The first process, Remove and Replace, is used in instances where the offset is more significant or where tree roots are causing the problem. This procedure requkes removal of the existing sidewalk, and in the case of root problems, removal of the tree roots, installation of a root barrier to mitigate future problems, and then replacement of the concrete sidewalk. The second process is to grind concrete to match the adjoining grade for less severe offsets. This process is essentially more of a maintenance-type procedure, as opposed to the construction element of removal and replacement of sidewalk. For this reason, the sidewalk ~mSnding contract is recommended as a two- year contract similar to the Annual Striping contract, except that the City Council needs to approve the gmmtc~proj Xsidewalk~ag stauth COPIES TO: ITEM NO. funding each fiscal year. The specifications for this contract will include notification to the prospective contractor of the necessity for annual authorization of funding. While maintenance of sidewalks and other fi-ontage improvements is legally the responsibility of the private property owner, the City Council has adopted a City-paid sidewalk repair program on a year-by-year basis since 1983. At the budget hearing for Fiscal Year 1997-98, the City Council agreed to extend the City- paid repair program for ah additional year. St~ffrecommends that the City Council adopt the resolution establishing the City-paid sidewalk repair policy for Fiscal Year 1996-97 and authorize Staffto advertise for bids for the Annual Sidewalk Safety Repair Program. The existence of this program does not abrogate the responsibility of the property owners to maintain their frontage improvements in a safe manner under Section 5610 of the California Streets and Highways Code. g:[pwlmtccprofi$id~walk[98policy
