A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

VACATION OF FALLON ROAD RIGHT-OF-WAY AT THE FALLON ROAD/ POSITANO
PARKWAY INTERSECTION
WHEREAS, the City Council adopted the Eastern Dublin Specific Plan by Resolution No.
53-93, and, on December 6, 2005, the City Council adopted Resolution No. 223-05, which
extended the territory covered by the Specific Plan; and
WHEREAS, this extended territory included the entirety of the area within the boundaries
of the Vesting Tentative Map for Tract 7586, approved by City Planning Commission Resolution
No. 05-61; and
WHEREAS, the Conditions of Approval for Vesting Tentative Map 7586 included the
right-of-way dedication and construction for the intersection of Fallon Road and Positano
Parkway; and
WHEREAS, the necessary street right-of-way has been dedicated to the City, and the
required street and related improvements have been constructed; and
WHEREAS, after the Fallon Road right-of-way was dedicated, minor adjustments in the
final street alignment result in two areas located at the northeast and southeast corners of the
Fallon Road/Positano Parkway intersection falling outside the requirements for street right-of-
way, a legal description of which areas is attached hereto as Exhibit A to this Resolution and
incorporated herein by this reference; and
WHEREAS, in accordance with Vesting Tentative Map 7586, these two areas are
designated for landscaping and/or water quality purposes and will ultimately be maintained by
the Fallon Village Homeowner's Association and the Fallon Viltage Geologic Hazard Abatement
District; and
WHEREAS, California Streets and Highways Code section 8330 permits cities to
summarily vacate portions of roadways which have been superseded by relocation of the
roadway.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dublin that:
1. This resolution is enacted pursuant to Chapter 4 of Part 3 of Division 9 of the
California Streets and Highways Code.
2. The provisions of Government Code section 65402(a) shall not apply to this
resolution, which disposes of the remainders of a larger parcel that was used for
street purposes.

3. Those two portions of the City of Dublin's street system located within the City of
Dublin at the intersection of Fallon Road and Positano Parkway, and more
specifically described in Exhibit A, are unnecessary for present or prospective
public use.
4. Said portions of the City of Dublin's street system are no longer required for street
or highway purposes in that they have been superseded by a reconfiguration of the
street.
5. Said portions of the City of Dublin's street system are not useful as a non-
motorized transportation facility.
6. A copy of this resolution shall be recorded with the County Recorder pursuant to
Streets and Highways Code section 8336. From and after the date of recordation,
those portions of the street system described in Exhibit A shall no longer
constitute a street, highway or public service easement.
7. The City Manager is authorized to execute the Quitclaim Deed, attached hereto as
Exhibit B, to transfer the land vacated by this Resolution to Chang Su-o Lin, a
married woman as her sole and separate property, Hong Yao Lin, a single man,
and Hong Lien Lin, a single man.
