HomeMy WebLinkAboutReso 058-83 Karns VarianceRESOLUTION NO. 58 - 83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN GRANTING A VARIANCE TO SECTION 1711 OF THE BUILDING CODE AND CONFIRMING THE FINDINGS OF THE BUILDING OFFICIAL THAT COMPLIANCE WITH SECTION 2-812 TITLE 24 CALIFORNIA ADMINISTRATIVE CODE CREATES AN UNDUE HARDSHIP WHEREAS, Mr. & Mrs. Robert Karns, 6851 Langmuir Lane, Dublin, have requested a variance to Section 1711 of the Building Code in connection with conversion of the garage at the 6851 Langmuir Lane into a day care facility so as to waive the requirements of providing toilet facilities which are accessible to the handicapped; and WHEREAS, Section 2-812 of Title 24 California Administrative code also requires toilet facilities to be accessible to the handicapped except that the enforcing agency may find that compliance will create an unreasonable hardship; and WHEREAS, the Building Official of the City of Dublin has found that compliance with Section 2-812 of Title 24 California Administrative Code will create an unreasonable hardship; and WHEREAS, Section 2-105(b) 11 D requires that these findings must be confirmed by an appeals process. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby grants a variance to Mr. & Mrs. Robert Karns so as to waive the requirements of Section 1711 of the Building Code relative to making toilet facilities accessible to the handicapped. BE IT FURTHER RESOLVED that the City Council of the City of Dublin hereby confirms the findings of the Building Official that compliance with Section 2-812 Title 24 California Administrative Code would create an unreasonable hardship.
