A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
RECOMMENDING THAT THE CITY COUNCIL APPROVE A
PLANNED DEVELOPMENT REZONE AND ESTABLISH FINDINGS,
GENERAL PROVISIONS, AND DEVELOPMENT STANDARDS FOR A
PLANNED DEVELOPMENT REZONING FOR PA 97- 018
JEFFERSON AT DUBLIN PROJECT
WHEREAS, JPI Westcoast, L.P., has requested approval of a Planned Development Rezoning
for a 368 unit multi-family project on 16.17 gross acres in the Eastern Dublin Specific Plan Area; and
WHEREAS, the Applicant has submitted a Land Use and Development Plan as required by
Section 8.32 of the Zoning Ordinance which meets the requirements of said section; and
WHEREAS, pursuant to the California Environmental Quality Act (CEQA) the City has found,
pursuant to CEQA Guidelines Section 15182, that the proposed residential project is within the scope
of the Final Environmental Impact Report for the Eastern Dublin General Plan Amendment and Specific
Plan which was certified by the City Council by Resolution No. 51-93, and the Addenda dated May 4,
1993, and August 22, 1994 (the "EIR"), and has further found that the proposed project is consistent
with the adopted Eastern Dublin Specific Plan; and
WHEREAS, the Land Use and Development Plan and Planned Development Standards are
attached as Exhibit 2 to the Staff Report and incorporated herein by reference; and
WHEREAS, a properly noticed public hearing was held on the project on February 10, 1998;
and
WHEREAS, the Staff Report was submitted recommending that the Planning Commission
recommend approval of the Planned Development Rezone to the City Council; and
WHEREAS, the Planning Commission did hear and use their independent judgment and
considered all said reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby
make the following findings and determinations regarding said proposed Planned Development
Rezone:
1. The Planned Development Rezone is consistent with the general provisions, intent, and
purpose of the PD District Overlay Zone of the Zoning Ordinance. The Planned Development Rezone
will be appropriate for the subject property in terms of providing General Provisions which set forth the
purpose, applicable provisions of the Dublin Zoning Ordinance, range of permitted and conditionally
permitted uses, and Development Standards; which will be compatible with existing residential and
commercial uses in the immediate vicinity, and will enhance development of this area; and
2. The Planned Development Rezone is consistent with the general provisions, intent and purpose
of the Eastern Dublin Specific Plan. The Rezone implements the intent and development standards
identified in that document and will thereby serve to implement the provisions of the Eastern Dublin
Specific Plan in this area; and
3. The Planned Developm . Rezone is consistent with the intent le General Plan which
designates this area as Medium and Medium High Density Residential in that the Planned
Development Rezone will implement the intent of this Land Use Designation and because the project
would create development within the densities allowed by this Designation; and
4. The Planned Development Rezoning will not have a substantial adverse affect on health or
safety or be substantially detrimental to the public welfare or be injurious to property or public
improvements as all applicable regulations will be met; and
5. The Planned Development Rezoning will not overburden public services as all agencies will
have to commit to the availability of public services prior to issuance of building permits as required by
the Eastern Dublin Specific Plan policies and mitigation measures; and
6. The Planned Development Rezoning will create an attractive, efficient and safe environment
through the implementation of the standards identified in the Rezone document; and
7. The Planned Development Rezoning will benefit the public necessity, convenience and general
welfare and is in conformance with Sections 8-32 of the Dublin Zoning Ordinance; and
8. The Planned Development Rezoning will be compatible with and enhance the general
development of the area because it will be developed pursuant to the standards and site development
review; and
9. The Planned Development Rezoning will provide an environment that will encourage the
efficient use of common areas to create an innovative type of multi-family development.
BE IT FURTHER RESOLVED THAT except as specifically shown on Exhibit 1, the Land Use
and Development Plan, or included in Exhibit 2, General Provisions and Development Standards,
attached to the Staff Report and incorporated by reference herein, development and operation of land
use activities within this planned development, shall be subject to the City of Dublin Zoning Code in effect
at the time the development and land use activities are considered. Changes or revisions to this
document, including Exhibits 1 or 2 shall be subject to those requirements contained within the most
current Zoning Code.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby recommend
that the City Council approve PA 97-018, The Jefferson at Dublin Project Planned Development Rezone
and establish the General Provisions and Development Standards (Exhibit 2) which constitute regulations
for the use and improvement of the 16.16+ acres APN 986-001-001-10 (por).
PASSED, APPROVED AND ADOPTED this 10th day of February, 1998.
