Two small areas located at the northeast and southeast corners of the intersection are not needed for street right-of-way purposes. The Conditions of Approval for Vesting Tentative Map 7586 require that the developer transfer these areas to the Fallon Village Homeowner's Association (HOA) and/or the Fallon Village Geologic Hazard Abatement District (GHAD) for landscaping and/or water quality purposes. The vacation or abandonment of this right-of-way would allow the developer to satisfy this Condition of Approval. Pursuant to Section 8330 of the Streets and Highways Code, the City may adopt a resolution vacating these two areas as street right-of-way. FINANCIAL IMPACT: Once the City vacates the unnecessary right-of-way parcels, the City would be relieved from any maintenance responsibility and costs. The HOA and/or GHAD would be then be responsible for the maintenance of these parcels once to the requirements of the Vesting Tentative Map 7586 were satisfied. RECOMMENDATION: Adopt the resolution vacating a portion of Fallon Road Right-of-Way at the Fallon Road/ Positano Parkway Intersection. ,~ , ; ~'~ ~ Sub ' ed By Review Cit ngineer Assistant City Manager ~ Page 1 of 2 ITEM NO. • DESCRIPTION: As required by the Conditions of Approval for Vesting Tentative Map 7586, the street right-of- way dedications and improvements at the Fallon Road/Positano Parkway intersection have been completed. The current street right-of-way contains two small areas that are not needed for street improvements. These areas are located at the northeast and southeast corners of the intersection and are shown as Parcel 1 and Parcel 2 on Attachment 1. The tentative map designates Parcel 1 for landscaping purposes and Parcel 2 for water quality purposes. Parcel 1 would ultimately be dedicated to the Fallon Village Homeowners Association (HOA), and Parcel 2 would ultimately be dedicated to the Fallon Village Geologic Hazard Abatement District (GHAD). Attachment 2 shows the ultimate conditions for Fallon Road and Positano Parkway. These two right-of-way parcels were originally dedicated to the City as part of a larger Fallon Road right-of-way dedication as a requirement of Tract 7135. The right-of-way dedication was based on an alignment of Falton Road that extended the road through the Jordan Ranch property to the east. Subsequently, the City Council adopted a new atignment for Fallon Road that avoided environmentally sensitive areas on the Jordan Ranch property, by relocating the road to the southwest. Tract 7281 dedicated additional right-of-way for Fallon Road that conforms to the new alignment. The current improvements to Fallon Road are located within the Tract 7281 right-of-way. A portion of the Tract 7135 was utilized for the extension of Positano Parkway; the two areas on either side of Positano Parkway are no longer needed for street purposes and are the subject of this vacation. Since an existing City storm drain is located within Parcel 1, a 25' wide public storm drain easement will be dedicated by the property owner to the City under a separate grant deed to be recorded simultaneously with this vacation. In addition, a 10' wide public utility easement will be dedicated over the new Fallon Road and Positano Parkway frontages of Parcel 1 under a separate grant deed, to allow future installation of utilities behind the public right-of-way if needed. Vacating or abandoning these two areas would clear the parcels from street right-of-way encumbrances, and would allow the parcels to be dedicated to the HOA and the GHAD. The property owner (Lin) that dedicated this portion of Fallon Road on Tract 7135 has entered into an agreement to sell these two parcels to Braddock and Logan once the City completes the right-of-way vacation process. Braddock and Logan would then dedicate these parcels to the HOA or the GHAD to satisfy the Conditions of Approval for Vesting Tentative Map 7586. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dublin that: 1. This resolution is enacted pursuant to Chapter 4 of Part 3 of Division 9 of the California Streets and Highways Code. 2. The provisions of Government Code section 65402(a) shall not apply to this resolution, which disposes of the remainders of a larger parcel that was used for street purposes. 1 ATTACHMENT 3 ~~ ~a G 3. Those two portions of the City of Dublin's street system located within the City of Dublin at the intersection of Fallon Road and Positano Parkway, and more specifically described in Exhibit A, are unnecessary for present or prospective public use. 4. Said portions of the City of Dublin's street system are no longer required for street or highway purposes in that they have been superseded by a reconfiguration of the street. 5. Said portions of the City of Dublin's street system are not useful as a non- motorized transportation facility. 6. A copy of this resolution shall be recorded with the County Recorder pursuant to Streets and Highways Code section 8336. From and after the date of recordation, those portions of the street system described in Exhibit A shall no longer constitute a street, highway or public service easement. 7. The City Manager is authorized to execute the Quitclaim Deed, attached hereto as ~ Exhibit B, to transfer the land vacated by this Resolution to Chang Su-o Lin, a married woman as her sole and separate property, Hong Yao Lin, a single man, and Hong Lien Lin, a single man.
