' \~:~/ CITY CLERK File # ^~^^- ~J^Q AGENDA STATEMENT CITY COUNCIL MEETING DATE: July 21, 2009 SUBJECT: Acceptance of Work -Contract 09-04, Citywide Street Storm Drain Condition Assessment, Sanact, Inc., DBA Roto-Rooter Report Prepared by: Melissa Morton, Public Works Director ATTACHMENTS: Map of Storm Drain Assessment Area in Fiscal Year 2008-2009 RECOMMENDATION: Accept as complete the work under Contract No. 09-04, Citywide Street Storm Drain Condition Assessment, and authorize the release ~~ of retention after 35 days if there are no subcontractor claims. FINANCIAL STATEMENT: The contracted services are funded through the General Fund. This is one component of a larger project and the next phase (anticipated to occur in Fall 2009) will analyze the videotape to assess the condition and identify deficiencies. Traffic Control, Cleaning of Storm Drain Lines, and Video $ 58,710 $ 53,882 Recordin of the line condition DESCRIPTION: The second year of the multiple-year Citywide Street Storm Drain Condition Assessment Capital Improvement Project (CIP No. 96030) was approved as part of the Five- Year Capital Improvement Program (CIP) for Fiscal Year 2008-2009. The project is being undertaken in two phases. The first phase consisted of a clean-out of the storm drain system and video recording of the existing pipe condition. J G:\CIP\Storm Drain Assessment\FY2008-2009\Agenda Statements\agst accept.doc ~, The second phase consists of an assessment and report compilation on the condition of the storm drain system to assess the need, if any, to perform local repairs to the storm drain system. Any recommended repairs will be included in a new Capital Improvement Program (CIP) project for consideration in a future CIP update. The second phase of the project is projected to take place in Fa112009. City practice is to hold back ten percent of project invoices as retention throughout the length of the project to ensure completion of the project and retain funds against potential subcontractor claims, should they arise. Upon the City Council's acceptance of project improvements, the retained amount is paid to the contractor after 35 days if there are no subcontractor claims. RECOMMENDATION: Accept as complete the work under Contract No. 09-04, Citywide Street Storm Drain Condition Assessment, and authorize the release of retention after 35 days if there are no subcontractor claims. On or about the 7tn day of April, 2009, the City of Dublin, a municipal corporation of the State of California, did enter into a certain contract with Sanact, Inc. DBA Roto-Rooter for a certain work of improvement: to wit, Citywide Street Storm Drain Condition Assessment (Year II Phase I), Contract Number 09-04. 2. The project was accepted as completed on July 21St, 2009, by the City Council for the City of Dublin. 3. The offices of the City of Dublin are located at 100 Civic Plaza, Dublin, California 94568. 4. The nature of the interest or estate of the City of Dublin is as owner of certain land in dedicated right-of-way title designated as the City of Dublin storm drain system, as well as ownership of improvements thereon. 5. The name of the surety on the bonds of the Citywide Street Storm Drain Condition Assessment Project, Contract Number 09-04, is as follows: American Contractors Indemnity Company.
