Approve Budget Change in the amount of $169,690 from Unallocated General Fund Reserves FINANCIAL STATEMENT: Budgeted for Improvements Pool Architect's Estimate Low Bid Low Bid, plus 10% Contingency $ 362,710 427,236 484,000 532,400 To complete this phase of the Dublin Pool Renovations, a budget appropriation is necessary in the amount of $169,690 from Unallocated General Fund Reserves. This amount is substantially over the funds budgeted; however, Staff believes that since there were 3 bids received, this is a competitive bid, and no money could be saved by rebidding the project. DESCRIPTION: At the City Council meeting of November 17, 1998, City Council authorized Staff to solicit bids for Contract 98-16, Dublin Pool Renovation. The renovation project is included in the Fiscal Year 1998-99 Budget. The City has received a Measure D Grant to pumhase and install picnic tables, benches and trash receptacles made from recycled products, and the balance of the project will be financed from the General Fund. This portion of the Dublin Pool Renovations will replace the existing pool deck and increase the deck size by approximately 6,000 square feet to accommodate a group picnic area, bleacher seating, and storage for the pool cover and lane line reels. In addition, the wading pool will be separated from the main pool and have its own filter and sanitation system, as well as be physically separated by a wider walkway. The original scope of work for the project was expanded to remove the fiberglass pool shell in the main pool, COPIES TO: Bidders ITEM NO. g:~niscproj~poolfleck~agstawrd install new plaster and ceramic tile, and install necessary piping and infrastructure for a slide. Future . work will include replacement of the pool heater and the installation of a pool slide. A total of three (3) bids were received with the low bid being submitted by South Coast Pool Plastering, Inc., in the amount of $484,000. These bids were as follows: 1) 2) 3) South Coast Pool Plastering Vanguard Construction Sposeto Engineering $484,000 $535,400 $588,000 Following the bid opening, a letter of protest was received from Sposeto Engineering (Attachment 3). Staff has investigated the allegations in the letter, specifically that South Coast Pool Plastering is not qualified or properly licensed, and found that the allegations are unfounded. South Coast Pool Plastering possesses the appropriate licensing for the job, intends to perlorm the work without the use of subcontractors, and has perlormed satisfactorily on similar jobs for other jurisdictions. Although the low bid is substantially over the funds budgeted, Staff does not believe that money could be saved by rebidding the project. The alternative would be to modify the scope of the project by reducing the size of the deck and eliminating the seat wall. This would entail that the plans be revised and the project be rebid and would result in the project being deferred until fall, 1999. Even with this modification, Staff does not believe that substantial cost savings would be achieved. It should be noted that Staff is finding that capital construction projects are consistently coming in over . the estimates prepared by engineers/architects. Staff would attribute this to the current bidding climate that has resulted in a significant escalation in construction costs. Consequently, Staff recommends that the City Council adopt the resolution awarding Contract 98-16 to South Coast Pool Plastering, Inc., and approve the Budget Change Form in the amount of $169,690 to complete the work in this phase of the Dublin Pool Renovation. . Page 2 RESOLUTION NO. -99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN REVISED RESOLUTION (ITEM NO. 7.2) ********************** A WARDING CONTRACT 98-16 DUBLIN POOL RENOVATION TO SOUTH COAST POOL PLASTERING, INC. AND TAKING FORMAL ACTION ON PROTEST RECEIVED WHEREAS, the City of Dublin did, on January 12,1999, publicly open, examine, and declare all sealed bids for doing the work described in the approved Plans, Specifications, and Modifi- cations for Contract 98-16, Dublin Pool Renovation, authorized by the City Council on November 17, 1998, which Plans, Specifications, and Modifications are hereby expressly referred to for a description of said work and for all particulars relative to the proceedings under the request for bids; and WHEREAS, said bids were submitted to the City Engineer, who has recommended that the bid hereinafter mentioned is the lowest and best bid for doing said work; and WHEREAS, in a letter dated January 14, 1999, the firm of Sposeto Engineering, Inc. has protested the bid submitted by South Coast Pool Plastering, Inc. on the basis that they are not properly licensed to perlorm the scope of work within the project and that they did not list any subcontractors for the work; and WHEREAS, representatives from the California State Contractors Licensing Board have confirmed with Staff that South Coast Pool Plastering, Inc. does have a current and valid license and that the license does allow them to perlorm the scope of work within the project; and WHEREAS, representatives from South Coast Pool Plastering, Inc. have confirmed with Staff that they intend to perform the scope of work without the use of subcontractors and Staff has further determined that South Coast Pool Plastering, Inc. has performed satisfactorily on similar jobs; and WHEREAS, Sposeto Engineering, Inc. has also protested the bid submitted by Vanguard Construction on the basis that proper subcontractors are not listed and that they are not qualified to perform the work; and WHEREAS, since the bid submitted by Vanguard Construction was not the lowest responsible bidder, the allegations were not investigated further. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby award City of Dublin Contract 98-16 to the lowest responsible bidder therefor, to wit South Coast Pool Plastering, Inc., with a bid of Four Hundred Eighty-Four Thousand Dollars and No Cents ($484,000.00), the particulars of which bid are on file in the Office of the City Engineer. BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby reject the protest of Sposeto Engineering, Inc. dated January 14, 1999.
