A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF Dublin
ADOPTING A NEGATIVE DECLARATION FOR PA 97-040, CASTERSON PROPERTY
DEVELOPMENT - GENERAL PLAN/SPECIFIC PLAN AMENDMENT, PD REZONING,
VESTING TENTATIVE MAP, AND SITE DEVELOPMENT REVIEW
WHEREAS, James Tong, on behalf of Clyde Casterson, has submitted applications to the City
of Dublin requesting approval of a General Plan/Specific Plan Amendment, Planned Development
Rezoning, Vesting Tentative Map and Site Development Review, as represented by the plans, diagrams,
and text in Exhibit A-l, to subdivide a 19 + acre parcel for 109 homes with public and private open
space, and a regional trail along the Tassajara Creek, in the Eastern Dublin Specific Plan area; and
WHEREAS, the California Environmental Quality Act (CEQA), together with State guidelines and
City environmental regulations require that certain projects be reviewed for potential environmental
impacts and that environmental documents be prepared; and
WHEREAS, an Initial Study was conducted for this project with the finding that this Project is
located within the boundaries of the Eastern Dublin Specific Plan area and is considered one in a series of
actions covered within the scope ofthe Program EIR. The Eastern Dublin Specific Plan was adopted in
1994 and has a certified Program EIR (SCH No. 91-103064). The Program EIR & Addendum adequately
describe the impacts of the project, and there have been no substantial changes or new information which
would necessitate supplementing the Program EIR pursuant to Public Resources Code section 21166 and
CEQA guidelines Section 15162; and
WHEREAS, the Initial Study was prepared to evaluate site-specific impacts of the project (to a
greater level of detail than in the Program EIR) pursuant to CEQA guidelines Section 15168. The
discussion in the Initial Study explains that the Mitigation Measures previously adopted for the Program
EIR and addendum continue to apply to this project, and also help to reduce the potential site-specific
impacts of the project to a level of insignificance. In addition, standard city requirements, improvements,
and design aspects of the proposed project which have been incorporated in the proposal collectively
reduce the potential impacts to a less-than ~significant level. The Initial Study has resulted in the conclusion
that the proposed project will not create any new significant impacts which were not already covered by
the EI1L nor require any new mitigation measures; and
WHEREAS, a Negative Declaration has been prepared for this application and is on file in the
Dublin Planning Department; and
WHEREAS, the Planning Commission did review and use their independent judgment to consider
the Negative Declaration at a public hearing held on April 14, 1998; and
WHEREAS, proper notice of said hearing was given in all respects as required by law.
WHEREAS, the Planning Commission did adopt a Resolution recommending that the City Council
adopt a Negative Declaration for the Casterson Property Development Project, PA 97-040; and
WFIEREAS, a properly noticed public hearing was held by the City Council on May 5, 1998; and
WHEREAS, the StaffReport was submitted recommending that the City Council adopt a Negative
Declaration for the Casterson Property Development Project; and
WltE~S, the City Council did hear and use their independent judgment and consider all said reports,
recommendations and testimony hereinabove set forth. -
NOW, TItEREFORE, BE IT RESOLVED THAT THE Dublin City Council does hereby find that:

Pursuant to the California Environmental Quality Act (CEQA) the City finds that this residential
project is within the scope of the Final Environmental Impact Report for the Eastern Dublin
General Plan Amendment and Specific Plan (SCH 91103064) and the Mitigated Negative
Declaration for the Eastern Dublin Specific Plan Amendment and City of Dublin General Plan
Amendment (SCH 96092092). In addition, site-specific environmental affects have been
analyzed in an initial study dated February 24, 1998, and circulated for public review, during
which time 2 comments were received on the proposed Negative Declaration. The Casterson
Property Residential project application will not have a significant effect on the environment with
the application of previously identified mitigation measures, based on a review of the Initial Study
and public testimony.
B. The Negative Declaration has been prepared in accordance with State and local environmental
laws and guideline regulations.
C. The Negative Declaration is complete and adequate.
NOW, THEREFORE BE IT FURTHER RESOLVED THAT THE Dublin City Council does
hereby adopt the Negative Declaration for PA 97-040, Casterson Property Development.
