FINANCIAL STATEMENT: If the appeals are not qranted, the residents will
be reguired to subscribe to a minimum level of
~ervice, the current ~ate is $6.65 per month.
DESCRIPTION: In January, 1992 the City Council passed ~he
Mandatory Garbage Service Ordinance, No. 2-92. The Mandatory Garbage
Service p~ogram began March 16, 1992 for all residents in Dublino
At the same time as the City Council approved ~he Mandatory Garbage Service
Ordinance, a newr class of service was initiatedo The new class of se~vice
provides for a 20 gallon container, curbside recycling and the four special
Saturday pick-ups for $6.65 per month. This low monthly rate is the
minimum level of service and assures that the costs of the recycling
program and Saturday pick-ups are spread among the entire rate base. All
residences were required to subscribe to at least this level of service
unless they qualified for an exemption. Exhibit 1 identifies the current
status of the Mandatory Garbage Programe
In accordance with Ordinance 2-92, the law provides for an exemption and an
appeal process (Exhibit 2)a According to Section 5.32.111 of the Dublin
Municipal Code, an exemption is allowed when solid waste is not produced,
accumulated in, upon, or from such propertye To be exempted grom garbaqe
service, the resident completes an "Application for Exemption" and submits
it to the City Manager's Office. An on-site inspection of the property is
conducted to verify the information received on the application for
exemption. The City Manager then makes a determination to approve or deny
the application for exemption. If an applicant is denied, an applicant may

appeal to the City Council. The individual filing the appeal must submit,
in writing, the reasons why the application for exemption should not be
denied. If an exemption is granted, the term of said exemption will need
to be determined. The exemption can be revoked if the factual basis for
granting the exemption changes. The determination of the City Council is
considered final.
The following individuals have applied for an exemption from Mandatory
Garbage Service. The applications and subsequent inspections indicate that
they produce Solid Waste on the property and therefore, according to
Section 5.32.080 of the Solid Waste Management Ordinance, the residents
mus~ have the collector remove generated waste. Attached for the City
Councilos review are five appeals.
The public hearings begin with Exhibit #3 and end with Exhibit #7. The
applicants' letters of appeal, their applications for exemption and
property inspection forms are presented in whole accordinq to their
particular public hearing number. The applicants were notified of this
public hearing by a certified letter.
Staff is presenting all five appeals on one report as not to duplicate
information. It is recommended that the City Council open and close a
public hearing for each applicant and make their determination before
moving on to the next applicant.

Basis of Exemption: The applicant indicates that he hauls the waste
to the Pleasanton Transfer Station himself. The resident also redeems
,. recyclable material at the Pleasanton Buy Back Center. Trash is
disposed of twice each month and the resident indicates he does not
typically accumulate more ~han one trash can per week.
Staff Review of Exemption Request: The applicant submitted a
application for exemption from Mandatory Garbage Service. An on-site
inspection of the property was conducted. The inspection noted ~hat
solid waste is produced on the property.
Basis for Staff Denial: The inspection of the property revealed solid
waste is produced on the property. According to Ordinance 2-92,
5ection 5.32.080, all solid waste produced on the property shall be
removed by the collector at the minimum level of service.
Action Required: Close the Public Hearing and adopt a resolution

Public Hearing #3 Tayna Marie Clark

Applicants Request for Exemption: The applicant explains that a very
small quantity of waste is produced on the property. The disposal of
the waste is shared with a friend and the garbage is removed twice a
weeko
Staff Review of Exemption Request: The applicant submitted a
application for exemption from Mandatory Garbage Service. An on-site
inspection of the property was conducted. The inspection noted that,
by the owner's admission, a small quantity of solid waste is produced.
Staff has also evaluated several issues related to garbage service
which are raised in Mrs. Clark's letter of appeal. The following
information is intended to clarify information as to how the Mandatory
Garbage Ordinance was developed.
Consideration of Reduced Service Levels Prior to Im lementation of
Mandatory Service
* The City of Dublin did consider other service levels to address
low-volume waste generators, with the introduction of a Super
Recycler Service. The service is made available to all customers
~n order to avoid administrative costs of qualifying customers
based upon income or age.
Combetitive Selection of Garbage Service Provider
* The current agreement for garbage collection and disposal was
originally implemented in 1986. At that time ~he City requested
proposals from several providers of these services. Only one
responsible proposal was received from the parent company of
Livermore Dublin Disposal. This agreement allows the Company to
collect and dispose of all garbage. The initial term of the
agreement has less than 4 years remaining.

