The property is owned by Edwin and Judith Wright. The owners have given permission for this permit application. The automobile/vehicle storage yard is a triangular area that measures 80 feet by 90 feet by 120 feet and is located at the year of the property along the sough property line adjacent to American Building Components. The storage yard has been in existence for several years and is paved and fenced. The Applicant is requesting that the existing use be made conforming with the requirements of the Zoning Ordinance by means of this Conditional Use Permit. ANALYSIS: CONDITIONAL USE PERMIT The purpose of a Conditional Use Permit is to determine whether the proposed use is appropriate for the site and if conditions of approval are required. Issues that are commonly addressed include access to the site, land use compatibility and site design. The Planning Commission must make the following findings before a Conditional Use Permit may be granted: 1. The proposed use and related structures is compatible with other land uses, transportation and service facilities in the vicinity 2. The proposed use will not adversely affect the health or safety of persons residing or working in the vicinity, or be detrimental to the public health, safety and welfare; 3. The proposed use will not be injurious to property or improvements in the neighborhoo& COPIES TO: Annette Wahlgren, Applicant Edwin Wright, Owner PA File g:pa99-002/pcsr There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use and related structures would not be detrimental to the public health, safety, and welfare; The subject site ia' physically suitable for the type, density and intensity of the use and related structures being proposed; The proposed use will not be contrary to the specific intent clauses or performance standards established for the PD (Planned DevelopmenO Zoning District in which it ia' to be located and; The approval of the Conditional Use Permit will be consistent with the Dublin General Plan. ISSUES: The potential issues associated with establishing an automobile/vehicle storage lot include: 1) traffic and circulation; and 2) compatibility with adjacent uses. Traffic and Circulation: The storage lot is used to store vehicles that the business is repairing. No additional trips would be generated than those by the repair service itself. The Department of Public Works has determined that this project will not generate traffic and that a Traffic Impact Fee is not required. Compatibility with adjacent uses: The automobile/vehicle storage lot would be consistent with the adjacent American Building Components property and with the other uses on the Wright property which consist of a paint sales company, a newspaper distribution service and a marble bullnosing company. CONSISTENCY WITH THE GENERAL PLAN AND ZONING ORDINANCE: The project is consistent with the City of Dublin General Plan designation of Business Park/Industrial: Outdoor Storage which allows outdoor storage in connection with business park and industrial uses. The Rear Yard and Side Yard setbacks in the C-2 (General Commercial) Zoning District are 0 feet. The storage lot may therefore be located within those yards at the southeast end of the property. The project is consistent with the development regulations of the Zoning Ordinance. Public Notification: In accordance with State law, a public notice was mailed to all property owners and tenants within 300 feet of the proposed project, to advertise the project and the upcoming public hearing. A public notice was also published in the Tri-Valley Herald and posted at several locations throughout the City. To date, the City has received no contact or objections from existing businesses in Dublin Station or surrounding property owners regarding the current proposal. ENVIRONMENTAL REVIEW: This project has been found to be Exempt from the California Environmental Quality Act (CEQA), according to Section 15061(b)(3). It can be seen with certainty that there is no possibility that the project may have an impact on the environment because the proposed automobile/vehicle storage lot is an existing use in a paved and fenced area adjacent to the repair garage. There is no possibility that significant environmental impacts would occur from this use. CONCLUSION: The proposed automobile/vehicle storage yard is consistent with the General Plan and the development regulations of the Zoning Ordinance and would be compatible with adjacent land uses. The yard has been 2 ~n existence for several years. Approval of this Conditional Use Permit would bring the use into conformity with the land use requirements of the Zoning Ordinance. RECOMMENDATION: Staff recommends the Planning Commission open a public hearing, receive the staff presentation and public testimony, close the public hearing and deliberate and adopt the Resolution (Attachment 4) approving Conditional Use Permit PA 99-002 John's European Auto Service for an automobile/vehicle storage yard. We currently use this lot to store vehicles in various stages of repair. The lot is not open on a regular basis, but is locked and accessible only by the owner, John Wahlgren. The lot cannot be seen from the street, and does not not have any negitive impact on the surrounding businesses. There is no noise associated with the storage lot, nor is there any hazardous