Excerpt from Government Code Sections 65401 and 65402 RECOMMENDATION: ,, jAdopt Resolution finding the additional public works projects O~-~F within the 1998-2003 Capital Improvement Program Update to be consistent with the General Plan BACKGROUND: Government Code Sections 65401 and 65402 (a) require the Planning Commission to review public works proposed for the ensuing fiscal year for their conformance with the City's adopted General Plan. City staffhas prepared an update to the five year Capital Improvement Program (CIP) covering Fiscal Years 1998-2003. This plan was prepared and adopted last year to identify the needs for major infrastructure improvements and capital items through fiscal year 2003. The Planning Commission's role is to review those additional major public works within the Capital Improvement Program Update to determine whether they are in conformance with the City's General Plan. Not all of the Capital Items within the existing Capital Improvement Program or the additional items added to the Capital Improvement Program Update are major public works projects. Projects which were not reviewed in 1998 by the Planning Commission that are proposed in this year's Update to the five year CIP include the following: General Improvements Civic Center Library (Phase I) Emerald Park Fire Station Fire Station Acoustic Improvements g:\agendas\99\65402CIP COPIES TO: ln-house Distribution Community Improvements Audible Pedestrian Signals City Entrance Landscaping Improvements Downtown Improvements Plan Downtown Special Flood Hazard Areas Engineering Study Iron Horse Trail Amenities Major Arterial Tree Well/Median Planting Median Paver Repair - Downtown Arterial Streets Stagecoach Road Landscaping Improvements Trash Racks Behind Padre Way Village Parkway Median Landscaping - Dublin Boulevard to Amador Valley Boulevard Parks Handicap Lift for Senior Center Heritage Center Storage Building Pool Lift for Swim Center Shannon Center HVAC Dublin Ranch Village Square Senior Center Emerald Glen Park Aquatic Center Emerald Glen Park Community Center Emerald Glen Park Recreation Center Sports Park Community Theater Street Projects 1-580/Hacienda Road Freeway Interchange 1-580/Tassajara Road/Santa Rita Road 1-580/Fallon Road Freeway Interchange Eastern Dublin Street Right-of- Way Acquisition (The above four items were originally approved last year under the Eastern Dublin Arterial Street Improvements, but are identified as separate projects this year) 1-580/San Ramon Road/Foothill Road Interchange Improvements RECOMMENDATION: Staff recommends that the Planning Commission review the 1998-2003 Capital Improvement Program Update and adopt the attached Resolution finding that it is in conformance with the City's General Plan. RESOLUTION NO. 99- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN FINDING THAT THE 1998-2003 CAPITAL IMPROVEMENT PLAN (CIP) UPDATE OF THE CITY OF DUBLIN IS CONSISTENT WITH THE ADOPTED CITY OF DUBLIN GENERAL PLAN WHEREAS, the City of Dublin has completed a 1998-2003 CIP update outlining major infrastructure improvements through Fiscal Year 2003; and WHEREAS, Sections 65401 and 65402 (a) of the Government Code requires that plans for major public works for the ensuing fiscal year be submitted to the Planning Commission for review as to conformance with the adopted City of Dublin General Plan; and WHEREAS, this application is exempt from environmental review under State law; and WHEREAS, the Planning Commission did review and consider the draft document and heard recommendations at a public meeting on June 22, 1999. NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning Commission does hereby find that the major public works projects proposed within the 1998-2003 CIP Update of the City of Dublin dated June, 1999, comply with the General Plan as adopted, and said Resolution shall be submitted to the City Council in accordance with the Government Code. AYES: NOES: ABSENT: ATTEST: Planning Commission Chairperson Community Development Director g:agenda\98\65402cip ATTACHMENT ~ a general plan or part If thereof has been adopted, withinsuch time as may be fixed by the legislative body, each county orcity officer, department, board, or commission, and each governmentalbody, commission, or board, including the governing body of anyspecial district or school district, whose jurisdiction lies whollyor partially within the county or city, whose functions includerecommending, preparing plans for, or constructing, major publicworks, shall submit to the official agency, as designated by the respective county board of supervisors or city council, a list of theproposed public works recommended for planning, initiation orconstruction during the ensuing fiscal year. The official agencyreceiving the list of proposed public works shall list and classifyall such recommendations and shall prepare a coordinated program ofproposed public works for the ensuing fiscal year. Such coordinatedprogram shall be submitted to the county or city planning agency for review and report to said of~~ as to conformity with theadopted general plan or part thereof~If a general plan or part thereof has been adopted, noreal property shal~be ~cquired by dedication or otherwise for street, square, park or other public purposes, and no real propertyshall be disposed of, no street shall be vacated or abandoned, and nopublic building or structure shall be constructed or authorized, ifthe adopted general plan or part thereof applies thereto, until thelocation, purpose and extent of such acquisition or disposition, suchstreet vacation or abandonment, or such public building or structurehave been submitted to and reported upon by the planning agency asto conformity with said adopted general plan or part thereof. The planning agency shall render its report as to conformity with saidadopted general plan or part thereof within forty (40) days after thematter was submitted to it, or such longer period of time as may bedesignated by the legislative body. If the legislative body so provides, by ordinance or resolution, the provisions of this subdivision shall not apply to: (1) the disposition of the remainder of a larger parcel which was acquiredand used in part for street purposes; (2) acquisitions, dispositions,or abandonments for street widening; or (3) alignment projects,provided such dispositions for street purposes, acquisitions,dispositions, or abandonments for street widening, or alignmentprojects are of a minor nature.