efforts were undertaken to obtain public inputo
- A public hearing was conducted on January 13, 1992 and one
member of the public addressed the City Council.

homes which did not subscribe to garbage service.

Three members of the public including Ms. Tanya Clark and
.. Mse Ella Clark provided public testimony on the ordinance.

The applicant also uses a chipper to mulch yard debris.

inspection of the property was conducted. The inspection noted that
solid waste is produced on the property.

is taken away by her daughter twice each week. The resident indicates
that the amount of waste which is generated is too small to warrent
regular serviceo

application for exemption from Mandatory Garbage Service. An on-site
inspection of the property was conducted. The inspection noted that
solid waste is produced on the property.
Basis for Staff Denial: The inspection of the property revealed solid
waste is produced on the property. According to Ordinance 2-92,
Section 5.32.080, all solid waste produced on the property shall be

Status Report
Mandatory Garbage Service
(Prepared August 19, 1992)
Implementation
The new law became effective February 28, 1992. At that time 308
residential accounts did not have regular garbage service. All units
were contacted and advised of the need to establish minimum service by
March 16, 1992 or request an exemption.
Exemption Rec~uests
A total of 37 exemption rec~uests were received. Property billing was
suspended until the final outcome of the exemption process for these
individuals.
Exemptions Granted by Staff Pursuant to the Ordinance
A total of 5 applications for exemptions were granted for vacant
residential units.
Exemptions Denied Bv Staff Pursuant to the Ordinance
A total of 32 applications were denied given that they did not appear
to meet the requirements of the ordinance.
Ap~eals Received
All applicants whose application for exemption was denied by Staff
were advised of their opportunity to appeal to the City Council. They
were advised the appeal must be, in writing and submitted within 20
days. A total of 5 applicants filed an appeal.
Current Delinquencies
,. The Company has indicated that there are currently a total of 89
accounts which are delinquent. The Company is in the process of
sending a final request for payment to the property owners. The
notification also advises that unpaid amounts may become a lien on the
property.

ADMINI5TRATIVE PROCEDURES FOR EXEMPTION'
FROM MANDATORY GARBAGE SERVICE
Section 5.32.111 Dublin Municipal Code
In accordance with the Dublin Municipal Code, the following administrative
procedures are adopted by Resolution of the City Council.
I. Exemption AppliCations
Attached hereto as Exhibit A is an application form for exemption from
mandatory garbage service. The form used for this purpose shall
substantially represent the information shown in Exhibit A. The form
includes questions which are necessary to determine whether solid
waste is produced or accumulated in, upon, or from such property.
These forms shall be made available by the City Manager's Staff to
persons requesting an exemption.
II. Reference Information (Exhibit B)
The application form (Exhibit A) shall include reference information
such as that shown in Exhibit B. The purpose of this information is
to assist the applicant, without a need to refer to the entire Solid
Waste Management Ordinance.
III. Inspection Reauired
In order to verify whether the applicant qualifies for an exemption,
an inspection is required. The purpose of the inspection is to verify
whether the address appears to meet the qualification that solid waste
is not produced or accumulated in, upon, or from such property. The
applicant shall be informed that an inspection will occur. The
inspection shall be completed by City 5taff.
IV. Inspector__Recommendation
Based upon the inspection, a recommendation shall be made to the
Director (City Manager/or his/her designee) by the Inspector regarding
whether the address qualifies for an exemption. The Inspector shall
also attach any relevant information supporting his/her
recommendation.
V. Director's Decision
The Director (City Manager or his/her designee) shall make a decision
based upon information in the application, the inspection report, and
the criteria in the Municipal Code. Following a decision by the
Director, the applicant shall be notified in writing with a Notice of
Determination. Said notification shall include information on the
applicant's right to appeal the decision.
VI. Term of Exemption
Director shall identify the term of the exemption granted. Applicant
may be required to submit updated information upon expiration of the
exemption or if the City becomes aware of a change in the conditions,
which would no longer warrant an exemption.
VII. Revocation By Director
As stated in Section 5.32.111 Dublin Municipal Code, said exemption
may be revoked by the Director, in the event that the factual basis
.. for such exemption no longer exists. Said revocation shall also be
subject to the'appeal process as described herein.
VIII.Authorization to Appeal •
In the event the applicant does not agree with the decision rendered
by the Director, he/she may appeal the decision to the City Council in
accordance with Section 1.04.050 of the Dublin Municipal Code.
IX. Notice to Appellant
The City Clerk shall notify the appellant in writing of the findings
made by the City Council on the matter.

