVICES DISTRICT CONVEYING TITLE TO RECYCLED WATER PIPELINE, AND APPURTENANCES TI:IERETO INSTALLED AS PART OF THE "DUBLIN BOULEVARD WIDENING - DOUGHERTY ROAD TO SCARLETT DRIVE" PROJECT PURSUANT TO THE PARTIES' COOPERATIVE AGREEMENT WHEREAS, on February 6, 2001, the City of Dublin and the Dublin San Ramon Services District (DSRSD) duly entered into the Cooperative Agreement concerning Dublin Boulevard Widening Project and Construction and Acquisition of Recycled Water Line ("Agreement"), pursuant to which the City completed the installation of public improvements generally described as the "Dublin Boulevard Widening - Dougherty Road to Scarlett Drive" project; and WHEREAS, the City, on July 2, 2002, acting through its City Council, accepted such improvements in their entirety, and DSRSD, through its Board of Directors on July 16, 2002, accepted the portion of said improvements called "District's Project" in the Agreement, and DSRSD has paid to City all costs required of it under the Agreement; and WHEREAS, Paragraph l(e) of the Agreement obligates the City to convey title of "District's Project" to, or to confirm vesting of title thereof in, DSRSD by a resolution duly adopted by its City Council or other document approved as to form by DSRSD's counsel; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin approves the conveyance to DSRSD of all of the City's right, title and interest in the following portions of the public improvements generally described as the "Dublin Boulevard Widening - Dougherty Road to Scarlett Drive" project accepted by the City Council of the City of Dublin on July 2, 2002: 1. 24-inch diameter recycled water pipeline extending approximatelY one thousand five hundred feet; 2. Various valves, hydrants and other appurtenances to said pipeline as adjusted or installed. BE IT FURTHER RESOLVED that the Mayor is authorized and directed to execute a Deed Conveying Recycled Water Pipeline, Conduit, and Appurtenances to accomplish this conveyance.
