A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING IMPROVEMENTS FOR RIGHT-TURN LANE WIDENING ON DUBLIN
BOULEVARD AND HACIENDA DRIVE FOR PARCEL MAP 7223 "HACIENDA CROSSING"
AT OPUS WEST RETAIL PHASE II (OPUS WEST CONSTRUCTION)
WHEREAS, the public right-of-way for Dublin Boulevard and Hacienda Drive, in the
incorporated territory of the City of Dublin, State of Califomia, to serve the Opus West Retail Phase II
Project, has been irrevocably dedicated to the public by Parcel Map 6879, filed on November 4, 1996,
Recorder's Series No. 96-280564 in Book 225 of Parcel Maps at Pages 67 - 75; and
WHEREAS, Conditions of Approval No. 44 and 45, approved on December 1, 1997, via
Community Development Director Resolution 09-97, required the Developer to design and construct
a northbound right-mm lane on Hacienda Drive between the southerly driveway of Hacienda Crossing
and Dublin Boulevard, an eastbound right-turn lane on Dublin Boulevard between Hacienda Drive and
Hibernia Drive, and landscaping frontage improvements adjacent to the Hacienda Crossing development;
and
WHEREAS, Opus West Corporation, a Minnesota Corporation, previously entered into a Tract
Developer Agreement with the City of Dublin to construct said roadway improvements in accordance with
plans and specifications on file with the City Engineer, said improvements identified as follows:
a) Developer: Opus West Corporation, a Minnesota Corporation
b) Location: Dublin Boulevard and Hacienda Drive
c) Resolution Approving Agreement: 28-02, City Council of Dublin
d) City Streets Affected: Dublin Boulevard and Hacienda Drive
WHEREAS, the improvements associated with Dublin Boulevard and Hacienda Drive are
complete in accordance with said plans and specifications, and any approved modifications thereto,
to the satisfaction of the City Engineer; and
WHEREAS, the developer has installed certain traffic regulatory devices as part of the
improvements; and
WHEREAS, the original $4,656,921.36 Performance Bond and $2,328,460.68 Labor and
Materials Bond posted to guarantee the improvements associated with Parcel Map 7223 can each be
reduced by $300,000.00 in accordance with the authority contained in §66499.7 of the Government
Code of the State of California, and replaced with a Maintenance Bond to guarantee maintenance of the
completed work for a one-year period.
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed within Dublin Boulevard and Hacienda Drive are hereby
approved and accepted subject to a one-year guarantee period.
2. The traffic regulatory devices installed by the developer are hereby included in the City of
Dublin Traffic Code, said regulatory devices to include the following:
"No parking" restriction along the south side of Dublin Boulevard from Hacienda
Drive to Hibernia Drive, and along the east side of Hacienda Drive from Dublin
Boulevard to the southerly Hacienda Crossing driveway.
3. The original Performance Bond issued by American Insurance Company (Bond No.
11119418827) in the mount of $4,656,921.36 be reduced by $300,000.00.
4. The original Labor and Materials Bond issued by American Insurance Company (Bond No.
1111941882) in the amount of $2,328,460.68 be reduced by $300,000.00.
5. The submitted Maintenance Bond in the amount of $75,000.00 issued by The Continental
Insurance Company (Bond No. 929256012) be accepted as security for t_he aforesaid one-
year maintenance period, said period to commence on this date and terminate on the 3rd
day of December, 2003.
PASSED, APPROVED AND ADOPTED this 3rd day of December, 2002.