I am writing to you regarding the denial my wife and I received
regarding Exemption from Mandatory Garbage Service. I have
several concerns I would like to express to you and would like
to make you aware of these prior to the City Council meeting
I will attend.
We terminated garbage service in 1982 for various reasons.
First, the garbage collectors repeatedly left trash, including
broken bottles, strewn about after their so-called collecting.
We were forced to clean up after these men, including sweeping
the street, after each of their visits so that our yard would
be clean and safe. I found their poor service to be irritating
and phoned several times to relay my feelings to the company.
I was not listened to by them as was evident by each successive
collection.
Secondly, the trash handlers threw my trash can around, breaking
and ruining more than just one. Again phoning the garbage
collecting company to relay my dissatisfaction. My can was
not put back in a responsible way so that on windy days can
could be found at the end of the street in someone else's yard.
On regular weather collecting days cans were left in the way
of neighbors on the sidewalk out for a stroll or trying to pull
into driveways. This was a nuisance and very poor service.
As is the case with anyone that provides very poor service,
I gave them more than a fair opportunity to change their
behavior. Since they didn't I"fired" them.
In our household we have two semi-retired adults. Our children
are grown and out of the house and we now travel as often as
possible. We do not generate large amounts of trash any longer.
We have one garbage can in our rear yard that is well secured
and never reaches more than halfway filled. When we need to
dispose of our garbage, I take it to the dump in Pleasanton.
We seperate out recyclables, glass, cans, and newspapers and
turn these in for refunds. I have my last collection receipt
I will ~rovide for your information.
Our ho~ne is not and never will be any type of health hazard
with ga~bage piling up. At any time of the day or night an
inspector is welcome to our home to view for themself what I,L

am telling you. In the event that I am forced to pay for
mandatory garbage service, I will pay but I will not allow this
company to collect my trash and will continue to take it to
the dump in Pleasanton.
I look forward to meeting you and the City Council regarding
my home. I am proud of this city and understand that you are
trying to keep it clean and safe. I want you to know that I
desire the same things and am doing my part to `keep it safe
and clean, but I also have principals regarding service I expect
and receive. Please respect my descision as I respect yours.

