RECOMMENDATION: Accept the improvements under Contract No. 09-05, San Ramon
Road Trail Improvements -Asphalt Path Repair and Sealing, and
authorize the release of retention after 35 days if there are no
subcontractor claims.
FINANCIAL STATEMENT: The contract with Union City Construction, which was awarded by
the City Council on May 19, 2009, including a 10% contingency was
a total of $28,730.41. Adequate funds have been budgeted based on
the final project expenditures.

DESCRIPTION: The San Ramon Road Trail Improvements Project was approved as
part of the Five-Year Capital Improvement Program (CIP) for Fiscal Year 2008-2009. The project
proposed to repair and construct improvements to the bicycle/pedestrian path along the west side of San
Ramon Road from Alcosta Boulevard to Silvergate Drive.
Construction was undertaken in two phases. The first phase cut the roots from trees that had damaged the
asphalt path and installed vertical root barriers to protect the path in the future. This second phase
repaired the damaged asphalt within the path, and placed a seal coat over the entire path.
Ten percent of project invoices is held back as retention throughout the length of the project to insure
completion of the project and retain funds against potential subcontractor claims, should they arise. Upon
the City Council's acceptance of project improvements, the retained amount is paid to the contractor after
35 days if there are no subcontractor claims.
RECOMMENDATION: Staff recommends that the City Council accept the improvements
under Contract No. 09-05, San Ramon Road Trail Improvements -Asphalt Path Repair and Sealing, and
authorize the release of retention after 35 days if there are no subcontractor claims.
