A regular meeting of the Dublin City Council was held on Tuesday, April 21, 2009, in the
Council Chambers of the Dublin Civic Center. The meeting was called to order at
7:02 p.m., by Vice Mayor Hildenbrand.

Police Commander Casey Nice introduced Dmarie Smith as the new Secretary to the

Certificate of Recognition -The Competition Team, Fallon Middle School

Vm. Hildenbrand introduced the Fallon Middle School Competition Team and coaches
and stated they had recently attended the USA Jr. Nationals competition at Disneyland.
The City Council wished to acknowledge the members' hard work with the presentation
of a Certificate of Recognition.
Coach Christine Cousins thanked the City Council for the certificate.
The City Council commented on the achievement of the members and the support of the
parents.

Recognition of Dublin Rotary Superstar Awards to City of Dublin Employees

John Zukoski, Dublin Rotary Club member, announced the winners of the Dublin Rotary
Superstars. from the City of Dublin Staff: Administrative Aide, Gaylene Burkett; Deputy
Fire Marshal, Darrell Jones; and Deputy Sheriff Floyd Gil.
The City Council thanked the Rotary Club for acknowledging the employees and their
efforts.

Approved (4.7 300-40) the Warrant Register in the amount of $899,841.55.
Mayor Sbranti pulled Item 4.4 (350-20), Request to Waive Competitive Bid Process and
Authorize Staff to Purchase Specialized Police Motorcycles Directly from Vendor and
asked about the relatively low mileage on the motorcycles. Was that the standard mileage
at which the City could get the best trade-in value? How many motorcycles were in the
Dublin Police force?
Police Commander Nice stated that 30, 000 miles was a lot of miles for a motorcycle that
primarily rode around town in stop and go traffic. Some of the motorcycles were five
years old. As the motorcycles got older, there were more expensive repairs needed. It
was also a safety issue. The City currently had four motorcycles..

Mayor Sbranti opened the public hearing.
City Attorney John Bakker presented the Staff Report and advised that the City Council
would consider revisions to the- Public Facilities Fee (PFF), Fire Facilities Fee (FFF), and.
the Downtown Traffic Improvement Fee (DTIF) to include Second Units as a separate
category of residential development, and to establish a fee for second units for each fee.
Vm. Hildenbrand asked if the Positano development second units had been considered
multi-family in terms of fees.
Mr. Bakker stated, to date, the Positano development second units had been charged the
single-family unit fee. They would have paid two such fees. In the future, they would be
charged the new multi-family fee.

Mayor Sbranti stated the multi-family fee was lower than the single-family fee.
No testimony was received by any member of the public relative to this issue.
Mayor Sbranti closed the public hearing.
Cm. Biddle asked if these fees were reviewed annually.
Mr. Bakker stated each of the fees had an automatic inflation adjustment in it. Each fee
also had an indication that the City should review, from time to time, the assumptions on
which the fees were based. Assumptions such as development and the cost of the
improvements the fees would fund were also reviewed to ensure the City was keeping up
or that the City was not generating more revenue than required. They were reviewed on a
three- to five-year basis.
Mayor Sbranti stated the City was reviewing its entire fee schedule and this was part of
that study.
On motion of Cm. Scholz, seconded by Vm. Hildenbrand, and by a unanimous vote, the

Status of Comprehensive Update to Dublin Municipal Code and Zoning Ordinance

City Attorney John Bakker presented the Staff Report and advised that at its March 22,
2006 Goals and Objectives meeting, the City Council approved with high priority, the
comprehensive update of the Dublin Municipal Code (DMC or Code). The purpose of
this report was to apprise the City Council of the current status of the update.
Mayor Sbranti stated that this was a potential cost saving measure. He supported the
recommendation of continuing with the items on Attachment 2 in the Staff Report and
suspending the review of items on Attachment 3.
Vm. Hildenbrand asked how long the City Attorney would recommend to hold off on the
review of the items on Attachment 3.
City Manager Pattillo stated as an issue arose related to the items on Attachment 3, City
Staff would review the related codes.
Cm. Hart asked about Chapter 5.20 Alarm Systems. To what did it pertain?
Mr. Bakker stated it pertained to someone with an alarm system, if it continually went off
and required a Police response, there was a fine.
Cm. Hart requested that Commander Nice review Chapter 5.20 -Alarm Systems to gauge
whether this was an appropriate time for review.

