and am thcretore reserving mv rights to comment on specitlc iiesign aspects of the
project at a later date. Unfiortunatcly, T have a hearing in Pleasanton that same
cvening and will nu~st likcly be unable to attend the Dub1i11 Plannino Commission's
hcaring, and am thereforc putting my two initial concerns in writui~.

cont7guration could potentially crcate a constituency that may anake it clifficult to
i-iuild out the Dublin Transit Center as eontemplateci in the Transit C"entcr Specilic
P(an. t tllerefore rcquest that the City requirc the developer to do both ofthe
following: (1) disclose to all potential huyers that the irrimecliate neighborhoc>d is
entitled tbr very )tigh ctensity eoinmercial struc[trres ( up to ten stories tall); ancl
record. on thc titlc pf each unit, a signed acknowledgement by every huycr tha[ t}iey
liave been infot-mcd of the erititlements of the Dublin "Transit Center.
%My second conce;rii is I arri assunling, by the descripeion in the Notice, that there is
no pt-ovision for retail wiillin the Esprit at Dublin Station pro~jECt recognize that
tlle retail spaces in the Dublin 7'ransit Centcr are not Icasing. I have agreccl with the
City and AvalonBay that the anlount of retail required in the Dublin Transit Center
Specitic Plan is excessivc and have suppotted reducing it signiticantly and focusing
it on the fblir corners of lr<~nhorse ancl i'vlartinelli. t the-rei'ore request that the City
require some retail space on thc souUiwest eorner of Martinelli and Ironhorse as part
of,iltis project.
