ZONING HISTORY:
On December 3, 1969, the Alameda County Planning Department approved
Tentative Map #3135 and Site Development Review, S-293, for the Dublin
Plaza. The shopping center has nine lots, each of which has its own
owner. Common rights of access are provided for each parcel to allow
cars to drive across parcel lines and share parking spaces.

In January, 1971, the Board of Supervisors also granted Building Code
variances to the developers of the center to allow 1)buildings to be
closer to the property lines than was allowed by the Building Code; 2)
that these buildings could have openings in them (for doors and windows)
that were closer to the property lines than allowed; and, 3) that
covered walkways could connect the buildings, where the Building Code
required fire separations which would not have allowed connected
walkways.
On March 28, 1983, the Dublin City Council granted approval of the same
Building Code variances mentioned above as well as a 105 space Parking
Variance (PA 82-013).
On February 18, 1986, the Dublin Panning Director approved an
Administrative Conditional Use Permit allowing a Boy Scout Troop to
locate a newspaper collection bin :_n the parking lot area of Dublin
Plaza Shopping Center near Albertson's, (this permit has expired and the
Applicant is currently in the process of completing an application
submittal to consider continuation of this operation).
One June 27, 1988, the Dublin City Council approved a Site Development
Review request for a 6,300+ square foot building addition.
APPLICABLE REGULATIONS:
Section 8-61.0 of the Zoning Ordinance as amended by Ordinance 81-81
requires that a Conditional Use Permit be obtained that a Conditional Use
Permit be obtained from the Planning Commission for the operation of recycling
centers which would collect, sort and temporarily store glass, metals and
other reusable materials. (It does not allow for processing activities to
occur).
Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need; 2)
whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or not the
use will materially affect the health or safety of persons residing or working
in the vicinity; and 4) whether or not the use will be contrary to the
specific intent clauses or peformance standards established for the district
in which it is located.
Section 8-94.4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the
acceptance and observance of specified conditions, including but not limited
to the following matters:
a) substantial conformity to approved plans and drawings;
b) limitations on time of day for the conduct of specified activities;
c) time period within which the approval shall be exercised and the proposed
use brought into existence, failing which, the approval shall lapse and be
void;
d) guarantees as to compliance with the terms of the approval, including the
posting of bond;
e) compliance with requirements of other departments of the City/County
Government.
ENVIRONMENTAL REVIEW: Categorically exempt Section 15303 Class 3(e) and
Section 15'_11 Class 11. Installation of new
accessory structures and placement of minor
structures accessory to existing commercial
facilities.
NOTIFICATION: Public Notice of the September 6, 1988, hearing was
published in The Herald, mailed to adjacent property owners, and posted
in public buildings.
ANALYSIS:
State Assembly Bill 2020, the California Beverage Container Recycling
and Litter Reduction Act, was signed into law in the Fall of 1986. The
California State Department of Conservation is responsible for the
administration of the recycling program.
The law requires supermarkets having two million dollars or more in
sales per year to provide outlets for consumers to redeem approved recyclable
materials. These redemption outlets must be located within a 1/2 mile radius
of the supermarket having such sales. The establishment of a small collection
facility, such as the proposed 20/20 operation, in one accepted method that
can be used to satisfy Assembly Bill 2020. Reverse vending machines are
another acceptable method. The supermarket may also purchase back the
containers if a collection facility or reverse vending machine is not used.
The City Zoning Ordinance complies with Assembly Bill 2020 by
establishing a provision allowing consiceration of recycling centers as
conditional uses in any zoning district.
The Applicant is requesting approval of a Conditional Use Permit to
operate a Recycle Collection Center at the Dublin Plaza Shopping Center
parking lot near Albertson's. The Applicant's request complies with the City
adopted ordinance relating to recycling centers.
The request is to comply with State Bill 2020 and the use is not
anticipated to create any special problems for the existing commercial tenants
at the shopping center.
The use will consist of up to five Igloos and one kiosk. The igloos and
kiosk have been located at this site since June, 1988. The proposed operation
would occupy approximately two-three parking spaces. The structures consist
of one grey with blue trim kiosk for the operator and four igloos of red,
green, blue and white. A fifth yellow :_gloo may be added in the future to
accommodate newspaper recycling.
Staff has reviewed the Applicant's proposed location and feels that an
alternative location adjacent to the la:ge shopping center sign would provide
for better screening, parking and traff`_c circulation.
The State law does allow local go-rernment agencies the discretion to
regulate the appearance, including land:;caping and signing of recycling
facilities and equipment.
Staff has obtained information from other cities as to what their
architectural/screening requirements ha-ie been. Some cities have required
solid :screened areas, others regulate the exterior color of the containers.
Staff believes that with placemen: next to landscape planters and added
trees placed in these areas the desired level of screening could occur with
minimal inconvenience and initial cost :o the Applicant.
":he Applicant's proposal has been reviewed by the applicable public
agencies and conditions of approval have been included in the Resolution of
Approval.
RECOMMENDATION:
FORMAT: 1) Open public hearing and hear Staff presentation.
2) Take testimony from Applicant and the public.
3) Question Staff, Applicant and the public.
4) Close public hearing and deliberate.
5) Adopt Resolution approving PA 88-080 Conditional Use Permit,
or give Staff and Applicant direction and continue the
matter.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 88-080 20/20 RECYCLE CENTERS CONDITIONAL USE PERMIT
TO OPERATE A REDEMPTION CENTER IN THE PARKING LOT AREA OF THE
DUBLIN PLAZA SHOPPING CENTER NEAR ALBERTSONS
WHEREAS, Barbara Saperia, representing 20/20 Recycle Centers filed
an application for a Conditional Use Permit to allow the operation of a
recycling redemption center at the parking lot of the Dublin Plaza Shopping
Center near Albertsons, 7333 Regional Street; and
WHEREAS, the adopted City of Dublin Zoning Ordinance, as amended,
provides for the operation of recycling centers, through the Conditional Use
Permit process; and
WHEREAS, the Planning Commission held a public hearing on said
application on September 19, 1988; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, this application has been reviewed in accordance with the
provisions of the California Environmental Quality Act and has been found to
be categorically exempt; and
WHEREAS, the Staff Report wz.s submitted recommending that the
Conditional Use Permit application be approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony herein above setforth; and
WHEREAS, the proposed land use, if conditionally approved, is
appropriate for the subject property in terms of being compatible to existing
land uses in the area and will not adersely affect public services;
NOW, THEREFORE, BE IT RESOLVED THAT THE Planning Commission finds:
a) Use of the supermarket store park:_ng lot areas of this portion of the
Dublin Plaza Shopping Center serves the public need by providing
recycling collection/redemption canter for the community.
b) The use, as conditioned by this Resolution, will be properly related to
other land uses, and transportation and service facilities in the
vicinity, and will not be in conf'.ict with existing commercial uses in
the Dublin Plaza Shopping Center;
C) The use will not materially adver:tely affect the health or safety of
persons residing or working in the vicinity, or be materially detri-
mental to the public welfare or injurious to property or improvements in
the neighborhood, as all applicable regulations will be met;
d) The use will not be contrary to the specific intent clauses or
performance standards established for the zoning district in which it is
to be located, as the proposed use will be compatible with adjoining
retail uses and will serve to promote additional vehicular and
pedestrian traffic through the Dublin Plaza Shopping Center;
e) The approval of the Conditional U.>e Permit is consistent with the Dublin
General Plan;
BE IT FURTHER RESOLVED THAT THE Planning Commission does hereby
conditionally approve said application 3s shown by materials labeled Exhibit B
and stamped approved on file with the Dublin Planning Department, subject to
the following conditions:

CONDITIONS OF APPROVAL
All Conditions of Approval shall be comp Lied with prior to the issuance of a
building permit or establishment of prop)sed land use activity and shall be
subject to Planning Department approval.
1. This approval is for glass, aluninwn, plastic beverages and newspaper
recycling containers which will be located in the parking lot of the
shopping center at 7333 Regional Street and depicted on the site plan
labeled Staff Alternative, (Attachment 2).
2. The maximum number of parking spaces to be used for the recycling center
shall be limited to three.
3. The Applicant shall obtain an annual Recycling Permit and Recycling
Transporter Permit for each site as required by Resolution 26-86
(Attachment 6).
Additional 24" box evergreen screening trees and five gallon shrubs shall
be provided in the existing landscape planter adjacent to the recycling
containers. Details to be worked out with Staff.
5. All recyclable materials shall be stored inside the containers.
Containers shall be of weatherproof and fire retardant design and
materials.
6. The Applicant/Operator (possibly in conjunction with the Property Owner)
shall submit a maintenance plan and program to carry out that plan to
ensure that at a minimum, the sites litter is picked up on a daily basis
and the landscape screening is maintained.
7. The Applicant shall take all necessary precautions to ensure litter and
materials are controlled and that the bins are maintained in an
attractive and functionally operative manner.
8. The Applicant shall control activity so as not to create a nuisance to
the existing businesses or shoppers.
9. A solid, enclosed receptacle shall to provided for the receipt of
recyclable materials when igloos are unattended or locked. Details to be
worked out with Staff.
10. Each site shall be allowed directional and identification signs. Signs
shall not exceed eight (8) square feet and shall not contain advertising
messages.
11. A minimum of one 40 gallon all-weather trash receptacle shall be provided
in each collection area.
12. Containers shall be clearly marked to identify the type of material to be
deposited and a notice will be displayed stating that no material shall
be left outside the recycling containers.
13. Kiosk shall have a notice identify'_ng the name and telephone number of
the facility operator and the hours of operation.
14. The supermarket which contracts fo,- the placement, construction and
operation of the recycling facility shall be responsible for ensuring
that the premises surrounding such facility are maintained free of
litter, recyclable materials, and other debris.
15. The supermarket for which the recycling facility is located shall post,
in a convenient, visible location within the supermarket, entrances and
exits, the location of the recycling facility.
16. The Applicant shall submit evidence to the Planning Director that
appropriate state licenses, permit.; or certificates have been obtained.
17. The Applicant has 60 days in which to bring the site into conformance
with these project conditions.