City Manager Pattillo stated she would work with Police Commander Nice on this item.
Cm. Hart asked that Chapter 2.28, Campaign Contributions, be reviewed prior to the next
election based on the economy. It should not be deferred.
Cm. Biddle asked if the "Hours to Complete" listed on Attachment 2 were Attorney hours
or Staff hours.
Mr. Bakker stated those were only attorney hours. The Attorney time did affect the City's
budget more than Staff time.
On motion of Vm. Hildenbrand, seconded by Cm. Scholz and by unanimous vote, the City
Council directed Staff to continue with the update process for the items listed on
Attachment 2 and defer the items on Attachment 3, with the exception of Chapter 2.28
Campaign Contributions be reviewed before the end of this calendar year; and the City
Manager and Police Commander Nice review Chapter 5.20, Alarm Systems.

NEW BUSINESS
Senior Center Webpage Conceptual Plan

Assistant Director of Parks and Community Services Paul McCreary presented the Staff
Report and advised that the City Council would receive a presentation on the plans to
update the Senior Center webpage on the City's website. The new webpage would be
utilized to expand electronic promotions of the programs at the Senior Center.
On motion of Cm. Scholz, seconded by Cm. Hart and by unanimous vote, the City
Council approved the conceptual webpage.

Proposed Community Development Block Grant Rating Criteria

Administrative Aide Gaylene Burkett presented the Staff Report and advised that the City
Council would consider a Community Development Block Grant (CDBG) Rating Criteria.
The City Council commented on the new rating sheet. It was simple and easy to
understand.
Cm. Hart asked why there was a difference in funds received among the Cities of Dublin,
Pleasanton and Livermore.
Ms. Burkett stated the Cities of Livermore and Pleasanton had populations over 50,000
and were entitlement cities that received more funds.
Mayor Sbranti stated the City had entered into a recent agreement with the County.
Ms. Burkett stated that was correct. The City had just entered into athree-year contract
with the County that included FY 2010-2011, which the City was expected to have a
population of around 49,000. In the Fiscal Year 2011-2012, it was possible the City
would hit the 50,000 population mark.
Vm. Hildenbrand stated the City did not have to wait for an official census to be
completed before applying for the extra funds of an entitlement city.
Ms. Burkett stated the census would be completed so the City would have that information
as back up. The funds were based on the population projections submitted to the State in
regarding to issuing permits.
City Manager Pattillo stated Staff would monitor the population figure before extending
the agreement with the County.
On motion of Cm. Biddle, seconded by Cm. Hart and by unanimous vote, the City Council
approved the CDBG Rating Sheet.

Residential Evening Inspection Program

Building Official Gregory Shreeve presented the Staff Report and advised that the City
Council would review the results of a Residential Evening Inspection Program.
On motion of Cm. Hart, seconded by Cm. Scholz and by unanimous vote, the City
Council directed Staff to continue to offer Tuesday evening inspections.
OTHER BUSINESS

7:59 p.m.
City Manager Pattillo presented a slide show on the Kolb properties' move from
Pleasanton to Dublin which took place on April 17, 2009 and would continue on Apri124,
2009. She also recognized the involvement of various agencies to make the move a
success. The City of Dublin held its Family Sports Fest on April 19, 2009. The Dublin
Swim Center also offered a free swim day. Next Wednesday, April 29, 2009 there would
be a Solar Cities Workshop in Dublin for local residents that wanted to learn more about
solar products. The event would start at 7:00 p.m. in the Regional Meeting Room.
Cm. Biddle stated this coming Saturday would be the start of Dublin Pride Week and there
would also be a Water Wise Gardening Session at the Dublin Library on April 28, 2009.
Vm. Hildenbrand stated in regard to the Kolb properties, the Kolb family had donated the
homes to the City of Dublin. The land where the buildings were situated was once a part
of Dublin before being cut off by the building of the 580 freeway. The properties were
returning to Dublin.
Cm. Hart stated he had missed the last City Council meeting due to attending training.

Cm. Scholz stated she had attended the Rotary lunch and the Alameda. County
Transportation Improvement Authority (ACTIA) meeting.
Mayor Sbranti stated he had attended the Alameda County Mayors Conference and one of
the presentations was cities coming together for stimulus dollars; he attended an interfaith
Good Friday prayer breakfast. He had attended a fund raiser for the Muslim Community
Center; he went to the Dublin San Ramon Services District Treatment Plant regarding
receipt of federal dollars to have recycled water. serve central areas of Dublin. He also
toured the AXIS Community Health facility which would be increasing its service to
Dublin residents; spoke at a Tri-Valley Realtors Networking event; attended the Tri-
Valley Convention and Visitors Bureau conference on social media and public relations;
attended the Rotary Lunch, and toured Pan Digital of Dublin.
