Resolution Amending the Salary Plan RECOMM ENDATIO2/~ ~Adopt Resolutions FINANCIAL STATE : Funding has been included in the Fiscal Year 2002-2003 budget to cover the costs associated with the proposed new classification and respective salary range value. DESCRIPTION: The City's personnel system is governed by several documents. Each document addresses a specific set of issues. The Staff report identifies proposed changes to the City's current personnel system. As discussed below, these proposed adjustments are based on the need to add a new job classification to the City's Classification Plan. CLASSIFICATION PLAN AMENDMENT Pursuant to the City's Personnel System Rules, a job description must be adopted for each classification in the organization. The job description typically includes key elements, knowledge, skills, abilities and requirements of the position. The job descriptions make up the City's Classification Plan. The City's Community Development Director and Planning Manager recommended to the City Manager that the City create the new position of Code Enforcement Officer. This position was proposed due to the need to place more emphasis on code enforcement/neighborhood preservation activities in the City. The new Code Enforcement Officer position would replace one of two positions currently vacant and budgeted as an Assistant Planner/Code Enforcement Officer. This new position would be dedicated to code enforcement activities and the existing Assistant Planner would provide back-up support to the new position. Further justification for this request came as a result of a recent recruitment for the Assistant Planner/Code Enforcement Officer position that was unsuccessful. The recruitment analysis showed that it is more difficult to recruit qualified candidates for a combination position. Staff's research found that entry-level planning applicants were more interested in starting their planning career and less interested in a career in code enforcement. The City Manager concurred with the Department's recommendations and requested that the Personnel Office work with the Planning Manager to develop the new classification pursuant to the scope of duties. Attached to the Resolution (Attachment 1) is Exhibit A, which is the job description for Code Enforcement Officer. COPIES TO: ITEM NO. Staffrecommends that the City Council adopt the attached Resolution amending the Classification Plan. SALARY PLAN AMENDMENT Included in the City's Personnel System are Resolutions that address salary ranges for part-time and full- time personnel. The attached Resolution is a proposed amendment to the City Salary Plan (Attachment 2) for full-time personnel. Once the Code Enforcement Officer job description was developed, the City's Personnel Officer took the positions to market for development of the appropriate salary range and alignment within the City's existing Salary Plan. The resolution also identifies positions that are exempt from the Federal Labor Standards Act (FLSA) overtime provision and those that are not. The Salary Plan Resolution (Attachment 2) would establish the following monthly salary ranges for the new position: Code Enforcement Officer - $3,906 - $4,883 Staff recommends that the City Council adopt the attached Resolution amending the Salary Plan. Upon adoption by the City Council, Staff will begin the recruitment and selection process to fill the classification vacancy. It is estimated that the above recruitment will take between three and four months to successfully complete. Staff recommends that the City Council review the proposed modifications to the City's Classification, Salary, and Benefit Plans and adopt the Resolutions. RESOLUTION NO. XX- 02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AMENDING THE CLASSIFICATION PLAN WHEREAS, in accordance with the City's Personnel System Rules, the City Council adopted Resolution No. 30-84 and subsequent resolutions which comprise the Classification Plan; and WHEREAS, it is necessary to periodically add job descriptions to the Classification Plan. NOW, THEREFORE, BE IT RESOLVED that Resolution No. 30-84 and subsequent resolutions shall be further amended to include a j ob description for the position of Code Enforcement Officer BE IT FURTHER RESOLVED that this document shall become a part of the official Classification Plan for the City of Dublin; m~d that the changes contained herein shall be effective October 15, 2002. AYES: NOES: ABSENT: ABSTAIN: Mayor ATTEST: City Clerk ATTACHMENT I Date Adopted: 10-15-2002 Date Revised: Title: Code Enforcement Officer FLSA: Non-Exempt SALARY: General Purpose: Under general direction of the Planrfing Manager, seeks compliance with sections of the Municipal Code, ordinances and resolutions in such areas as planning, zoning, community nuisance, property maintenance, housing, signs and related areas, and performs related work as required. Distinguishing Characteristics: Responsible for investigating, analyzing, and resolving issues related to permit or licensing functions mandated by the City of Dublin Municipal Code. The incumbent i.s a civilian employee empowered to issue notices of violation and seek resolutions of problems through administrative