HomeMy WebLinkAboutReso 181-02 DBW DSRSD RecyWater RESOLUTION NO. 181 - 02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN EXECUTION OF DEED TO DUBLIN SAN RAMON SERVICES DISTRICT CONVEYING TITLE TO RECYCLED WATER PIPELINE, AND APPURTENANCES THERETO INSTALLED AS PART OF THE "DUBLIN BOULEVARD WIDENING DOUGHERTY ROAD TO SCARLETT DRIVE" PROJECT PURSUANT TO THE PARTIES' COOPERATIVE AGREEMENT WHEREAS, on February 6, 2001, the City of Dublin and the Dublin San Ramon Services District (DSRSD) duly entered into the Cooperative Agreement concerning Dublin Boulevard Widening Project and Construction and Acquisition of Recycled Water Line ("Agreement"), pursuant to which the City completed the installation of public improvements generally described as the "Dublin Boulevard Widening - Dougherty Road to Scarlett Drive" project; and WHEREAS, the City, on July 2, 2002, acting through its City Council, accepted such improvements in their entirety, and DSRSD, through its Board of Directors on July 16, 2002, accepted the portion of said improvements called "District's Project" in the Agreement, and DSRSD has paid to City all costs required of it under the Agreement; and WHEREAS, Paragraph l(e) of the Agreement obligates the City to convey title of "District's Project" to, or to conf'n'rn vesting of title thereof in, DSRSD by a resolution duly adopted by its City Council or other document approved as to form by DSRSD's counsel; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin approves the conveyance to DSRSD of all of the City's right, title and interest in the following portions of the public improvements generally described as the "Dublin Boulevard Widening - Dougherty Road to Scarlett Drive" project accepted by the City Council of the City of Dublin on July 2, 2002: 1. 24-inch diameter recycled water pipeline extending approximately one thousand five hundred feet; 2. Various valves, hydrants and other appUrtenances to said pipeline as adjusted or installed. BE IT FURTHER RESOLVED that the Mayor is authorized and directed to execute a Deed Conveying Recycled Water Pipeline, Conduit, and Appurtenances to accomplish this conveyance.
