City of Dublin et al., U.S. District Court, Northern District of California, Case C 07-05794 MHP A special meeting of the Dublin City Council was held on Tuesday, September 29, 2009, in the Council Chambers of the Dublin Civic Center. The meeting was called to order at 7:00 p.m., by Mayor Sbranti. ~+ ROLL CALL PRESENT: Councilmembers Biddle, Hart, Hildenbrand, Scholz, and Mayor Sbranti ABSENT: None PLEDGE OF ALLEGIANCE The pledge of allegiance to the flag was recited by the City Council, Staff and those present. 1. REPORT ON CLOSED SESSION ACTION Mayor Sbranti stated there was no reportable action during Closed Session. Pat Huffman, 2009 President of the Bay East Association of REALTORS, stated that the National Association of REALTORS working in conjunction with the U.S. Conference of Mayors selected the Bay East Association of REALTORS and the Tri-Valley communities of Danville, Dublin, Livermore, Pleasanton and San Ramon to receive the 2009 Ambassadors for Cities Award. The award was presented to this group based on the collaborative efforts between these communities and the Bay East Association of REALTORS to establish and support the Tri-Valley Housing Opportunity Center. The City Council thanked Ms. Huffman for the award. 3. UNFINISHED BUSINESS Arroyo Vista -Environmental Impact Report, General Plan Amendment, Planned Development Rezone With a Stage 1/Stage 2 Development Plan and Resolution Waiving Certain Provisions of Dublin Municipal Code Chapter 8.68 (Inclusionary Zoning Regulations) of the Zoning Ordinance, PA 07-028 7:08 p.m. 400-20/420-30/450-30 Senior Planner Erica Fraser presented the Staff Report and advised that the proposed Arroyo Vista residential development would be a community of 378 residential units comprised of 198 market rate and 180 affordable units, a community building and a daycare. The market rate component of the project would include 141 attached and 57 detached for-sale dwellings. Up to 14 of the for-sale units would be affordable dwellings. The affordable portion of the project would include 130 affordable family apartments and 50 affordable senior apartments. Scholz asked if the childcare at the development would be a before- and after-school childcare. Ms. Fraser stated the childcare would be run by Kidango. Mr. Hart asked if the open computers in the community center would be hooked up to the Internet. Linda Mandolini, Executive Director of Eden Housing, stated the programs and computers would be fully monitored. Cm. Hart asked what was the setback of the homes. Ms. Fraser stated the setback varied. For the detached, there was a paseo with a walkway down the middle. In the back of the development, there was zero setback. Cm. Hart asked if the soundwall on Dougherty would be rebuilt. Would it be the same height? Ms. Fraser stated it would be rebuilt to the same height but with a new look. The frontage would be changed. Cm. Biddle asked if the community center could be rented by others than the residents of the development. Liz King, Dublin resident, spoke in opposition of the change of the medium density to medium/high density. Ms. Mandolini stated there was a good mix of residences; there would be a central area, childcare provided by Kidango; the Community Center would be a place where everyone could come together. People other than residents could rent the facility. It was one of the nicest projects they had designed and one of the least dense. Senior housing would be affordable and would have elevators. Arroyo Vista residents would get the first opportunity to move back to the development. It was a great project that would provide great opportunity. Arroyo Vista residents would get first chance to move in. It had been a long project. She would support it. Cm. Scholz asked what year the project had started. Mayor Sbranti stated this portion of the project started in 2003 when residents would came in and complained about design problems. Vm. Hildenbrand stated this project had been approved years ago. The dollar figure to fix general problems would have cost $22 million. It was decided to look at other options. The residents of Arroyo Vista would have first choice to return if they so chose. Cm. Scholz asked how the live-in manager would be selected. Ms. Mandolini stated there would be two managers or a manager and a maintenance person. If there was an association, the manager would have to be part of the association. Cm. Hart stated it was a benefit to Eden, Citation, the Dublin community, and the current residents to come back. He was ready to approve the project. Cm. Biddle stated the detached homes would have their own yards, as the City Council had requested. Vm. Hildenbrand stated it was great that others could use the community center. Mayor Sbranti stated it was an exciting time for this project. It was balanced and the public amenities were there. He thanked the previous Councilmembers for the project. On motion of Vm. Hildenbrand, seconded by Cm. Biddle stated he had attended the League of California Cities (League) Conference. Vm. Hildenbrand had been elected First Vice Chairperson of the East Bay Division of the League. He thanked City Staff for their work on Day on the Glen. Vm. Hildenbrand stated she had attended the League Conference. She also announced that the Fallon Middle School Cheerleaders had received first place at a recent competition and had been invited to compete in Nationals. Cm. Scholz stated she had attended the League Conference. She also attended the Day on the Glen and attended a Lions Fundraiser at the Senior Center. City Manager Pattillo stated there were many Staff members that participated in Day on the Glen, but she needed to give a special thanks to Staff member Julie Carter for her work on the City tent. Cm. Hart stated he attended Day on the Glen. Mayor Sbranti stated there would be a service for Danville Town Councilman Mike Shimansky next Saturday. He had attended the last Tri-Valley Council meeting. The next Tri-Valley Council meeting would be hosted by the City of Dublin in February 2010. He had participated in the Day on the Glen; he attended a TV30 Board meeting with discussion on whether to include Staff as alternates or serve on the Board. He spoke to elementary students at Green Elementary and attended the Walk and Roll Program at Dublin Schools. On Friday, October 2, Dublin High would be hosting their Homecoming event.