18. This permit shall be valid for one :gear expiring on September 28, 1989.
The approval shall be reviewed by t:ie Planning Commission to evaluate the
overall conditions of operation, including adequacy of the method of
screening.

q 19. This permit shall be revocable for cause in accordance with Section 8-
90.3 of the Dublin Zoning Ordinance.

THE CENTER. Our centers are Small Collection Facilities
as outlined in the Model Zoning Ordinance prepared by the
Division of Recycling.
- Our centers are approximately 300 square feet,
typically two (2) parking spaces.
- Each center will have five (5) "igloo" storage
containers and one (1) panned kiosk. Each
igloo will be approximately 3.0 - 4.0 cubic
yards; two (2) 8" x 16" holes, and is 516"
in height.
- A staff person will be on site 30 hours a week
to purchase materials. The containers will
remain on site for donation of materials on a
voluntary basis.
- Over 50,000 of these igloo units are deployed
throughout Europe, and have become the
standard for collecting, storing, and trans-
porting recyclable materials.
- Colors of each igloo will be standardized and
have graphics to identify each type of
material redeemed. Blu = aluminum; Green =
mixed glass; White = c1=ar glass; Red =
plastic; and Yellow = paper (future option).
The colors are reflective of many auto
manufacturers' vehicle colors.

A typical complete site will consist of four igloos made of
fibreglass materials (clear glass, colored glass, aluminum,
plastic), and a kiosk (in which our site attendant conducts
business). We hope to have a fifth igloo for recycling
newspaper sometime in the near future.
We have one Site Operator per location who works Wednesday,
Thursday, Friday, and Sunday, 11:00 to 5:00, and Saturday
from 8:30 to 5:00. The attencant is responsible for issuing
Scrip, which is redeemable at the Market for either cash or
toward grocery purchases. The attendant is also responsible
for keeping the igloos and surrounding areas clean. If ther
is excessive debris or overflew, it is their respcnsibility
to contact the Regional office and see that it is picked up.
We have a Crew Chief who is responsible for 10 to 15 Stores
and visits each site every day to make sure that everything
is being handled properly.
The igloos are emptied once a week ( or more often if
needed). A 40 ft. truck with .3 crane pulls into a space next
to the igloos. The driver stabilize the truck and unfolds
the crane. He attaches a hoof at the end of the crane onto
the center eye of the igloo, which pulls on a tensioning
device that keeps the door closed. The igloo is lifted off
of the lot up over the truck onto one of three compartments
(depending on material type). The compartment door opens and
the materials fall into the truck. The door closes and the
igloo is returned to its proper spot. The driver then cleans
anv debris that may have spilt during the emptying process.
SIGNACE
Signage consists of one -2' x 4' metal sign. It is generally
attached to an already existing nearby light standard, or it
can be fixed atop a 3" diameter pole, which with the sign
will be 12' in height. p

AMENDING RESOLUTION NO. 96-84
TO ESTABLISH PERMIT FEES FOR THE OPERATION OF
A RECYCLING FACILITY AND -RECYCLING TRANSPORTERS
WHEREAS, the City of Dublin will assume the role of
Franchisor for solid waste collection effective April 1, 1986; and
WHEREAS, the City Council adopted a Solid Waste
Management Ordinance to accomplish its role in the provision of
adequate solid waste collection anr' removal; and
WHEREAS, the Ordinance will impose permit requirements
for recycling facilities and recycling transporters; and
WHEREAS, the establishment of additional permit fee will
require an amendment to Resolution No. 96-84.
NOW, THEREFORE, BE IT RE_OLVED that the City Council of
the City of Dublin does hereby amerd Resolution No. 96-84 to
include the followin; charges:
A. Recycling Facility Permit $25.00
B. Recycling Transporter Permit $50.00
BE IT FURTHER RESOLVED, that the City Council of the
City of Dublin shall apply the pror,isions of Resolution No. 120-84
related to the waiver of payment of fees and charges to the above
fees. The Fee Waiver policy contained within said resolution
small be amended to include Recycling FacLlity and Transporter
permits.