Request for Ex_emption from NSandatory Garba~e Service.
The action taken (denial of application) should not be approved
because: I am complyin~ taith the City of Dublin r4andatory
Garbage Service for all intents and ptirposes; I have provided
for my own mandatory ~arba~e service on a ttaice weekly piclc-up
basis; tiThich is actually a better provision than _T would receive
from Livermore/Dublin Disposal.
The City of Dublin apparently si~ned a contract r~ith L9.vermore
Dublin Disposal (which, being oi~ned by ~~laste Mana~ement Inc., is
a monopoly) without even investigating any alternatives sueh as
open bidding, reduced rates for seniors and/or lota-income
households, bi-monthly sevice, etc. Going F~ith a monopoly
without open biddin~ is the same thin~ as sayi.n~ rrAluts" to our
Free Enterprise System which I have always been under the
impression is the very backbone of our country. Could I be
mistaken about this all these years? Or is there some favortism
(kickbacks or politics, maybe) bein~ sho~an for iahatever reason
that only the City Council is aware of? The residents of Dtiblit~
did not ~et a chance to vote on this selection and even durin~
the so-called "publie hearing" on this raatter, [~~l~en alternatives
~•rere brou~ht up and aslced about by concerned citizens, the.y ~aere
told they could not speak, the issue was cl.osed. That's ~overn-
ment by democracy? I think not. P4ore 1il;e a minor dictatorship.
Even the rec~uirement that no solid waste be produced on the
property for ~ranting an exemption is ambiguous, because it is
~ impossible for even unoccupied (by hur~ans) property to not
produce some solid w.aste such as in the forui of 4reeds, stray
animals, etc.
Therefore, I believe that the action taken by the City t~Iana~er's
Office should not be approved and my application for exenption
should not be denied!

Maintenance of home and yard is accomplished at least
bi-weekly by myself or associates. Any waste is removed

In regard to hearing about mandatory garbage collectio~•;•~~.r r,~- ~E ,w~ ~~~;
in the case of Ed Bressinck. I wish to acquaint you with the
information as follows; I fear that there;w~:ll';not ~~ time to
state my case or that you will not listen to things you do
no~ want to hear.
I.'.spoke to as many as twenty five citizens about the the situatiori
and they all agreed that for the City to make a contract for
service with a private firm for a~.citizen when such service is
not required or wanted is clearly a violation of a person°s
civil rights. The proposed way of forcing payment for such service
is abhorrent and authoritarian. Placing a lien on property and
adding tJ~e fee to the taxes is something you might expect from
a totalitarian regime . This may be a break because ~taxes _ are -:~~. .', ~:
deductible. The argument that the ord~iance:~.s required because
some people are disposing of their waste is invalid because
there are '~~ laws in effect~against ~~zch practices. Your proposed
act~.on punishes everyone and violates their rights because of
a few who may well be transients,tourists or homeless people.
Hardly anyone in town knows that they cannbt~.canceL~their garbage
service even if they want to. The attitude of the people at the
disposal service is t~hat they have the pQwer of City Hall to
whip citizens into being hostage clients. If this situation gets
publicity (which I will try to get) There will be many furious
p aople in town. In my case it will be costing me money for which
I wil~ receive no'benefit because I will have nothing to collect...
It is suggested that the ordinance be rescinded or revised.
Requiring persons who do not subscribe to~waste collection
service to explain what t~iey do with their waste would be, in my
view, no~.objectionable. It is thought that the welfare of the
citizens should be considered above all whr~n you have to listen
to the clamoring of the special interest groups who want to me~ke
a profit. Additional developments shoukl not be considered while
we ha~re a severe water shortage and traffic:problems.

2-92, amending the Solid Waste Management Ordinance to provide for
Mandatory Garbage collection and procedures for collection of
delinquent garbage service bills; and

WHEREAS, a resident can initiate an exemption from garbage
service by completing an application form and submitting it to the
City Managers Office;
WHEREAB, the City of Dublin Ordinance 2-92 identifies criteria
for approval of exemptions; and
WHEREAB, after an on-site inspection of the property the City
Manager makes a determination to approve or deny the application for
exemption; and
~PHEREAS, if the applicant is denied by the City Manager, the
applicant can appeal the determination to the City Council; and
AHEREAS, the City Council accepts testimony in a public hearing
and makes findings on the appeal of the application for exemption from
Mandatory Garbage Service; and
