HomeMy WebLinkAboutPC Reso 88-054 20/20 Recycle Ctr PA88-080RESOLUTION NO. 88 - 054 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN ------------------------------------------------------------------------------ t APPROVING PA 88-080 20/20 RECYCLE CENTERS CONDITIONAL USE PERMIT TO OPERATE A REDEMPTION CENTER IN THE PARKING LOT AREA OF THE DUBLIN PLAZA SHOPPING CENTER NEAR ALBERTSONS WHEREAS, Barbara Saperia, reyresenting 20/20 Recycle Centers filed an application for a Conditional Use Pern.it to allow the operation of a recycling redemption center at the parkir.g lot of the Dublin Plaza Shopping Center near Albertsons, 7333 Regional Street; and WHEREAS, the adopted City of Dublin Zoning Ordinance, as amended, provides for the operation of recycling centers, through the Conditional Use Permit process; and WHEREAS, the Planning Commis:.ion held a public hearing on said application on September 19, 1988; and WHEREAS, proper notice of sai.d public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, the Staff Report was submitted recommending that the Conditional Use Permit application be approved; and i WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony horein above setforth; and WHEREAS, the proposed land use, if conditionally approved, is appropriate for the subject property in 1.erms of being compatible to existing land uses in the area and will not adersely affect public services; NOW, THEREFORE, BE IT RESOLVED THAT THE Planning Commission finds: a) Use of the supermarket store parking lot areas of this portion of the Dublin Plaza Shopping Center server the public need by providing recycling collection/redemption ce?iter for the community. b) The use, as conditioned by this Re3olution, will be properly related to other land uses, and transportatiol and service facilities in the vicinity, and will not be in conflict with existing commercial uses in the Dublin Plaza Shopping Center; c) The use will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detri- mental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met; d) The use will not be contrary to the specific intent clauses or performance standards established for the zoning district in which it is to be located, as the proposed use will be compatible with adjoining retail uses and will serve to promote additional vehicular and pedestrian traffic through the Dublin Plaza Shopping Center; e) The approval of the Conditional Use Permit is consistent with the Dublin General Plan; BE IT FURTHER RESOLVED THAT THE Planning Commission does hereby conditionally approve said application as shown by materials labeled Exhibit B and stamped approved on file with the Dublin Planning Department, subject to the following conditions: -1- CONDITIONS OF APPROVAL All Conditions of Approval shall be compl?.ed with prior to the issuance of a building permit or establishment of propo<:ed land use activity and shall be subject to Planning Department approval. 1. This approval is for glass, aluninum plastic beverages and newspaper recycling containers which will be located in the parking lot of the shopping center at 7333 Regional Street and depicted on the site plan labeled Staff Alternative, (Attachment 2). 2. The maximum number of parking spaces to be used for the recycling center shaLl be limited to three. 3. The Applicant shall obtain an annual Recycling Permit and Recycling Transporter Permit for each site as required by Resolution 26-86 (Attachment 6). 4. All recyclable materials shall be stared inside the containers. Containers shall be of weatherproof and fire retardant design and materials. 5. The Applicant/Operator (possibly in conjunction with the Property Owner) shall submit a maintenance plan and program to carry out that plan to ensure that at a minimum, the sites litter is picked up on a daily basis and the existing landscaping is maintained. 6. The Applicant shall take all necessary precautions to ensure litter and materials are controlled and that the bins are maintained in an attractive and functionally operative manner. 7. The Applicant shall control activity so as not to create a nuisance to the existing businesses or shoppers. 8. A solid, enclosed receptacle shall be provided for the receipt of recyclable materials when igloos are unattended or locked. Details to be worked out with Staff. 9. Each site shall be allowed directionE.l and identification signs. Signs shall not exceed eight (8) square feet and shall not contain advertising messages. 10. A minimum of one 40 gallon all-weather trash receptacle shall be provided in each collection area. 11. Containers shall be clearly marked to identify the type of material to be deposited and a notice will be displayed stating that no material shall be left outside the recycling containers. 12. Kiosk shall have a notice identifying the name and telephone number of the facility operator and the hours of operation. 13. The supermarket which contracts for the placement, construction and operation of the recycling facility shall be responsible for ensuring that the premises surrounding such ::acility are maintained free of litter, recyclable materials, and o:her debris. 14. The supermarket for which the recycling facility is located shall post, in a convenient, visible location within the supermarket, entrances and exits, the location of the recyclin; facility. 15. The Applicant shall submit evidence to the Planning Director that appropriate state licenses, permits or certificates have been obtained. 16. The Applicant has 60 days in which to bring the site into conformance with these project conditions. 17. This permit shall be valid for one year expiring on September 28, 1989. The approval shall be reviewed by the Planning Commission to evaluate the overall conditions of operation, including adequacy of the method of screening. -2- 18.E This permit shall be revocable for cause in accordance with Section 8- 90.3 of the Dublin Zoning Ordinance. PASSED, APPROVED AND ADOPTED this 19th day of September, 1988.