waste or substance. Thank you, Annette Wahlgren' John's European Auto Service 6295 Dougherty Road Dublin, CA 94568 ATTACHMENT RESOLUTION NO. 99 - xx A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 99-002 JOHN'S EUROPEAN AUTO SERVICE CONDITIONAL USE PERMIT REQUEST FOR AN AUTOMOBILE/VEHICLE STORAGE YARD LOCATED AT 6289 DOUGHERTY ROAD WHEREAS, the Applicant, Annette Wahlgren of John's European Auto Service has requested approval of a Conditional Use Permit to allow an Automobile/Vehicle Storage Yard located at 6289 Dougherty Road, in a PD (Planned Development) Zoning District; and WHEREAS, a vehicle storage yard has existed at the location proposed on this Conditional Use Permit for several years; and WHEREAS, the Califomia Environmental Quality Act (CEQA), together with the State guidelines and City environmental regulations require that certain projects be reviewed for environmental impact and that environmental documents be prepared; and WHEREAS, the project has been found to be Exempt from the California Environmental Quality Act (CEQA), according to Section 15061 (b)(3). It can be seen with certainty that there is no possibility that the project may have an impact on the environment because the proposed automobile/vehicle storage lot is an existing use in a paved and fenced area adjacent to the repair garage. There is no possibility that significant environmental impacts would occur from this use; and WHEREAS the Planning Commission held a properly noticed public hearing on said application on April 27, 1999; and WHEREAS, the Staff Report was submitted recommending that the application be approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth and used his independent judgment to make a decision; and WHEREAS, the Planning Commission has found that the proposed project is appropriate for the subject site. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does find that: The proposed use is compatible with other land uses, transportation and service facilities in the vicinity because the proposed use will be located adjacent to similar uses and will generate no additional traffic. The proposed use will not adversely affect the health or safety of persons residing or working in the vicinity, and will not be detrimental to the public health, safety and welfare because all City and Alameda County regulations and conditions will be met. ATTACHMENT C. The use will not be injurious to property or improvements in the neighborhood because the project will generate no traffic and has no environmental impacts. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use and related structures would not be detrimental to the public health, safety, and welfare. The subject site is physically suitable for the type, density and intensity of the use and related structures being proposed because it is flat, paved and enclosed with a fence, and because the Automobile/Vehicle Storage Yard is compatible with surrounding uses. The use is not contrary to the specific intent clauses, development regulations, and performance standards established for the zoning district in which it is located because the project is consistent with the PD (Planned Development) Zoning District. G. The proposed use permit amendment is consistent with the Dublin General Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby approve PA 99-002 John's European Auto Service Conditional Use Permit request to allow an Automobile/Vehicle Storage Yard at 6289 Dougherty Road, as generally depicted by the site plan labeled Attachment 2, dated received on February 5, 1999, stamped approved and on file with the Dublin Department of Community Development, subject to compliance with the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. [PL.] Plaiming, lB] Building, [PO] Police, [PWI Public Works [ADM] Administration/City Attorney, [FIN] Finance, [FI Alameda County Fire Department, [DSR] Dublin San Ramon Services District, [CO] Alameda County Department of Environmental Health. GENERAL PROVISIONS Period of appr0val. This approval shall be null and void in the event the approved use fails to be established within one year, or ceases to operate for a continuous one-year period. [PL] Noise/Odors/Nuisances. The Applicant shall limit interior and exterior noise or odors so as not to create a nuisance to the existing or surrounding businesses or to neighboring properties. [PL] Disposal of Hazardous Substances and Petroleum Products. The Applicant shall not dispose of any hazardous substances or petroleum products within the Automobile/Vehicle Storage Yard. [PL] Activities. All activities associated with the use shall be conducted entirely within the fenced and gated enclosure. [PL] 2 Maintenance. The Applicant shall be responsible for maintaining the premises in safe, clean and litter-free conditions at all times. The Applicant shall be responsible for cleaning up and disposing of trash and litter within the automobile/vehicle storage yard. [PL] Annual review. On at least an annual basis, this Conditional Use Permit shall be subject to Zoning Investigator Review and determination as to compliance with the conditions of approval. [PL] Revocation of permit. The permit shall be revocable for cause in accordance with Section 8.96.020.I of the Dublin Zoning Ordinance. [PL] PASSED, APPROVED AND ADOPTED this 2Th day of April, 1999.
