HomeMy WebLinkAbout99-035 ExtndStyAmrcRvrs 09-28-1999 AGENDA STATEMENT PLANNING COMMISSION MEETING DATE: September 28, 1999 SUBJECT: ATTACHMENTS: PA 99-035, Extended Stay America Appeal (Report Prepared by~nnis Carrington, Senior Planner) 1) Resolution reversing Planning Department decision to deny the Extended America Sign on the AutoNation freestanding sign and allowing the Extended Stay America sign on the AutoNation freestanding sign RECOMMENDATION: 1) Adopt Resolution reversing Planning Department decision to deny the Extended America Sign on the AutoNation freestanding sign and allowing the Extended Stay America sign on the AutoNation freestanding sign DESCRIPTION: On September 14, 1999, the Planning Commission considered an appeal by Extended Stay America of a decision by the Planning Department to deny the application of Extended Stay America to place a sign on the AutoNation pylon sign on 1-580. At that meeting the Planning Commission directed Staffto prepare a resolution reversing Planning Department decision to deny the Extended America Sign on the AutoNation freestanding sign and allowing the Extended Stay America sign on the AutoNation freestanding sign. The resolution is Attachment 1 to this report. RECOMMENDATION: Staff recommends that the Planning Commission adopt the Resolution reversing Planning Department decision to deny the Extended America Sign on the AutoNation freestanding sign and allowing the Extended Stay America sign on the AutoNation freestanding sign. G:pa99035/pcsr2 COPIES TO: Mr. Art Sallee Mr. Harry Brumley Mr. Craig Caldwel PA File RESOLUTION NO. 99 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN REVERSING THE DECISION OF THE PLANNING DEPARTMENT TO DENY THE EXTENDED STAY AMERICA SIGN ON THE AUTONATION FREESTANDING SIGN AND ALLOWING THE EXTENDED STAY AMERICA SIGN ON THE AUTONATION FREESTANDING SIGN WHEREAS, Extended Stay America requested permission to place a sign on the AutoNation freestanding sign adjacent Highway 1-580; and WHEREAS, the Planning Department denied Extended Stay America permission to place a sign on the AutoNation freestanding sign adjacent Highway 1-580; and WHEREAS, Extended Stay America appealed the decision of the Planning Department to the Planning Commission; and and WHEREAS, the Planning Commission held a public hearing on said application on September 14, 1999; WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the Staff Report recommended that the Planning Commission sustain the decision of the Planning Department; and WHEREAS, the Planning Commission determined that the Extended Stay America parcel was part of the original AutoNation parcel when the AutoNation freestanding sign was originally approved and therefore that the Sign Regulations should be interpreted to allow the Extended Stay America Hotel Sign to be placed on the AutoNation freestanding sign on Highway 1-580; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above set forth and used their independent judgment to evaluate the project and voted to reverse the decision of the Planning Department; and WHEREAS, the Planning Commission directed Staffto prepare a resolution reversing the decision of the Planning Department and allowing the Extended Stay America sign to be placed on the AutoNation freestanding sign on Highway 1-580; and WHEREAS, the Planning Cormnission held a hearing on said application on September 28, 1999; and WHEREAS, proper notice of said public hearing was given in all respects as required by law. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: The Extended Stay America parcel was part of the original AutoNation parcel when the AutoNation freestanding sign was originally approved. B. The Extended Stay America Sign shall be allowed to be placed on the AutoNation freestanding sign on Highway 1-580. PASSED, APPROVED AND ADOPTED this 28th day of September 1999.
