A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
APPROVING AMENDMENT NO. 7 TO THE AGREEMENT WITH
TY LIN INTERNATIONAL FOR CONSULTING SERVICES
I-580/FALCON ROAD INTERCHANGE IMPROVEMENTS PROJECT
WHEREAS, on May 16, 2000, the City Council of the City of Dublin approved an
agreement for design services with CCS Planning & Engineering, Inc., now known as TY Lin
International/CCS, for the design of the I-580/Fallon Road Interchange Improvements; and
WHEREAS, subsequent contract amendments (Amendment 1 through 6) were approved
over the course of project design to expand their scope of services; and
WHEREAS, TY Lin International/GCS's scope of work is now being expanded to
increase TY Lin's overall construction support service budget to complete project closeout.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does
hereby approve Amendment No. 7 to the Agreement with TY Lin International/GCS, attached
hereto as Exhibit A.
BE IT FURTHER RESOLVED that the City Manager is authorized to execute the
Amendment.

AMENDMENT NO.7 TO AGREEMENT BETWEEN
CITY OF DUBLIN AND TY LIN INTERNATIONAL/CCS
FOR ENGINEERING SERVICES
WHEREAS, the City of Dublin (hereinafter referred to as "CITY") and TY Lin InternationaUCCS
(hereinafter referred to as "CONSULTANT"), entered into an agreement on May 16, 2000, to design the
I-580/Fallon Road Interchange Improvements; and
WHEREAS, the City Council of the City of Dublin approved Amendments No. 1 through No. 6
to the Consultant Agreement to include additional services, and
WHEREAS, the City desires to amend the Consultant Agreement to include additional services,
and the not-to-exceed contract amount is proposed to be increased to cover the cost of the additional
work;
NOW, THEREFORE, the parties hereto agree as follows:
Scope of Work
The Scope of Work shall be extended to include the additional scope of work as described in
Consultant's letter dated January 25, 2010, for the I-580/Fallon Road Interchange Improvements Project
(attached).
Extension of Fees
The total cost for time-and-materials work under this amendment shall not exceed an additional
$80,000.

I-580/Fallon Road Interchange
• Responded to RFI's on Chromium found in soil, Petroleum Hydrocarbons found in soil,
unsuitable subgrade, and lenton couplers not found on bottom slab of existing RCB
• Prepared CCO #7, 9, and 11 -the unforeseen change orders:
In early July, during excavation for the WB auxiliary lane upstream of the Fallon Road off-
ramp, the contractor discovered 2-48" parallel pipes underneath the proposed shoulder,
which at some areas only have less than 1 foot cover. These pipes, along with junction
boxes, had to be removed (CCO #7) and replaced (CCO #9) with a 42" RCP to the outside
shoulder of the proposed ultimate widening of the upcoming WB HOV Lane Project. Due
to the new alignment of the replacement pipe, overhead sign structures also needed to be
shifted (CCO #11) to different locations. AC dikes and MBGR also had to be added or
revised as part of CCO #9.
These existing pipes are identified on our Drainage Plans but are shown at the location
much closer to the R/W fence that would not have any impact to our auxiliary lane
construction. These "existing" Iocations were obtained from Caltrans' As-Builts drawings,
which were checked at time of PS&E and again verified after the Contractor's discovery.
The above effort, along with normal RFI's and correspondence with S&C Engineers basically depleted
our budget for Construction Support Services.
We, respectfully, are requesting consideration of an increase in the amount of $80,000 to our overall
Construction Support Service budget and for closeout of this project. This increase is made up of the
following:
• $43,500 to cover remaining construction support services between October 25, 2008 (last
invoice billed to budget limit through Amendment 6) and completion of original project
(thru January 2010, excluding ACTIA CCO 39 and ACCMA CCO 39b). This includes
preparation of CCO's requested by you, such as addition of Type 6 Chain Link Railing on
the west side of the overcrossing, fractured rib texture at the bridge railings, striping
revision at Croak Road, revision of Traffic Handling at Stage 3A for bridge closure pour,
and other minor coordination issues with S&C Engineers, etc.
• $13,500 to prepare As-Builts (estimated at %z hour per sheet, including checking)
• $20,000 for completion of Right-of--Way work. This includes Record Right-of--Way Map,
review pro forma title policy; prepare Corporation Grant Deed, and Record of Survey Map
necessary for completion ofright-of--way transfer to Caltrans.
• $3,000 contingency -additional CCO, or additional R/W surveys, as authorized
Timeline for producing the As-Builts should be no more than 2 to 3 weeks from when we received the
mark-ups from S & C Engineers. These as-Builts will be done electronically.
The Right-of--Way survey mapping work will include converting the current Hardcopy Maps to R/W
Record Maps, preparing a Grant Deed, preparing two corner record(s), including survey crew time
setting two corner monuments. This survey effort requires approximately 60 hours. Upon approval of
the Fallon Road UC project by Caltrans, the R/W Record Maps as required for the R/W acquisition
will be prepared. The review and acceptance process by Caltrans is anticipated to take 8 to 16 weeks.

Any additional R/W surveying efforts required to support further R/W transfer services is consider on
a time and materials basis.
Although we are requesting an increase of $60,000 (for capital improvement, and not counting the
completion of R/W work), the total of $150,000 for Construction Support Services represents only
1.6% of Construction cost, which is much less than the averaged industry cost for similar magnitude
and nature of project.
Needless to say, construction support services for both the ACTIA projects (CCO 39 and 39b) for the
eastbound and westbound auxiliary lanes, including preparation of As-Builts, are being handled under
separate agreements with ACCMA.
