DESCRIPTION: The City of Dublin contracts with the California Public Employees
Retirement (Ca1PERS) for retirement and health benefits for eligible City employees. Under the Public
Employees' Retirement Law a contracting agency is required to determine whether an employee of such
Agency in employment in which he/she is classified as a miscellaneous member is disabled for purposes
of the Public Employees' Retirement Law and whether such disability is "industrial" (work related) within
the meaning of such Law.
In addition, from time to time it maybe necessary for the City to make applications on behalf of a member
(employee) for disability retirement and/or to initiate requests for reinstatement of employees who are
retired for disability.
The adoption of this Resolution establishes that the City's Human Resources Director classification shall
be delegated the authority to make determinations of disability and industrial disability on behalf of the
City of Dublin. This position works directly with City employees when it becomes necessary to process a
work related injury, short and/or long term disability claims. As with all significant personnel matters,
disability retirement applications are reviewed jointly with the City Manager or his/her designee.
According to Ca1PERS, within most other California municipalities, this is the position designated with
the delegation of authority by the agency.
RECOMMENDATION: Staff recommends the City Council adopt the Resolution authorizing California
Public Employees Retirement System Delegation of Authority.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
AUTHORIZING CALIFORNIA PUBLIC EMPLOYEES RETIREMENT
SYSTEM DELEGATION OF AUTHORITY
WHEREAS, the City of Dublin (hereinafter referred to as Agency) is a contracting agency of the
California Public Employees' Retirement System (Ca1PERS); and
WHEREAS, the Public Employees' Retirement Law requires that a contracting Agency
determine whether an employee of such Agency in employment in which he/she is classified as a
miscellaneous member is disabled for purposes of the Public Employees' Retirement Law and whether
such disability is "industrial" within the meaning of such Law; and
WHEREAS, the City of Dublin has determined upon legal advice that it may delegate authority
under section 21173 of the Government Code to make such determinations to the incumbent of the
position of Human Resources Director.
NOW, THEREFORE, BE IT RESOLVED that the City of Dublin delegate and it does hereby
delegate to the incumbent of the position of Human Resources Director authority to make determinations
under section 21152(c), Government Code on behalf of the Agency, of disability and whether such
disability is industrial and to certify such determinations and all other necessary information to the Public
Employees' Retirement System; and
BE IT FURTHER RESOLVED that such incumbent be and he/she is authorized to make
applications on behalf of the Agency for disability retirement of all employees and to initiate requests for
reinstatement of such employees who are retired for disability.