processes. Essential Duties and Responsibilities: The following duties are normal for this classification. The omission of specific statements of duties does not exclude them from the position if the work is similar, related or a logical assignment to this class. Receive and respond to complaints from the public and Staff regarding substandard dwellings or structures, zoning violations, debris, unsanitary conditions, abandoned or inoperative vehicles, overgrown vegetation, and other zoning and municipal code violations. Initiate investigations as necessary for observed violations; prepare necessary notices and citations that outline proper repair and correction methods, time limits, permits and all necessary remedial work required. Prepare investigative reports and collect evidence for civil property abatements, civil litigation and criminal prosecution; prepare legal documents, including abatement and inspection warrants, correspondence and post legal documents. Exhibit A Contact property owners and schedules and conduct on-site inspections; interpret codes and regulations and explains inspections; interpret codes and regulations and explain inspection procedures to involved parties. Monitor compliance activities and conduct follow-up inspections. Act as liaison with the City Attorney's office and the courts regarding property abatements; file property tax assessment liens; and coordinate assigned work with related activities by other City departments, governmental agencies and organizations. Collect and safeguard evidence of violations to be presented in court; testify in court a required. As directed, serves as liaison and provides staff assistance to various citizen and community interest groups; may make presentations to the City Council, Planning Commission and community groups; and develop and present community outreach programs. Maintain files and records and prepare reports. Establish positive working relationships with representatives of community organizations, state/local agencies and associations, City management and Staff, and the public. Perform related work as necessary. Minimum Qualifications: Knowledge of: Principles, practices and trends of City Planning. Principles, practices and techniques of code violation investigation and enforcement. Applicable City and State regulations and policies related to code enforcement. Effective public contact techniques in person, on the telephone and through written communication. Investigative techniques useful in inspecting residential, business, health, safety and welfare activities to ensure compliance with applicable codes and ordinances. Negotiation and conflict resolution techniques. Research, record keeping and report writing techniques. Municipal code enforcement methods and procedures. Customer service techniques. Exhibit A Federal, state and local laws, regulations and court decisions applicable to assigned areas of responsibility. Ability To: Enforce policies, procedures, codes and regulations pertaining to code enforcement activities. Interpret, apply and clearly explain codes, policies and regulations to the general public. Communicate clearly and concisely orally and in writing. Work independently, correctly prioritize cases and exercise sound judgment. iRead and interpret laws, codes, ordinances and policies. Work indoors or outdoors in a variety of climatic conditions. Maintain manual and electronic records accurately and in a timely manner. Deal effectively and tactfully with property owners and managers, tenants, contractors, City Staff and the general public. Operate word processing, e-mail and digital photographic equipment. Work and attend occasional night and weekend meetings and conferences. Physical Standards: The physical standards described are representative of those that must be met by employees to successfully perform the essential functions of this class. Experience: Two years responsible experience in public contact work involving inspection, investigation, interpretation and application of codes, code enforcement or related activities. Licenses; Certificates; Special Requirements: Possession of a valid California Class C drivers' license and Certificate of Automobile Insurance for Personal Liability. Completion of PC-832 course training desirable or the ability to obtain such training within first 12 months of employment. XX- 02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AMENDING THE SALARY PLAN WHEREAS, in accordance with the City's Personnel System Rules, the City Council adopted Resolution No. 64-97 and subsequent resolutions which comprise the Salary Plan. NOW, THEREFORE, BE IT RESOLVED that the position of Code Enforcement Officer shall be covered under Article I, Section B of the Salary Plan; and BE IT FURTHER RESOLVED that the position Code Enforcement Officer shall be paid a monthly salary within the following range with the exclusion of any Performance Pay Adjustment granted in accordance with the adopted Personnel Rules: Code Enforcement Officer: $3,906 - $4,883 BE IT FURTHER RESOLVED that this document shall become a part of the official Salary Plan for the City of Dublin; and that the changes contained herein shall be effective October 15, 2002.
