Rojo, Assistant Planner ATTACHMENTS: ~~~RECOMMENDATION: L PROJECT DESCRIPTION: 1) Withdrawal Letter from Mike Feeney, Applicant, dated May 20, 2009. 1) Receive the Staff Report and withdraw the item from consideration. At the May 12, 2009 Planning Commission Meeting, a request was made for a Conditional Use Permit for a parking reduction and off-site parking for a proposed health club _'acility at 6705 Amador Plaza Road. The Planning Commission continued the item to a date certain on July 14, 2009, and directed Staff to work with the Applicant to explore potential alternatives to address parking related issues for the proposed gym. On May 20, 2009, the Applicant withdrew the application for a Conditional Use Permit for a parking reduction and off-site parking for the health club facilit;- (Attachment 1). NOTICING: In accordance with State law, a Public Notice regarding this Project was mailed to all property owners and occupants within 300 feet of the Project site for the May 12, 2009 Planning Commission Meeting. The Public Notice was also published in the Valley Times and posted at several locations throughout the City. At the May 12, 2009 Planning Commission meeting, the Planning Commission continued the item to a date certain on July t4, 2009. Therefore, a Public Notice is not reglired for the July 14, 2009 Planning Commission meeting. ENVIRONMENTAL REVIEW: Pursuant to Article 18, Statutory Exemptions, Section 15270 of the California Environmental Quality Act (CEQA) Guidelines, CEQA does not. apply to projects in which a public agency rejects or disapproves. RECOMMENDATION: Staff recommends that the Planning, Commission receive the Staff Report and withdraw the item from consideration.
